Rizwan                                State of M.P. &amp; others\n\n\n\n\n11.10.2011\n      Shri Akash Choudhary, counsel for petitioner.\n      Shri Kumaresh Pathak, Dy.A.G., for respondent nos.1 to 3 on<\/pre>\n<p>advance notice.\n<\/p>\n<p>      The petitioner has sought following reliefs :-\n<\/p>\n<blockquote><p>             &#8220;(i)    This Hon&#8217;ble Court may kindly be<br \/>\n             pleased to direct the respondent no.1 to 3 to<br \/>\n             take suitable action against the respondent no.4<br \/>\n             &amp; 5 on the basis of recommendation made by<br \/>\n             the Inquiry Officer in his Inquiry Report<br \/>\n             (Annexure P\/4).\n<\/p><\/blockquote>\n<blockquote><p>             (ii)    This Hon&#8217;ble Court may be kindly<br \/>\n             pleased to restrain the respondent no.5 from<br \/>\n             constructing any residential duplexes and mall<br \/>\n             on the land in question.\n<\/p><\/blockquote>\n<blockquote><p>             (iii)   This Hon&#8217;ble Court may be kindly<br \/>\n             pleased to restrain the respondent no.5 from<br \/>\n             selling the constructed residential duplexes in<br \/>\n             open market.\n<\/p><\/blockquote>\n<blockquote><p>             (iv)    This Hon&#8217;ble Court may kindly be<br \/>\n             pleased to restrain the respondents from<br \/>\n             creating any third party interest on the land in<br \/>\n             question.\n<\/p><\/blockquote>\n<blockquote><p>             (v)     This Hon&#8217;ble Court may further pleased<br \/>\n             to declare all the alienation of the plots made by<br \/>\n             respondent no.5 in respect of the land of the<br \/>\n             respondent no.4 society bearing Khasara<br \/>\n             No.7\/1\/2, 7\/1\/4 situated at Bavadiyakala (E\/8<br \/>\n             Extention, near Gulmohar Colony, infront of<br \/>\n             Canal) Bhopal, as null and void.\n<\/p><\/blockquote>\n<blockquote><p>             (vi)     This Hon&#8217;ble Court may further pleased<br \/>\n             to direct the respondent no.1 to take appropriate<br \/>\n             legal action against the erring responsible<br \/>\n             officers of the State Government who have failed<br \/>\n             to discharge their duties.\n<\/p><\/blockquote>\n<blockquote><p>             (vii)  Any other relief which this Hon&#8217;ble Court<br \/>\n             deems fit.&#8221;\n<\/p><\/blockquote>\n<p>      The case in short, of petitioner, is that respondent no.4<br \/>\npurchased certain lands on concessional rate from private persons.<br \/>\nThe sale deed was executed on payment of lower rate of stamp<br \/>\nduty, but the respondent no.4 sold the land to respondent no.5, who<br \/>\n                          W.P.No.14038\/2011<\/p>\n<p>    Mohd. Rizwan                            State of M.P. &amp; others<\/p>\n<p>    is a builder, while the entire purpose of purchase of land by<br \/>\n    respondent no.4 was for providing residential plots to its members.<br \/>\n    It is submitted that on the complaint of petitioner, the matter was<br \/>\n    enquired into by the Inspector of Cooperative, who submitted his<br \/>\n    report Annexure P-4 to the Deputy Commissioner, Cooperative,<br \/>\n    Bhopal on 30.10.2009, but thereafter no action has been taken on<br \/>\n    the aforesaid report.        It is submitted that respondent no.2 be<br \/>\n    directed to decide the matter expeditiously.\n<\/p>\n<p>           Shri Kumaresh Pathak, learned Dy.A.G., submitted that this is<br \/>\n    an old matter and he is not aware whether any action has been<br \/>\n    taken on the report Annexure P-4, but he has no objection if<br \/>\n    respondent no.2 is directed to decide the matter expeditiously.\n<\/p>\n<p>           In view of aforesaid, we finally dispose of this petition with<br \/>\n    following directions :-\n<\/p>\n<p>    1.     Petitioner to move an application to respondent no.2 along<br \/>\n    with a copy of this petition and order passed by this Court today.\n<\/p>\n<p>    2.
