The petition was then<br \/>\namended as permitted by the court by order dated 26.04.2010 praying<br \/>\nthat order dated 12.04.2010 passed below exh.793 and 794; order dated<br \/>\n13.04.2010 passed below exh.795; order dated 13.04.2010 passed below<br \/>\napplications-exh.797 and 798 by the learned Judge, City Civil Court<br \/>\nNo.22, Ahmedabad in Civil Suit No.4149 of 1978 be quashed ans set<br \/>\naside.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate Mr.Sanjanwala for the petitioners and Mr.Gandhi for<br \/>\nthe respondent-auction purchaser.\n<\/p>\n<p>At<br \/>\nthis juncture, learned advocate Mr.Sanjanwala submitted that the<br \/>\nsingle petition is filed challenging the orders passed qua Ahmedabad<br \/>\nproperty as well as Bombay property.  As purchasers of Bombay<br \/>\nproperty are not before this Court he may be permitted to withdraw<br \/>\nthe petition qua  Bombay property with a liberty to file a fresh<br \/>\npetition qua Bombay property.  Taking into consideration the fact<br \/>\nthat the suit was filed for partition of the family properties and<br \/>\nBombay property is sought to be sold for an amount of Rs.54 lacs<br \/>\nthough the next lower bidder of Rs.52 lacs has shown his willingness<br \/>\nto raise the bid to Rs.62 lacs, the court has confirmed the bid at<br \/>\nRs.56 lacs. The learned advocate for the petitioners submitted that<br \/>\nthe petitioners have sentimental attachment with the property, it<br \/>\nbeing the family property and they will see to it that they purchase<br \/>\nthat property for Rs.62 lacs.  The learned advocate submitted that if<br \/>\nthat is permitted the petitioners and other respondents-family<br \/>\nmembers will be benefited because, in that case instead of Rs.56<br \/>\nlacks, Rs.62 lacs will be coming to the common pool and in addition<br \/>\nto that the petitioners will be able to retain their family property.<br \/>\n At this stage, the Court restrains itself from expressing any<br \/>\nopinion on the aforesaid facts and permits the learned advocate for<br \/>\nthe petitioner to withdraw these petitions qua the Bombay property<br \/>\nwith a liberty to file a fresh petition for Bombay property.\n<\/p>\n<p>3.\tSo<br \/>\nfar as Ahmedabad property is concerned, learned advocate<br \/>\nMr.Sanjanwala submitted that the learned Judge without there being<br \/>\nany valuation report on the record, fixed upset price for Ahmedabad<br \/>\nproperty at Rs.5,00,00,000\/- and bids were invited. A bid was<br \/>\nreceived for Rs.6,50,00,000\/-. Learned advocate Mr.Sanjanwala<br \/>\nobjected to the said being accepted and the property being sold for a<br \/>\nsum of Rs.6,50,00,000\/-.  He submitted that as per the information<br \/>\navailable with him the property is valued at Rs.14,00,00,000\/-, if it<br \/>\nis without tenants.  But even if there are tenants, it is valued at<br \/>\nRs.10,99,52,000\/- and odd.  In light of the fact that the learned<br \/>\nJudge fixed upset price without there being any valuation report<br \/>\nbefore him order\/s is\/ are required to be quashed and set aside.\n<\/p>\n<p>4.\t Rule.\n<\/p>\n<p> Mr.Gandhi, learned advocate appearing for the main affected party<br \/>\nand the main contesting party waives service of rule.  At the request<br \/>\nof Mr.Sanjanwala and with the consent of Mr.Gandhi, learned advocates<br \/>\nfor the parties, the matter is taken up for final disposal.  The<br \/>\ncourt below could not have proceeded with fixing up of upset price in<br \/>\nabsence of any valuation report with it. Orders are required to be<br \/>\nquashed and they are accordingly quashed and set aside. At this<br \/>\njuncture, it is deemed fit that the petitioners should be saddled<br \/>\nwith the expenses incurred out of the common pool for the purpose of<br \/>\npast advertisement and also for the fresh valuation report, if any<br \/>\nrequired by the court and for fresh advertisement which will be<br \/>\nrequired to be issued after fixing upset price on the basis of the<br \/>\nvaluation report which may be accepted  by the court below.\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate Mr.Sanjanwala requested that the petitioners be permitted to<br \/>\nsubmit valuation report which is already submitted before this Court.<br \/>\n The request is granted. It will be open for the petitioners to<br \/>\nsubmit the same valuation report before the court below which is<br \/>\nplaced on record here.  But then, it is clarified that in the event<br \/>\nthe Court feels that a fresh valuation report is required, as in this<br \/>\nvaluation report it is mentioned that for having more scientific<br \/>\nvaluation certain more documents are required, it will be open for<br \/>\nthe court below to undertake that exercise and in the event the court<br \/>\ndecides to undertake that exercise the petitioners will have to bear<br \/>\nthe expenses for the same.\n<\/p>\n<p>6.\tLearned<br \/>\nadvocate Mr.Gandhi submitted that expenses of Rs.83,000\/- were<br \/>\nincurred for advertising the sale of the property at the first<br \/>\ninstance and later on an amount of Rs.57,000\/- was  spent for issuing<br \/>\nanother advertisement, the total of which comes to Rs.1,40,000\/-.<br \/>\nThe present petitioners are directed to deposit 50% of this amount as<br \/>\ntheir share with the court below, which will go to the common pool.<br \/>\nSo far as new advertisement is concerned, the expenses for the same<br \/>\nwill be borne by the petitioners.\n<\/p>\n<p>7.\tThis<br \/>\nbrings the Court to issue directions with regard to the aforesaid<br \/>\nexercise in a time frame, namely:\n<\/p>\n<p>The<br \/>\n\tCourt below is directed to undertake the exercise of fixing<br \/>\n\tvaluation of the property either with the help of present valuation<br \/>\n\treport or with the help of fresh valuation report within four weeks<br \/>\n\tfrom today.\n<\/p>\n<p>Once<br \/>\n\tvaluation is fixed, upset price be fixed within next one week.\n<\/p>\n<p>\tAdvertisement<br \/>\n\tbe issued within two weeks thereafter.\n<\/p>\n<p>\tThen to<br \/>\n\tproceed further and complete the entire exercise within eight weeks.\n<\/p>\n<p>At<br \/>\n\tthe request of the learned advocate Mr.Gandhi, it is clarified that<br \/>\n\tit will be open for the present bidder to bid in response to the new<br \/>\n\tadvertisement.  In the event they bid in response to new<br \/>\n\tadvertisement an amount of Rs.6 lacs which they have deposited will<br \/>\n\tbe adjusted against the amount required to be deposited under the<br \/>\n\tfresh advertisement. In the event, in response to the fresh<br \/>\n\tadvertisement, if no higher bid than Rs.6,50,00,000\/- is received<br \/>\n\ttheir offer will be considered in accordance with law. The petition<br \/>\n\tis allowed in the aforesaid terms. Rule is made absolute to the<br \/>\n\taforesaid extent.\n<\/p>\n<p>(RAVI<br \/>\nR.
