Justice S.SIRI JAGAN\n\n Dated :07\/06\/2010\n\n O R D E R\n                          S.S.SIRI JAGAN, J.\n                ------------------------------------------\n                      W.P(C) No.16844 OF 2010\n                ------------------------------------------\n                 Dated this the 7th day of June, 2010\n\n                               JUDGMENT\n<\/pre>\n<p>      Petitioners are the children of an estranged couple. The<\/p>\n<p>petitioners are represented in this writ petition by their mother.<\/p>\n<p>Mother is residing at Chengannur after the separation from the<\/p>\n<p>father. The children are presently enrolled in the Sree Narayana<\/p>\n<p>Central School, Chirakkadavu, Kayamkulam. The children are in<\/p>\n<p>the custody of the mother. The mother is residing at<\/p>\n<p>Chengannur. She cannot come to Kayamkulam because she is<\/p>\n<p>estranged from her husband who lives at Kayamkulam.<\/p>\n<p>Therefore, the children need a transfer to a school nearer to the<\/p>\n<p>house of the mother. When the mother approached the second<\/p>\n<p>respondent for a T.C for that purpose, the second respondent<\/p>\n<p>informed the mother that without the consent of the father, who<\/p>\n<p>is the third respondent herein, T.C. cannot be issued to the<\/p>\n<p>children. It is under the above circumstances, petitioners have<\/p>\n<p>approached this court seeking the following reliefs.<\/p>\n<p>            i. issue a writ of mandamus or any other appropriate<br \/>\n            writ order or direction commanding the second<br \/>\n            respondent to issue Transfer Certificates (T.Cs) to<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.16844 OF 2010            2<\/span><\/p>\n<p>           the petitioners at the earliest.\n<\/p>\n<p>           ii. Issue any appropriate writ or mandamus or<br \/>\n           any other writ order or direction commanding<br \/>\n           the first respondent to take necessary action<br \/>\n           against the second respondent and the school<br \/>\n           concerned for violating CBSE examination by-<br \/>\n           laws.\n<\/p>\n<p>           Iii. Grant such other reliefs as this Hon&#8217;ble<br \/>\n           Court deems fit and proper.\n<\/p>\n<\/p>\n<p>     2. Counter affidavits have been filed by the second<\/p>\n<p>respondent and the third respondent.            The second<\/p>\n<p>respondent would take the contention that without the<\/p>\n<p>consent of the guardian of the children, namely father,<\/p>\n<p>Transfer Certificates cannot be issued to the children. The<\/p>\n<p>third respondent has taken several contentions which I do<\/p>\n<p>not propose to record in this writ petition, since the same<\/p>\n<p>may not be conducive to the welfare of the children.<\/p>\n<p>Suffice to say that the third respondent does not agree<\/p>\n<p>with the requests for Transfer Certificates of the children<\/p>\n<p>from the present school.\n<\/p>\n<p>     3. I have considered the rival contentions in detail.<\/p>\n<p>This court should naturally be interested in the welfare of<\/p>\n<p>the children than the dispute between the parents. The<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.16844 OF 2010            3<\/span><\/p>\n<p>welfare of the children lies in continuance of their education<\/p>\n<p>uninterruptedly. Presently they are in the custody of the<\/p>\n<p>mother at Chengannur.       It may not be possible for the<\/p>\n<p>mother to get the children educated in the second<\/p>\n<p>respondent school at Kayamkulam. Despite the objections<\/p>\n<p>raised by the third respondent, he does not dispute the fact<\/p>\n<p>that the custody of the children is with the mother and that<\/p>\n<p>he has not taken any steps before the appropriate<\/p>\n<p>authorities for getting custody of the children. That being<\/p>\n<p>so, I am satisfied that the dispute between the mother and<\/p>\n<p>the father should not stand in the way of continuance of<\/p>\n<p>the education of the petitioners, which can presently only<\/p>\n<p>be at Chengannur, since the mother who has the custody<\/p>\n<p>of the children is residing at Chengannur. Therefore,<\/p>\n<p>notwithstanding the objections raised by the third<\/p>\n<p>respondent, in the interests of the welfare of the children, I<\/p>\n<p>direct the second respondent to issue Transfer Certificates<\/p>\n<p>to the petitioners as requested for as expeditiously as<\/p>\n<p>possible, at any rate, within one week from the date of<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.16844 OF 2010           4<\/span><\/p>\n<p>receipt of a copy of this judgment.
