JUSTICE HARSHA DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/10\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nthis application, the applicant has prayed for the following<br \/>\nreliefs:-\n<\/p>\n<p>YOUR<br \/>\n\tLORDSHIPS may be pleased to admit and allow this petition;\n<\/p>\n<p>YOUR<br \/>\n\tLORDSHIPS may be pleased to issue appropriate order or directions,<br \/>\n\tdirecting the investigating authority to complete the further<br \/>\n\tinvestigation under Sec.173(8) of Cr.P.C. in connection with FIR<br \/>\n\tbearing C.R. No.I-75\/2004 registered with Godhra Town Police<br \/>\n\tStation; by transferring the further investigation to any<br \/>\n\tindependent agency like CBI, CID Crime or any other superior officer<br \/>\n\tnot below the rank of DSP; as notwithstanding the specific direction<br \/>\n\tissued by this Hon&#8217;ble Court (Coram : Hon&#8217;ble Ms. Justice H.N.<br \/>\n\tDevani) vide order dated 05.02.2008 rendered in Special Criminal<br \/>\n\tApplication No.1958 of 2007 to conduct the further investigation<br \/>\n\tu\/s.173(8) of Cr.P.C. within a period of two months, the<br \/>\n\tinvestigating authority has not laid the report.\n<\/p>\n<p>Pending<br \/>\n\tthe admission, hearing and final disposal of this petition, YOUR<br \/>\n\tLORDSHIPS may be pleased to direct an inquiry by superior officer<br \/>\n\tnot below the rank of DSP regarding the failure of direction issued<br \/>\n\tby this Hon&#8217;ble Court in Special Criminal Application No.1958 of<br \/>\n\t2007, in the interest of justice;\n<\/p>\n<p>YOUR<br \/>\n\tLORDSHIPS may be pleased to grant such other and further relief(s),<br \/>\n\tas may be deemed fit and proper by this Hon&#8217;ble Court, in the<br \/>\n\tinterest of justice.\n<\/p>\n<p>2.\t\tThe<br \/>\nfacts of the case stated briefly are that vide order dated 05th<br \/>\nFebruary, 2008 made in Special Criminal Application No.1958 of 2007,<br \/>\nthis Court had allowed the petition by quashing the order made by the<br \/>\nlearned Chief Judicial Magistrate which was subject matter of<br \/>\nchallenge before the Court and had directed the Investigating Officer<br \/>\nto conduct further investigation under section 173(8) of the Code of<br \/>\nCriminal Procedure, 1973 only qua the request made by the petitioner,<br \/>\nnamely to inquire as to who had signed the notice under section<br \/>\n135(D) of the Bombay Land Revenue Code, by posing as the petitioner<br \/>\nand arraign such person as an accused.  It was further directed that<br \/>\nthe aforesaid exercise shall be carried out within a period of two<br \/>\nmonths from the said date.  It was also made clear that the time<br \/>\nlimit would not be extended in any<br \/>\nevent.\n<\/p>\n<p>3.\t\tSubsequent<br \/>\nthereto, the respondent no.1 &#8211; State of Gujarat preferred an<br \/>\napplication seeking extension of time to complete the investigation<br \/>\nwhich came to be rejected vide order dated 14th<br \/>\nOctober, 2008.\n<\/p>\n<p>4.\t\tThe<br \/>\ngrievance voiced in the present application is that despite the<br \/>\naforesaid directions issued by this Court, the Investigating Officer<br \/>\nhas not concluded the investigation within the time limit stipulated<br \/>\nby the Court and that now the investigating agency was putting forth<br \/>\nan excuse that the time during which the further investigation was<br \/>\ncontemplated to be done was over and, therefore, no further<br \/>\ninvestigation could be carried out.  It is further alleged that the<br \/>\ninvestigating authority has acted in a perfunctory manner and has<br \/>\nallowed the time to pass and now it is sought to be contended that<br \/>\nonce the time limit stipulated by this Court is over, they cannot<br \/>\ncarry out investigation.  It is in the background of the aforesaid<br \/>\nfacts that the applicant has moved the present application seeking<br \/>\nthe reliefs noted hereinabove.\n<\/p>\n<p>5.\t\tThis<br \/>\nCourt has heard learned advocates for the respective parties.\n<\/p>\n<p>6.\t\tVide<br \/>\norder dated 26th March, 2010, this Court had passed an<br \/>\norder in the following terms:-\n<\/p>\n<p>&#8220;1.\tMr.\n<\/p>\n<p>Maulik Nanavati, learned Additional Public Prosecutor states that<br \/>\nfurther investigation is in in progress.\n<\/p>\n<p>2.<br \/>\n\tMr. Ashim Pandya, learned advocate for the respondent No.2 states<br \/>\n\tthat in view of the time limit stipulated by this Court in its<br \/>\n\tearlier order, it is not permissible for the investigating agency to<br \/>\n\tcarry out further investigation.\n<\/p>\n<p>3.<br \/>\nCarrying out further investigation is the sole prerogative of the<br \/>\ninvestigating agency.  Hence, the said contention does not merit<br \/>\nacceptance.\n<\/p>\n<p>The<br \/>\nmatter stands adjourned to 30th April 2010.&#8221;\n<\/p>\n<p>7.\t\tFrom<br \/>\nthe facts noted hereinabove, it is apparent that the main grievance<br \/>\nventilated in the present application is that despite the direction<br \/>\nissued by this Court, the investigation has not been completed within<br \/>\nthe specified time limit and that the investigating agency is now<br \/>\ntaking a stand that in the light of the fact that the time limit<br \/>\nstipulated by the Court has expired, no further investigation can be<br \/>\ncarried out.  However, as recorded in the order dated 26th<br \/>\nMarch, 2010, the learned Additional Public Prosecutor has stated that<br \/>\nfurther investigation is in progress.  In the circumstances, the<br \/>\napprehension voiced by the applicant that in the light of the fact<br \/>\nthat the time limit stipulated by the Court for carrying out further<br \/>\ninvestigation has elapsed, no further investigation would be carried<br \/>\nout, would no longer survive.  Insofar as the other prayer for<br \/>\ntransferring further investigation to any independent agency like<br \/>\nCBI, CID Crime or any other superior officer not below the rank of<br \/>\nDSP is concerned, the same is beyond the scope of an application of<br \/>\nthis nature, and as such cannot be entertained.\n<\/p>\n<p>8.\t\tIn<br \/>\nthe light of the aforesaid, nothing remains to be done in this<br \/>\napplication.
