They seek quashing of the complaint at<br \/>\n&#8220;ANNEXURE-A&#8221;,<br \/>\nbearing M. Case No.3 of 2010, registered with Fatehpura Police<br \/>\nStation, District : Dahod, for the offences punishable under<br \/>\nSection-366 read with Section-114 of the Indian Penal Code.\n<\/p>\n<p>2.\t\tComplainant<br \/>\nis the father of one Kantaben. He has alleged that the petitioner<br \/>\nNo.1 had, on 11.05.2010, enticed his daughter and runaway with her,<br \/>\nin order to get marry. Petitioner Nos. 2 and 3 are the father and<br \/>\nmother of petitioner No.1, respectively. It is alleged that<br \/>\npetitioner No.1 is a married person and also has children from the<br \/>\nfirst marriage.\n<\/p>\n<p>3.\t\tIt<br \/>\nis not in dispute that the daughter of the complainant was, at the<br \/>\nrelevant point of time, aged about 19 years.  Her date of birth, as<br \/>\nper the school<br \/>\nrecord, is shown to be 10.06.1991.  The petitioners have also<br \/>\nproduced the certificate of marriage between petitioner No.1 and<br \/>\nKantaben, dated 07.07.2010.  It is not even the case of the<br \/>\ncomplainant that his daughter was minor or that she was forcibly<br \/>\ntaken out of his care and protection.\n<\/p>\n<p>4.\t\tUnder<br \/>\nthe circumstances, no case of kidnapping is made out.  It is the case<br \/>\nof the complainant that petitioner No.1 is a married person, and<br \/>\ntherefore, could not have married to his daughter, when the first<br \/>\nmarriage is subsisting.  This, however, is a separate issue<br \/>\naltogether. Whether the offence of bigamy is made out or not and who<br \/>\ncan complain about such an offence are the issues, which are not<br \/>\ngermane in this petition.  In that view of the matter, it is not<br \/>\nnecessary to examine the evidence of petitioner No.1 that he was<br \/>\nalready divorced and that the father of his first wife has also filed<br \/>\nan affidavit to that effect. In the present case, only charge is that<br \/>\nof kidnapping, which I do not find is disclosed.\n<\/p>\n<p>5.\t\tUnder<br \/>\nthe circumstances, the complaint at &#8220;ANNEXURE-A&#8221;, bearing<br \/>\nM. CASE NO.3 OF 2010,<br \/>\nregistered with FATEHPURA<br \/>\nPolice Station, District : DAHOD,<br \/>\nis QUASHED.\n<\/p>\n<p>Rule is made absolute.
