DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\t \n\t\t \n\t\t\t \n\nDate\n\t\t\t: 10\/03\/2010 \n\t\t\t\n\t\t\n\t\n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nMr B Y Mankad, learned Advocate for the applicant and  learned<br \/>\nAdvocate Mr K B Anandjiwala, who states that he has instructions to<br \/>\nappear on behalf of the original accused namely, respondents No.3, 4<br \/>\nand  5.\n<\/p>\n<p>2.\t\tIt<br \/>\n is submitted that the learned Sessions Judge, Kachchh at Bhuj, while<br \/>\npassing order below Exh.16 in Criminal Misc.Application No.43 of 2010<br \/>\npreferred by the applicants-original accused, suspended condition<br \/>\nNo.5 imposed in Criminal Misc. Application No.47 of 2009 regarding<br \/>\nnon-entering of the original accused in the district of Kachchh for a<br \/>\nperiod of three months even though the application considering the<br \/>\nmain prayer to delete condition No.5 imposed regarding non-entering<br \/>\nof the accused in Kachchh district  was rejected and also the prayer<br \/>\nfor  revoking   condition  till further order also came to be<br \/>\nrejected.  Learned Advocate for the original complainant further<br \/>\nsubmits that thereafter Misc.Criminal Application was filed  by the<br \/>\noriginal complainant to stay the above order dated 26.2.2010 passed<br \/>\nby the learned Sessions Judge, Kachchh at Bhuj and accordingly the<br \/>\nlearned Sessions  Judge has suspended the order dated 26.2.2010 till<br \/>\n12.3.2010.\n<\/p>\n<p>3.\t\tIt<br \/>\nis  submitted that in a case where the accused are facing trial for<br \/>\noffence under section 307 etc. of IPC and they continuously<br \/>\nthreatening the complainant and other witnesses and even the<br \/>\nprosecution has also expressed danger of threat to the witnesses and<br \/>\ntampering with evidence etc., there was no justification for the<br \/>\nlearned Sessions Judge to suspend condition No.5 imposed by  the<br \/>\noriginal order granting bail in Criminal Misc.Application 47 of 2009<br \/>\nby suspending it for a period of 3 months.\n<\/p>\n<p>4.\t\tMr<br \/>\nK B Anandjiwala, learned Advocate appearing for the respondents<br \/>\nsubmits that initially  the accused were enlarged on bail and by<br \/>\npreferring application before this court, the original complainant<br \/>\nhas restrained them from  getting the benefit of bail order and the<br \/>\ntrial is indefinitely  delayed and there is no certainty.    It is<br \/>\nfurther submitted  that no threat was ever administered by the<br \/>\noriginal  accused nor any attempts were made by the accused to induce<br \/>\nor threat  any witness or tamper with the evidence.  Since discretion<br \/>\nis exercised by the learned Sessions Judge considering the rival<br \/>\nsubmissions, it  is submitted that no case is made out to interfere<br \/>\nwith the order passed by the learned Sessions Judge in exercise of<br \/>\npowers under section 482 of the Code of Criminal Procedure.\n<\/p>\n<p>5.\t\tHaving<br \/>\nheard the learned Advocates for the parties including the learned<br \/>\nAPP, I am of the opinion that when request and prayer or original<br \/>\naccused to cancel\/suspend condition No.5 imposed in Criminal Misc.<br \/>\nApplication No.47 of 2009, while enlarging the accused by granting<br \/>\nbail and specific condition regarding non-entering of the accused in<br \/>\nKachchh district was considered and rejected and even further prayer<br \/>\nto revoke the said condition also came to be rejected, there was no<br \/>\njustification for the learned Sessions Judge to suspend the operation<br \/>\nof condition No.5 for a further period of 3 months in absence of  any<br \/>\nmaterials.\n<\/p>\n<p>6.\t\tThe<br \/>\nabove approach of the learned Sessions Judge is contrary to law and<br \/>\nagainst fair trial when there are specific allegations against the<br \/>\naccused and the applications have been filed before the District<br \/>\nAdministration that the accused have induced threats to the witnesses<br \/>\nincluding the complainant  itself is sufficient and proper to quash<br \/>\nand  set aside the order and accordingly  the order dated 26.2.2010<br \/>\npassed in Criminal Misc. Application No.43 of 2010 is hereby quashed<br \/>\nand set aside.  This petition   is allowed.  Direct Service is<br \/>\npermitted.\n<\/p>\n<p>\t\t\t\t\t\t\t[ANANT<br \/>\nS.
