No.15980.11\n\n\n             Writ Petition No. 15980 of 2011\n28\/09\/2011\n      Ms. Malti Dadariya, learned counsel for the\npetitioner.\n      Heard.\n      Challenge put forth in this petition is to an\norder     passed      by    the    Central    Administrative\nTribunal, Jabalpur Bench, Jabalpur, on 12-05-2011\nin Original Application No. 692 of 2009; whereby\nthe     relief   sought      by   the    petitioner      seeking\nquashment of the order dated 18-06-2006 whereby\nrejoining of the duty was declined on the ground of\nacceptance       of   his     application     for     voluntary\nretirement, has been declined.\n      The petitioner while in service in the Postal\nService       Department,         Government        of      India,\npreferred an application\/notice under Rule 48-A of\nthe Central Civil Services (Pension) Rules, 1972\nseeking     voluntary       retirement    with   effect       from\n15-03- 2008 vide his application dated 01-01- 2008.\nThe petitioner on the basis of notice tendered by\nhim was relieved from duty as Postal Assistant,\nRewa Head Office, M. P. Circle, with effect from\n15-03- 2008. Subsequent thereafter on 29-03- 2008\nthe petitioner submitted a representation dated\n29-03- 2008 addressed to the Chief Post Master\n                                                       W.P. No.15980.11\n\n\nGeneral, M. P. Circle, seeking withdrawal of the\nvoluntary retirement on the ground that before\nacceptance      of    his    application        for   voluntary\nretirement,      he    vide        his    application         dated\n18-02- 2008 withdrew the same. The representation\nfiled by the petitioner did not reap any result\nleading the petitioner to file Original Application\nNo. 692 of 2009 before the Central Administrative\nTribunal, Jabalpur Bench, Jabalpur, under section\n19 of the Administrative Tribunals Act, 1985.\n      Before Tribunal the case put forth by the\npetitioner     was    that    though       he   tendered         his\nresignation on 01- 01-2008 but vide his application\ndated 18-02-2008 he withdrew the same. It was\nurged that the said application was routed through\nproper      channel   i.e.    it   was     submitted      to     the\nSuperintendent, Post Office, Rewa, who vide postal\narticle Parcel No. 4901 forwarded the same to the\nHead Office. It was contended that ignoring the\naforesaid fact the petitioner was made to retire\nwith effect from 15-03- 2008.\n      The      respondents           on      being       noticed<\/pre>\n<p>contradicted the story put forth by the petitioner.<br \/>\nIt was contended that the petitioner did not tender<br \/>\nany    application      seeking          withdrawal      of      his<br \/>\napplication dated 01-01- 2008. It was contended<br \/>\n                                                        W.P. No.15980.11<\/p>\n<p>that the Parcel wherein it was stated that the said<br \/>\napplication   was     forwarded       to     the    Head     Office<br \/>\ncontained     only     National        Saving        Certificate,<br \/>\nparticulars of a person and did not include the<br \/>\nletter dated 18-02-2008.\n<\/p>\n<p>      The Tribunal on the basis of rival contentions<br \/>\nand on the basis of material documents brought on<br \/>\nrecord observed that the petitioner failed to prove<br \/>\nthe fact that he ever tendered an application dated<br \/>\n18-02- 2008    said     to     be     an      application         for<br \/>\nwithdrawal    of   voluntary        retirement      application.<br \/>\nThe    Tribunal       observed        that     there       is      no<br \/>\ncorroborative evidence as would help the Tribunal<br \/>\nto come to a conclusion that the document i.e.<br \/>\napplication dated 18-02- 2008 said to have been<br \/>\nsent through Parcel No. 4901 actually existed. The<br \/>\nTribunal further discarded the version put forth by<br \/>\nthe retired Superintendent of Post Office on the<br \/>\nground that while in service he did not persuade<br \/>\nthe claim that he had tendered the document dated<br \/>\n18-02- 2008   along     with     Parcel       No.    4901.       The<br \/>\nTribunal on the basis of said observation which in<br \/>\nturn was based on material documents on record<br \/>\nand the rival pleadings declined to accept the plea<br \/>\nof the petitioner that he is being wrongfully retired<br \/>\nfrom service. The petitioner is before us against<br \/>\n                                                             W.P. No.15980.11<\/p>\n<p>the said order.\n<\/p>\n<p>       We     heard           the    learned      counsel    for       the<br \/>\npetitioner at length.\n<\/p>\n<p>       No additional material either is brought on<br \/>\nrecord as would demolish the finding recorded by<br \/>\nthe Tribunal on the basis of the material and<br \/>\npleadings before it. In absence of any material<br \/>\ndocument we are constrained to affirm the finding<br \/>\nrecoded      by     the        Tribunal     as    we     perceive       no<br \/>\nperversity. Onus to prove the facts is on the person<br \/>\nwho wants to take benefit from such facts. In the<br \/>\ncase at hand the petitioner, who had tendered<br \/>\nvoluntary resignation on 01-01-2008 which was to<br \/>\ncome     into      force       with     effect    from   15- 03-2008,<br \/>\nthough submits that he withdrew the resignation<br \/>\nby filing an application on 18-02-2008 had no other<br \/>\ndocuments          or    material       except     a   report    by     an<br \/>\nInspector       dated         31- 03-2009    to    bring    home       the<br \/>\nsubmission that the application dated 18-02-2008<br \/>\nwas duly forwarded. The report which is brought<br \/>\non record as part of Annexure-A\/8, however, when<br \/>\nminutely        observed            does   not    substantiate         the<br \/>\nsubmissions put forth on behalf of the petitioner.<br \/>\nThe report only reflects the statement of the then<br \/>\nSub Post Master, Bansagar Colony, Rewa, who<br \/>\nstated      that        the    letter      was    sent   along       with<br \/>\n                                                 W.P. No.15980.11<\/p>\n<p>registered Parcel No. 4901 whereas on a further<br \/>\nenquiry it is found that the said parcel contained<br \/>\nN.S.C. particular of a person and not the letter<br \/>\ndated 18-02-2008.
