He further submitted that it is a case of cross complaint<br \/>\n\twhere the present applicants are assaulted by the opposite party. He<br \/>\n\tsubmitted that the victims, who are alleged to have been assaulted<br \/>\n\tby the applicants, have been discharged from the hospital. He,<br \/>\n\ttherefore, submitted that as now the chargesheet has been filed and<br \/>\n\tother co-accused have been released on bail, the present application<br \/>\n\tmay be allowed.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Nanavati resisted the present application.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel appearing for the applicants-accused and<br \/>\n\tlearned A.P.P. for the State and having considered the papers and<br \/>\n\talso considering the nature of offence, manner in which it is<br \/>\n\talleged to have been committed, role attributed and also considering<br \/>\n\tthe fact that it is a case of cross complaint where the applicants<br \/>\n\tare also assaulted and the victims, who are alleged to have been<br \/>\n\tassaulted by the applicants, are discharged from the hospital and<br \/>\n\tare out of danger, the present applications deserves to be allowed<br \/>\n\tin view of the fact that the chargesheet has now been filed and<br \/>\n\tother co-accused have been released on bail.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicants are ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.70\/2010<br \/>\n\tregistered with Harij Police Station, District : Patan on their<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five Thousand Only) each with<br \/>\n\tone solvent surety of the like amount to the satisfaction of the<br \/>\n\tlower Court and subject to the conditions that they shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of their residence to the Investigating Officer and also<br \/>\nto the Court at the time of execution of the bond and shall not<br \/>\nchange their residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\ntheir passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\ntheir presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the trial<br \/>\ncommences.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
