SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent Second Appeal under Section 100 of the Code of Civil<br \/>\nProcedure has been preferred by the appellants-original defendants to<br \/>\nquash and set aside the impugned judgement and order dated 31st<br \/>\nMarch, 2009  passed by the learned Additional District Judge, Second<br \/>\nFast Track Court, Navsari in Regular Civil Appeal No. 40\/2003 in<br \/>\ndismissing the same and confirming the judgement and decree dated<br \/>\n27th March, 2003 passed by the learned Civil Judge (Junior<br \/>\nDivision), Gandevi in Civil Suit No. 131\/2000 by which the learned<br \/>\ntrial Court decreed the suit in favor of the respondent-original<br \/>\nplaintiff granting injunction as prayed for.\n<\/p>\n<p>2.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties and considering the impugned judgement and order passed by<br \/>\nboth the Courts below it appears that there are concurrent findings<br \/>\nof fact given by both the Courts below with respect to the right of<br \/>\nthe respective parties, more particularly, the appellants-original<br \/>\ndefendants in the suit property.  On appreciation of evidence, both<br \/>\nthe Courts below have concurrently found that the appellants-original<br \/>\ndefendants  have no right or title on the disputed land in question<br \/>\nand, therefore, allowed the suit and granted permanent injunction<br \/>\nagainst the appellants-original defendants, which are not required to<br \/>\nbe interfered with by this Court in exercise of powers under Section<br \/>\n100 of the Code of Civil Procedure.\n<\/p>\n<p>3.\tAs<br \/>\nsuch, the learned advocate appearing on behalf of the<br \/>\nappellants-original defendants has failed to satisfy the Court that<br \/>\nany substantial question of law arises to be considered by this Court<br \/>\nin the present Second Appeal.\n<\/p>\n<p>4.\tIn<br \/>\nabsence of any substantial question of law to be considered by this<br \/>\nCourt in the present Second Appeal, the present Second Appeal<br \/>\ndeserves to be dismissed and is accordingly dismissed.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(M.R.\n<\/p>\n<p>SHAH, J.)<\/p>\n<p>siji<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Lallubhai vs Pravinbhai on 21 April, 2010 Author: M.R.
