The aforesaid Special Civil Applications came up
\nbefore me along with Civil Application No. 5820 of 1997.
\nIn the facts and circumstances of the case I consider it
\nappropriate to decide these matters finally today.\n<\/p>\n
These two Special Civil Applications are directed
\nagainst the award dated 8.1.1996 passed by the Labour
\nCourt, Ahmedabad in Reference (LCA) No. 1174 of 1987.
\nSpecial Civil Application No.    4145 of 1996 has been
\nfiled by Gujarat Electricity Board whereas Special Civil
\nApplication No. 2641 of 1997 has been filed by the
\nworkman.    Gujarat Electricity Board is aggrieved against
\nthe relief of reinstatement and the workman is aggrieved
\nagainst    the   denial   of continuity of service and
\nbackwages.\n<\/p>\n
The workman represented through Mr.Shahani was
\nemployed with Gujarat Electricity Board as Clerk.       The
\nparties were at dispute as to whether the workman had
\nactually abandoned the job by tendering his resignation
\nand not reporting on duty or as to whether the workman
\nhad been orally terminated. The dispute raised by the
\nworkman was referred to the Labour Court, Ahmedabad and
\nthe Labour Court, Ahmedabad vide impugned award dated
\n8.1.1996 has granted relief of reinstatement to the
\nworkman without continuity of service         and   without
\nbackwages.   The case of the Gujarat Electricity Board is
\nthat the workman had stopped reporting on duty from
\n17.1.1984.   The Board had sent letter dated 2.3.1984 but
\nthe workman did not file any reply nor he did send any
\ncertificate for being sick.       The Board thereafter sent
\nletters dated 14.6.1984,       19.7.1984,   28.8.1984   and
\n22.10.1984 but the workman did not report for duty. The
\nworkman then submitted his resignation on 30.11.1984
\nwhich   was   addressed     to   Deputy Engineer, Gujarat
\nElectricity Board, Nardipur saying that he was resigning
\nbecause of harassment.      The letter dated 18.12.1984 was
\nsent calling upon him to report for duty, the workman yet
\ndid not report and thereafter         on   31.12.1985   the
\nresignation was accepted and an office order to that
\neffect was passed.      The    order   of   acceptance   of
\nresignation has been placed on record in Special Civil
\nApplication No. 2641 if 1997 as Annexure ‘C’.       Gujarat
\nElectricity Board has come with the categorical case that
\nthe services of the petitioner were never terminated and
\nthat in fact the workman had resigned on 30.11.1984 and
\nhis resignation was accepted on 31.12.1985. The workman
\n had examined himself only before the Labour Court whereas
\nGujarat Electricity Board examined Dahyabhai Hirabhai
\nSolanki.    The   Labour   Court after considering the
\npleadings and with material evidence of both the sides
\nand the submissions which were raised on behalf of the
\nrespective counsel came to the conclusion that the
\nworkman had failed to prove all his pleadings by leading
\neither oral evidence or producing       any   documentary
\nevidence and that he had failed to prove his own pleading
\nregarding oral termination, victimization, threats and
\nexploitation. The Labour Court also found that the Board
\nhad sent several letters to the workman for reporting on
\nduty but the workman failed to report on duty inspite of
\nrepeated letters.      The   Labour   Court   has    also
\ncategorically held in para 12 that it was proved that the
\nworkman had not come before the Court with clean hands
\nand had indulged into suppression of material facts while
\nfiling statement of claim. The Labour Court had also
\nconsidered the plea of the workman that resignation was
\naccepted too late in the day and has also observed that
\nplausible explanation has been given by the Board for
\ndelay in acceptance of the letter of resignation which
\nwas submitted at Nardipur and then it was submitted to
\nthe Executive Engineer and the Labour Court has also
\nobserved that if the workman was interested in doing his
\nduties he should have reported for his duties when
\nletters at exhibits 17 to 22 were written to him. The
\nLabour Court has also recorded that the workman did not
\nreport for duty inspite of several letters by the Board
\nspeaks volumes regarding his credibility and instead of
\nreporting for duties he had chosen to knock the doors of
\nthe Court for getting his job back. Having held so, in
\nthe operative part the Labour Court has granted relief of
\nreinstatement without continuity of service and without
\nbackwages.\n<\/p>\n
One fails to understand how the Labour Court
\ncould grant relief of reinstatement in the light of its
\nfindings and reasons.     The operative part of the order
\npassed by the Labour Court is not at all compatible with
\nits findings and reasons in the earlier part of the
\naward. It is established on record that the workman
\nfailed to report on duty and further that he had tendered
\nresignation   on   30.11.1984   which   was accepted on
\n31.12.1985 and in this view of the matter there is no
\nquestion of granting relief of reinstatement and there is
\nno reason to find any legitimate grievance in favour of
\nthe workman so as to even grant relief of reinstatement
\nin 1996 when the resignation had been accepted way back
\nin 1985.    The finding of fact with regard to the
\nsubmissions and acceptance of the resignation had already
\n become a fait accompli and there was nothing to suggest
\nthat it was a case of oral termination and the case of
\nthe Gujarat Electricity Board that the workman had
\nabandoned the job is fully established.\n<\/p>\n
Mr.Shahani pointed out that the       resignation
\nletter dated 3.11.1984 was accepted on 31.12.1985 and in
\nthe letter of acceptance of the resignation it has been
\nmentioned that on 31.12.1985 the resignation is accepted
\nwith effect from 30.11.1984. The resignation could not
\nbe accepted retrospectively and therefore the acceptance
\nof the resignation itself is bad.   Sofar as the legal
\ncontention goes Mr.Shahani is right in submitting that
\nresignation cannot be granted retrospectively, but in the
\nfacts of this case, it is not possible to grant any
\nrelief to the workman even if this contention is accepted
\nfor the simple reason that the workman never reported for
\nduty despite repeated letters and therefore the relief
\ngranting wages for the periode 30.11.1984 to 31.12.1985
\nalso cannot be granted to him on the principle of ‘no
\nwork no pay’ and also keeping in view the fact that this
\nperiod from 30.11.1984 to 31.12.1985, the workman was not
\nunder any   forced   unemployment.    The contention is
\ntherefore futile in the facts and circumstances of the
\ncase.\n<\/p>\n
In this view of the matter, the Special Civil
\nApplication filed by Gujarat Electricity Board against
\nthe impugned award dated 8.1.1996 deserves to be allowed
\nand the Special Civil Application filed by the workman
\ndeserves to be dismissed.     Accordingly the order dated
\n8.1.1996 passed by the Labour Court granting relief of
\nreinstatement to the workman is hereby quashed and set
\naside and as such there is no question of considering the
\nprayer of the workman for continuity of service and to
\ngrant backwages as has been made in Special Civil
\nApplication No. 2641 of 1997.\n<\/p>\n
Special Civil Application No.     4145 of 1996 is
\ntherefore allowed and the Rule is made absolute whereas
\nSpecial Civil Application No.      2641 of 1997 is hereby
\ndismissed and the Rule is discharged.    No order as to
\ncosts.\n<\/p>\n
CIVIL APPLICATION NO. 5820 OF 1997.\n<\/p>\n
This Civil Application     was   moved    by    the
\nrespondent workman in Special Civil Application No. 4145
\nof 1996.    During the pendency of the Special Civil
\nApplication relief under section 17B of the I.D.Act was
\nsought.   The interim order was passed in Special Civil
\nApplication No.4145 of 1996 on 9.9.1996.     While issuing
\nRule the order of interim relief was confirmed later on
\n after hearing both the sides. After confirmation of the
\nstay order, this Civil Application under section 17B had
\nbeen filed.   Now the main Special Civil Application
\nitself   has been decided, there is no question of
\nconsidering the prayer for 17B of the I.D.Act as the stay
\norder has also come to an end allowing the Special Civil
\nApplication.    The    Civil  Application   is therefore
\ndismissed accordingly.\n<\/p>\n
