Justice T.R.RAMACHANDRAN NAIR\n\n Dated :23\/11\/2009\n\n O R D E R\n                T.R RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.31974 of 2009\n                     --------------------------\n            Dated this the 23rd November,2009\n\n                       J U D G M E N T\n<\/pre>\n<p>      Petitioner herein is aggrieved by the delay in<\/p>\n<p>granting approval of appointment of the petitioner as a<\/p>\n<p>Full-time Menial in the school in question. Petitioner was<\/p>\n<p>appointed as     Full Time Menial on          5.2.2009 in the<\/p>\n<p>vacancy of Sri.Mony T.S, who was promoted as Peon with<\/p>\n<p>effect from 5.2.2009.     Ext.P1 is the copy of the said<\/p>\n<p>appointment order.\n<\/p>\n<p>      2.    It is the case of the petitioner that         the<\/p>\n<p>Manager had already appointed              a part-time H.S.A<\/p>\n<p>(Malayalam) protected teacher in the school going by<\/p>\n<p>Ext.P3 order. The same has been approved as per Ext.P4.<\/p>\n<p>Petitioner submitted Ext. P6 application before the Pubic<\/p>\n<p>Information Officer to get various details. Ext.P7 reply<\/p>\n<p>was given by the Public Information Officer of the D.P.I,<\/p>\n<p>wherein, it is stated that     in   Kottarakara Educational<\/p>\n<p>District there is no protected Full Time Menial available<\/p>\n<p>for re-deployment.\n<\/p>\n<p>W.P ( C) No.31974 of 2009<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       3.    In the statement filed on behalf of the 3rd<\/p>\n<p>respondent, it is averred in paragraph 3 that there is no<\/p>\n<p>protected Full time Menial in the Educational District or<\/p>\n<p>in the Revenue District.     But there are several protected<\/p>\n<p>non teaching staff including Full Time Menial available in<\/p>\n<p>the other Revenue Districts.\n<\/p>\n<p>       4.    Going by the express provision in Rule 6 (viii)<\/p>\n<p>Chapter V, K.E.R the obligation of the Manager is only in<\/p>\n<p>terms of the said provision. Therefore, the appointment of<\/p>\n<p>a protected teacher       from any other Revenue District<\/p>\n<p>cannot be imposed on against the Manager. The said<\/p>\n<p>legal position has been declared by this Court in         the<\/p>\n<p>judgment in W.P (C) No.4623 of 2009.,<\/p>\n<p>       5.    Therefore, in the light of the fact that there is<\/p>\n<p>no protected Full time Menial available in the Educational<\/p>\n<p>District or in the Revenue District, the approval of the<\/p>\n<p>appointment cannot be declined on that ground.<\/p>\n<p>       6.    There will be a direction to the 3rd respondent<\/p>\n<p>to pass orders on the approval of appointment in the light<\/p>\n<p>of the above finding within a period of one month from the<\/p>\n<p>date of receipt of a copy of this judgment.
