allowing the claim petition for compen;s_ation;’p’—-. <\/p>\n
seeking enhancement of compensation.<\/p>\n
This MFA coming on for iiearmg

This appeal   against the
\njudgment and award ‘AS_eptember 2005,
\npassed in  Afile of the Motor
\nAccident 3 sllgajrigalore ( Tribunal’ for
\nshort    .coinpensation on the ground
\nthat,   ‘tar Rs.66,880\/– awarded in<\/p>\n
favour of the plaimyant appellant by the Tribunal as<\/p>\n
 of Rs.O8 lakhs, is inadequate.\n<\/p>\n
 ._ 2′;  in brief are that, the appellant is a<\/p>\n

Kannan Road, at that time, a BMTC bus bearing<\/p>\n
Registration No.KA–O1\/F-12060 ceune from right, a<\/p>\n
rash and negligent manner and dashed <\/p>\n
appellant, as a result of which,_the_ it<\/p>\n
sustained grievous head injury zandgalso :fract.ure <\/p>\n
tibia.\n<\/p>\n
3. On account of   in the
\naccident, the appellant’ before the
\nTribunal seei\ufb01\ufb01g of Rs.08.00
\niakhs against’ The said claim
\npetition “”-cerisideration before the
\nTribu\ufb01\u00e9rlg   2005. The Tribunal, after<\/p>\n
consideringvthveVrelevaritimaterial available on \ufb01le and<\/p>\n
 w  aftefr\ufb02appreciatiodn’ of-the oral and documentary evidence,<\/p>\n
 a}Jowedv–.,t}ie”~ciaim petition in part, awarding a sum of<\/p>\n
  interest at 7% per annum from the<\/p>\n
V7.V__dr_,date cfrpetition till the date of reaiization. Being<\/p>\n
  “:,dis:satis\ufb01ed with the quantum of compensation awarded<\/p>\n
by the Tribunal, the appellant is in appeal before this
\nCourt, seeking enhancement of compensation.<\/p>\n
4. The learned counsel for the appiellpant<\/p>\n
submitted at the outset that, the <\/p>\n
committed an error in not awarding just.an..d’freas:onable–\u00ab .. <\/p>\n
compensation towards pain and ,..siivfferrings-, =a;_ci’<\/p>\n
future income, conveyanc-e__, nourishing Ifvoopd  and”<\/p>\n
attendant charges, loss of inco1r1e.V_during_’the period of
\ntreatment and future Virinedicagivvexpenses and hence, it
\nrequires enhancement” ‘unider the’  “heads. Further,
\nhe submitted  :’theTribi;,;.na1, “has erred in not
\nawardlirigl’ any \u00a2ompensa:ion towards loss of amenities of<\/p>\n
life even ltllough -the Doctor has assessed the disability<\/p>\n
   in respevet—\u00abof the left lower limb and 12% in<\/p>\n
  whole body and claimant has been<\/p>\n
adrnittedlasiinpatient on two occasions in the Victoria<\/p>\n
 Hospital, for a period of 42 days. It is the case of the<\/p>\n
 that having regard to the nature of injury,<\/p>\n
which is permanent in nature, the Tribunal ought to
\nhave awarded just and reasonable compensation.\n<\/p>\n
3. We have heard the learned COllI1Sl:E.f1.>_”‘I-CO1’<\/p>\n
appellant for considerable length of time.<\/p>\n
4. After careful evaluation of. the .’original records<\/p>\n
available on \ufb01le, threadbare, <\/p>\n
and award passed by the  the  that” V<\/p>\n
arise for our consideration

The  of the case are, that on<\/p>\n
account uof._Vth.evlaeeideritthat occurred on 17301-2004,<\/p>\n
 th.\u00a2_”\u00a7’\u00ab:.appellant’A”‘has_.esustained head injury and also<\/p>\n
 ‘   tibia and has been admitted to the<\/p>\n
Vlictoriahiilospital on two occasions for a period of 42<\/p>\n
 days: vvll\ufb01s per the evidence of the Doctor, PW2, the<\/p>\n
ff -appellant has suffered dis bility of 35% in respect of the<\/p>\n
  left lower limb and 12 ‘ respect of the whole body.<\/p>\n

6. The Tribunal has erred in taking the income of
\nthe appellant at Rs.1,500\/– per month, without any
\njustification and without assigning convincing reasons.<\/p>\n
The accident occurred during 2004. Therefore,<\/p>\n
of the then Noti\ufb01cations of * the Centra1.–:_:’and.’ <\/p>\n
Governments, we deem it fit and; a,pprop-riateiitjg ‘ii\/:al\u00a7e,Vti3Ve””<\/p>\n
monthly income of the appellant ~<\/p>\n
appellant was aged 19  aslon  the-it<\/p>\n
accident and the Tribunal—–lh’a-s”‘-rightly-adopted ’18’

\nthat the appellant was in–patient for a period of 42_days<\/p>\n
and has taken fo11ow~\u00abup treatment, we award <\/p>\n
Rs.9,000\/– towards loss of income during the  <\/p>\n
treatment.   .\n<\/p>\n
8. The Tribunal has’~aISo erred<\/p>\n

\naccount of disabilityr  1.1ndijspi;ted that. the
\nappellant has ‘isig_1Vgsta1’n_ed\u00a7  other injuries.<\/p>\n

limb and’d”–\u00ab1d2’\u00ab’\/op’i11_  of the Whole body. The said<\/p>\n
 unhappiriess and–discomfort persists through his life.<\/p>\n
 He “has_”un’dergone one surgery and needs one more<\/p>\n
operation’fori”removal of implants. He was in patient for<\/p>\n
 a period of 42 days. The efore, having regard to all<\/p>\n
 aspects, we dee ‘t fit to award a sum of<\/p>\n
