SHAH\n\t\t\n\t\n\n \n\nDate\n: 09\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application has been preferred by the applicant herein &#8211;<br \/>\noriginal respondent No.3 &#8211; National Insurance Company for<br \/>\ninterim relief during the pendency and final disposal of the main<br \/>\nFirst Appeal, to stay further implementation, execution and operation<br \/>\nof the judgement and order dated 31\/03\/2005 passed in Motor<br \/>\nAccident Claim Petition No.773\/1996 and order dated 31\/08\/2010<br \/>\npassed in Review Application No.499\/2005 by Learned Judge of Motor<br \/>\nAccident Claims Tribunal,  1st Fast Track Court,<br \/>\nPanchmahals, Godhara.\n<\/p>\n<p>2.\t\tHaving<br \/>\nheard Mr.Dakshesh Mehta, learned advocate appearing on behalf of the<br \/>\napplicant &#8211; appellant and Mr.V.B.Malek, learned advocate<br \/>\nappearing for Mr.Kharadi, learned advocate appearing on behalf of<br \/>\noriginal claimant and considering the deposition of respondent No.2 &#8211;<br \/>\nDriver, there shall be interim relief in terms of para 5(A) on<br \/>\ncondition that the Tribunal shall invest entire amount of<br \/>\ncompensation awarded  by the Tribunal in Fixed Deposits in any<br \/>\nNationalised Bank in the name of Nazir with cumulative interest<br \/>\ninitially for a period of 5 years and the same shall be renewed from<br \/>\ntime to time till final disposal of the main First Appeal. The<br \/>\nclaimant shall not be entitled to get interest on the aforesaid FDRS.<br \/>\nThe FDRS shall be kept with Nazir of the Tribunal and there shall not<br \/>\nbe any loan\/advance on the said FDRS.\n<\/p>\n<p>3.\t\tIn<br \/>\nthe facts and circumstances of the case, Registry is directed to call<br \/>\nfor records and proceedings of the case from the Tribunal so as to<br \/>\nreach this Court on or before 20th June,2011. Paper book<br \/>\nand printing is dispensed with.\n<\/p>\n<p>\t\tRegistry<br \/>\nis directed to notify the main First Appeal for hearing on 22nd<br \/>\nJune,2011 at the bottom of the first board.
