Justice K.K.DENESAN\n\n Dated :13\/03\/2007\n\n O R D E R\n                                 K.K.DENESAN, J\n\n                         -----------------------------------------\n\n                         W.P.(C)NO.6087  of 2007\n\n                         -----------------------------------------\n\n\n\n                Dated this the 13th  day  of  March,  2007\n\n\n\n                                    JUDGMENT\n<\/pre>\n<p>       The petitioner retired on 31.12.2003 while working as Sub<\/p>\n<p>Engineer   in   the   Kerala   State   Electricity   Board.   Disciplinary<\/p>\n<p>proceedings   pending   against   him   have   been   finalised   as   per<\/p>\n<p>Ext.P13   proceedings   of   the   Chairman   of   the   Board   passed   on<\/p>\n<p>24.1.2007. Last paragraph of Ext.P13 says that a lenient view is<\/p>\n<p>taken   in   the   case   of   the   petitioner   and   it   has   been   decided   to<\/p>\n<p>drop the punishment imposed by the Chief Engineer (HRM). The<\/p>\n<p>grievance   of   the   petitioner   is   that   the     benefits   consequent   on<\/p>\n<p>Ext.P13   have   not   been   granted   to   him   by   the   subordinate<\/p>\n<p>authorities.   He   has   filed   Ext.P14   representation   before   the<\/p>\n<p>Secretary   of   the   respondent   Board   requesting   to   grant   him   the<\/p>\n<p>following reliefs:\n<\/p>\n<blockquote><p>          i)      issue   a   writ   of   certiorari   or   any   writ   or<\/p>\n<p>          order to quash the finding of the first respondent<\/p>\n<p>          to   the   extent   that   there   is   no   merit   in   the<\/p>\n<p>          appeal;\n<\/p><\/blockquote>\n<blockquote><p>\n<span class=\"hidden_text\">W.P.(C)No.6087\/2007                                            :2:<\/span><\/p>\n<\/blockquote>\n<blockquote><p>            ii)     issue a writ of mandamus or any other writ<\/p>\n<p>            or direction or order directing the respondents to<\/p>\n<p>            grant the financial benefit on account of dropping<\/p>\n<p>            the  punishment;\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>            iii)    direct   the   respondents   to   promote   the<\/p>\n<p>            petitioner   as   Asst.Engineer   from   the   date   of<\/p>\n<p>            promotion of his junior and grant all consequent<\/p>\n<p>            pecuniary benefits arising therefrom;<\/p>\n<\/blockquote>\n<blockquote><p>            iv)     direct   the   respondents   to   revise   pension<\/p>\n<p>            and   other   pensionary   benefits   immediately   on<\/p>\n<p>            account of 1 and 2 above;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>        2. I have heard the Laision Officer for the respondent Board.<\/p><\/blockquote>\n<p>        3.   It   is   only   appropriate   that   the   Secretary   of   the<\/p>\n<p>respondent Board takes up for consideration Ext.P14 in the light<\/p>\n<p>of   Ext.P13   and   pass   orders   in   accordance   with   law,   as<\/p>\n<p>expeditiously   as   possible.
