The Applicant filed an     RTI application dt.15.9.08 with the PIO, DRM Office, North<br \/>\n      Eastern Railway Lucknow requesting for information against 2 points with regard to<br \/>\n      regularization of an employee Shri. Manmohan although he was promoted to a post<br \/>\n      which was abolished in 6 months as per notification dt.30.5.91. The PIO replied on<br \/>\n      30.1.09 informing the Applicant that Shri Manmohan post was extended              as   per<br \/>\n      orders . He also provided detailed clarification against point 2 of the RTI application.<br \/>\n      Nort satisfied with the reply, the Applicant filed an appeal dt.15.4.09 commenting on<br \/>\n      the PIO&#8217;s reply and seeking further clarification which was provided by the Appellate<br \/>\n      Authority on 8.7.09.     Still not satisfied, the Applicant filed a second appeal dt.3.9.09<br \/>\n      before CIC.\n<\/p>\n<p>2.    The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing<br \/>\n      for February 15, 2010 through video conferencing.\n<\/p>\n<p>3.    Shri Jagdish, PIO, Shri Anil Dadoria, Appellate Authority and Shri Jaydev Kumar,<br \/>\n      Sr.DPO representing the Public Authority and the applicant were present at NIC<br \/>\n      Studio, Lucknow.\n<\/p>\n<p>Decision<\/p>\n<p>4.    The Respondent, Shri Jagdish submitted that vide notification dt.30.5.91, promotion<br \/>\n      was given to Shri Manmohan and he was placed in a post which was expected to be<br \/>\n      abolished in 6 months. However, the post was extended at the end of 6 months and<br \/>\n      Shri Manmohan was allowed to continue on this post and he was regularized.             The<br \/>\n      Appellant wanted to know the rule by which Shri Manmohan&#8217;s post was extended and<br \/>\n      he was regularized although his post was abolished after 6 months.\n<\/p>\n<p>5.    After hearing both sides, the Commission holds that complete information has been<br \/>\n      provided by both the PIO and the Appellate Authority. However, in the interest of the<br \/>\n      Appellant, the Commission directs the PIO to allow the Apellant inspect the promotion<br \/>\n      file   of Shri Manmohan and to provide the Appellant attested copies of documents<br \/>\n        sought by him free of cost. Information to be provided by 15 March, 2010 and the<br \/>\n       Appellant to submit a compliance report to the Commission by 22.3.10.\n<\/p>\n<p>6.
