KRISHNAN, J.\n              = = = = = = = = = = = = = =\n                INS.APPEAL NO. 30 OF 2007\n            = = = = = = = = = = = = = = =\n        Dated this the 31st day of July, 2008.\n\n                      J U D G M E N T\n<\/pre>\n<p>     This appeal is preferred against the judgment of the<\/p>\n<p>Employees Insurance Court, Palakkad in I.C.32\/04.         The<\/p>\n<p>appellant was the applicant before the       E.I. Court, who<\/p>\n<p>challenged the notice issued by the Corporation holding that<\/p>\n<p>the establishment is covered under the provisions of the E.I.<\/p>\n<p>Act. The applicant&#8217;s establishment is a petrol bank and the<\/p>\n<p>Court below held that selling of petrol with the aid of power<\/p>\n<p>amounts to manufacturing process under Section 2(k) of the<\/p>\n<p>Factories Act and since the said manufacturing process is<\/p>\n<p>adopted under Section 2(14-AA) of ESI Act and as S.2(12)<\/p>\n<p>envisages manufacturing process, the Tribunal held hat the<\/p>\n<p>contention of the appellant that it is not covered cannot be<\/p>\n<p>accepted. It also found on facts that there were more than<\/p>\n<p>10 employees and it has been using power and therefore<\/p>\n<p>held that the establishment is covered by the Act.<\/p>\n<p>Ins. Appeal 30 OF 2007<br \/>\n<span class=\"hidden_text\">                              -:2:-<\/span><\/p>\n<p>      2.    Learned counsel for the appellant very strongly<\/p>\n<p>contends before me that usage of a small motor for pumping<\/p>\n<p>out oil in a petrol bunk does not amount to manufacturing<\/p>\n<p>process and therefore the decision of the Court below is<\/p>\n<p>erroneous. But it has to be sated that a Division Bench of<\/p>\n<p>this Court on examining the provisions of S.2(k) in MFA<\/p>\n<p>796\/00 held that pumping of petroleum products from the<\/p>\n<p>storage for supply thereof to the vehicles comes under the<\/p>\n<p>ambit of manufacturing process. It is also seen that<\/p>\n<p>Allahabad High Court has also taken the same view in the<\/p>\n<p>decision reported in Qazi Noorul Hasan Hamid Hussain<\/p>\n<p>Petrol Pump v. Deputy Director E.S.I. Corporation,<\/p>\n<p>Kanpur (2003 LLR 476) to the effect that petrol is supplied<\/p>\n<p>by usage of power and more than 10 persons are employed<\/p>\n<p>it is sufficient to prove it within the definition of<\/p>\n<p>manufacturing process under the Factories Act. The Punjab<\/p>\n<p>and Haryana high Court also had taken the same view in the<\/p>\n<p>decision    reported in  <a href=\"\/doc\/752130\/\">Employees&#8217;     State   Insurance<\/p>\n<p>Corporation v. Bhag Singh (AIR<\/a> 1989 Punjab and<\/p>\n<p>Ins. Appeal 30 OF 2007<br \/>\n<span class=\"hidden_text\">                               -:3:-<\/span><\/p>\n<p>Haryana 1).      Since the Division Bench of this Court has<\/p>\n<p>taken a view and there are other decisions of various other<\/p>\n<p>High Courts it may not be correct for me to again dwell deep<\/p>\n<p>into the averment for the reason this Court is bound by the<\/p>\n<p>decision of the Division Bench unless it is varied. Therefore<\/p>\n<p>though the argument of the learned counsel appears to be<\/p>\n<p>very persuasive I am not in a position to consider it in the<\/p>\n<p>light of a binding precedent on me. Therefore the said point<\/p>\n<p>is answered against.\n<\/p>\n<p>      3.    The next question is regarding the number of<\/p>\n<p>employees.      Learned counsel wanted to contend before<\/p>\n<p>before me that it is an erroneous finding on fact. It is very<\/p>\n<p>clear that unless there is a substantial question of law an<\/p>\n<p>appeal cannot be entertained. While dealing with the cases<\/p>\n<p>on second appeals regarding the scope of substantial<\/p>\n<p>question of law the Apex Court held in <a href=\"\/doc\/1754551\/\">Gurdev Kaur v. Kaki<\/p>\n<p>(AIR<\/a> 2006 (SC) 1975) that even if a different view is<\/p>\n<p>possible to be taken the appellate court is not expected to<\/p>\n<p>substitute its view with the finding on facts and further<\/p>\n<p>Ins. Appeal 30 OF 2007<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>cautioned that it shall not be a dice for another trial.    So,<\/p>\n<p>unless there is absolute perversity or illegality this Court<\/p>\n<p>cannot substitute the view of a fact finding Court by its own<\/p>\n<p>view. Therefore I do not find any substantial question of law<\/p>\n<p>on the number of persons. So from these discussions it is<\/p>\n<p>correct to hold that manufacturing process is involved and<\/p>\n<p>more than 10 persons are employed and power is used and<\/p>\n<p>so the provisions of E.S.I. Act is applicable to the appellant&#8217;s<\/p>\n<p>establishment. The appeal is devoid of merits and therefore<\/p>\n<p>it is dismissed.\n<\/p>\n<\/p>\n<p>                            M.N.
