Same shall be carried out.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate for the petitioner. The petitioner under Article<br \/>\n\t226 of the Constitution of India has approached this Court with<br \/>\n\tfollowing prayers:-\n<\/p>\n<p>&#8220;(A).\n<\/p>\n<p>Your Lordships may be pleased to issue a writ of mandamus or any<br \/>\nother appropriate writ, order and\/or directions, quashing and setting<br \/>\naside the impugned order dated 15.3.2010 passed by respondent no.2<br \/>\n(Annexure A) as being illegal, arbitrary, unjust, unreasonable and an<br \/>\norder made in violation of principles of natural justice.\n<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order and\/or directions, directing the respondent<br \/>\nno.2 to forthwith cancel the development permission granted vide<br \/>\norder bearing No. PRM 11\/2003 dated 1.7.2004 in respect of land<br \/>\nbearing survey No. 1\/13\/2 situated at Mouje : Kalol, District :<br \/>\nGandhinagar as being contrary to relevant regulations of the Gujarat<br \/>\nDevelopment Control Regulations framed u\/s. 12 of the Gujarat Town<br \/>\nPlanning and Urban Development Act, 1976;\n<\/p>\n<p>(C)<br \/>\n\tYour Lordships may be pleased to stay the impugned order dated<br \/>\n\t15.3.2010 passed by respondent no.2 (Annexure A) as being illegal,<br \/>\n\tarbitrary, unjust, unreasonable and an order made in violation of<br \/>\n\tprinciples of natural justice.\n<\/p>\n<p>(D)<br \/>\n\tYour Lordships may be pleased to direct the respondent no.2 to<br \/>\n\tforthwith act in accordance with the applicable regulations under<br \/>\n\tthe Gujarat Development Control Regulations for the breach committed<br \/>\n\tin respect of land bearing survey No. 1\/13\/2 situated at Mouje:<br \/>\n\tKalol, District: Gandhinagar, pending the admission hearing and<br \/>\n\tfinal disposal of this petition in the interest of justice;\n<\/p>\n<p>(E)<br \/>\nYour Lordships may be pleased to grant such other and further reliefs<br \/>\nas deemed fit in the interest of justice.&#8221;\n<\/p>\n<p>\tThus<br \/>\nessentially what is challenge in the communication dated 15\/3\/2010<br \/>\nissued by respondent no. 2 &amp; 3 indicating therein that there<br \/>\nexists no case for revoking development permission granted in favour<br \/>\nof the land owner of land bearing Survey No. 1\/13\/2.\n<\/p>\n<p>The<br \/>\n\tfacts as culled from the memo of the petition, and leading to filing<br \/>\n\tthis petition deserve to be set out as under.\n<\/p>\n<p>\tThe<br \/>\nland bearing survey no. 1\/13 admeasuring 51726 sq. meter (approx)<br \/>\nsituated at mouje Kalol, District Gandhinagar was in the name of late<br \/>\nShri Mohanbhai Lalubhai Shukla, grandfather of the petitioner. After<br \/>\nthe demise of Shri Mohanbhai Lalubhai Shukla, the said land was<br \/>\ndivided in to two equal parts i.e. Revenue Survey No. 1\/13\/1<br \/>\nadmeasuring 25863 sq. meter in the  name of Jaydevbhai Mohanbhai and<br \/>\nRevenue Survey No. 1\/13\/2 admeasuring 25863 sq. meter in the name of<br \/>\nReghubhai Mohanbhai. The revenue records were accordingly mutated.<br \/>\nThe petitioner is managing affairs of land bearing survey no. 1\/13\/1<br \/>\nin his capacity as power of attorney holder on behalf of  all the<br \/>\nfamily members of late Shri Jaydevbhai Shukla after the demise of<br \/>\nShri Jaydevbhai Shukla.  The plans for development were placed in<br \/>\nrespect of and bearing survey no. 1\/13\/1 in the year 1998 for<br \/>\nproposed housing scheme to be implemented in 18363 sq. meter out of<br \/>\n25863 sq. meters of land of survey no. 1\/13\/1. The plans were<br \/>\nsanctioned vide order dated 18\/7\/1998. Thereafter petitioner sold<br \/>\n18363 sq. meter of land to one Ishwar Corporation and balance 7500<br \/>\nsq. meter of land of said survey no. 1\/13\/1 is retained by the<br \/>\npetitioner.  The petitioner has averred in the memo of the petition<br \/>\nthat one Reghudevbhai &#8211; brother of late Shri Jaydevbhai &amp;<br \/>\nuncle of the petitioner transferred his share of land bearing revenue<br \/>\nsurvey no. 1\/13\/2 admeasuring 25863 sq. meter to one Shri Jaydeepsinh<br \/>\nA. Bhati, who in turn as power of attorney holder of uncle of the<br \/>\npetitioner, submitted a plan to respondent no.2 for the proposed<br \/>\nHousing society (Tenements) in respect of land bearing revenue survey<br \/>\nno. 1\/13\/2.  Petitioner in the memo of the petition averred that<br \/>\nrespondent no.2 vide order dated 1\/7\/2004 sanctioned the plan. The<br \/>\nsaid plan was not indicating of correct land and the land belonging<br \/>\nto the petitioner were shown to be part of the land for which the<br \/>\nplan was sought to be placed and development permission was sought to<br \/>\nbe obtained. Therefore petitioner made various representations and he<br \/>\nhad to move this Court also time &amp; again for seeking appropriate<br \/>\nrelief, wherein this Court directed the authorities to decide the<br \/>\nrepresentation of the petitioner in accordance with law. The<br \/>\npetitioner preferred Regular Civil Suit No. 85\/2005 before the<br \/>\ncompetent court wherein the petitioner has succeeded in obtaining<br \/>\nappropriate injunction order against the concerned person for not<br \/>\nputting up construction in any manner on the land which is prima<br \/>\nfacie said to be belonging to the petitioner, and it is forming part<br \/>\nof the plan. This injunction order dated 15\/10\/2005 is also pressed<br \/>\ninto service. However same is not available as respondent authorities<br \/>\nhave sent communication dated 15\/3\/2010 which is impugned in this<br \/>\npetition and also the inaction on the part of respondent authorities<br \/>\nin not supplying the petitioner copies of report of District Land<br \/>\nRecords Officer&#8217;s drawings for declining the claim of the petitioner.\n<\/p>\n<p>Mrs.\n<\/p>\n<p>\tPahuwa, learned advocate appearing for the petitioner relying upon<br \/>\n\tprovision in the form of Section 3.8 of the GDC Regulations, framed<br \/>\n\tunder Gujarat Town Planning &amp; Urban Development Act 1976<br \/>\n\tsubmitted that the development permissions if obtained fraudulently<br \/>\n\tthen, there exist discretionary authority to revoke the same.<br \/>\n\tEmphasis is placed in Regulation 3.8 of the Regulations.\n<\/p>\n<p>Mrs.\n<\/p>\n<p>\tPahuwa further submitted that the communication dated 15\/3\/2010<br \/>\n\timpugned in this petition do not indicate anywhere that the<br \/>\n\tpetitioner was supplied with copies of record or documents which<br \/>\n\thave been relied upon by the authority, namely communication and<br \/>\n\tdrawings from the office of District Land Record Inspector.<br \/>\n\tPetitioner therefore was constrained to file appropriate<br \/>\n\trepresentation seeking copies of those documents which were sought<br \/>\n\tto be relied upon by the authority, in declining to the petitioner.<br \/>\n\tHowever that attempt was also remained unanswered and therefore the<br \/>\n\tpetitioner is left with no choice but to approach this Court under<br \/>\n\tArticle 226 of the Constitution.\n<\/p>\n<p>This<br \/>\n\tCourt is of the considered view that the petition is misconceived<br \/>\n\tand is required to be dismissed for the following reasons, namely:-\n<\/p>\n<p>(i)<br \/>\n\tThe attempt on the part of the petitioner to cerate locus appears to<br \/>\n\tbe on account of provision of Regulation 3.8 of the Regulations<br \/>\n\tgoverning development in the area which is required to be set out as<br \/>\n\tunder:-\n<\/p>\n<p>&#8220;3.8\n<\/p>\n<p>\t&#8211; Cancellation of Permission <\/p>\n<p>The<br \/>\n\tdevelopment permission, if secured by any person by any<br \/>\n\tmisrepresentation or by producing false document, such development<br \/>\n\tpermission will be treated as cancelled \/ revoked.&#8221;\n<\/p>\n<p>\tThis<br \/>\nRegulation, in my view, would not confer upon and clothe with any<br \/>\nlocus to the petitioner to inform authority to exercise its<br \/>\ndiscretion on the facts which are highly disputed and which are<br \/>\nsubject matter of civil court jurisdiction, wherein civil court<br \/>\nthough recorded its prima facie opinion but has not rendered final<br \/>\nconclusion with regard to ownership of the land in question. The<br \/>\nquestion arises as to whether the authority can be called upon to act<br \/>\non the strength of civil court&#8217;s interim order which is nothing but<br \/>\nmerely on prima facie opinion of the court for revoking permission,<br \/>\nnamely development permission in exercise of Regulation 3.8 of the<br \/>\nRegulations, which essentially requires fraud on the part of the<br \/>\nperson concerned.\n<\/p>\n<p>(ii)<br \/>\n\tThe disputed question of law and its exercise cannot be subject<br \/>\n\tmatter of scrutiny under article 226 of the Constitution. The<br \/>\n\tpetitioner is already protected by the appropriate interim order<br \/>\n\tgranted by the competent court vide order dated 15\/10\/2005 in<br \/>\n\tRegular Civil Suit filed by the petitioner. Under those prohibitory<br \/>\n\torder the concerned person who had sought development permission and<br \/>\n\twho had been granted and whose permission  is sought to be cancelled<br \/>\n\tis sufficiently refrained from putting up any construction on the<br \/>\n\tland in question. Therefore, in my view, this petition is not<br \/>\n\trequired to be entertained.\n<\/p>\n<p>(iii)<br \/>\n\tThe petition cannot be entertained which filed for seeking mandatory<br \/>\n\twrit against the orders of  two authorities, when prima facie it<br \/>\n\tappears from the order that the discretion is exercised based upon<br \/>\n\tthe record and proceedings or opinion of the inspector of land<br \/>\n\trecord, then this Court under article 226 of the Constitution would<br \/>\n\tnot interfere at the behest of a party who has merely obtained<br \/>\n\tinterim  injunction and whose dispute with regard to land in<br \/>\n\tquestion is yet to be adjudicated upon by the competent civil court.\n<\/p>\n<p>This<br \/>\n\tbrings this Court to consider the question whether the communication<br \/>\n\tdated 15\/3\/2010 can be said to be a communication  not in accordance<br \/>\n\twith law. I am afraid, the submission canvassed by learned counsel<br \/>\n\ton behalf of the petitioner that this cannot be said to be a<br \/>\n\tcommunication in accordance with law, if accepted, then, it will<br \/>\n\tlead to render the exercise under 3.8 Regulation to be adversary<br \/>\n\tlitigating provision which even the regulations are not acknowledged<br \/>\n\tand therefore, such an interpretation of Regulation 3.8 is uncalled<br \/>\n\tfor. The discretion of not revoking development permission is not<br \/>\n\tfinal as it is the civil court to decide and in case  ultimately<br \/>\n\tthe civil court is in favour of the petitioner then naturally the<br \/>\n\taction taken by the person in whose favour development plan is<br \/>\n\texisting would be absolutely subject to result of the same.\n<\/p>\n<p>Before<br \/>\n\tparting, the Court is constrained to observe that the petition is<br \/>\n\totherwise also required to be dismissed as a person against whom the<br \/>\n\trelief is sought has not been joined as party respondent, and<br \/>\n\ttherefore, on this ground of non-joinder of appropriate party  also<br \/>\n\tthe petition is required to be dismissed. Though Mrs. Pahuwa at this<br \/>\n\tstage submitted that the concerned respondent was to be joined as<br \/>\n\tparty. Be that as it may, the Court has already opined that the writ<br \/>\n\tpetition is required to be dismissed and is accordingly dismissed.<br \/>\n\tHowever, no order as to costs.\n<\/p>\n<p>                                                     [<br \/>\nS.R.
