He has submitted<br \/>\nthat applicant No.1 is an advocate and applicant No.2 is her<br \/>\nassistant. The applicant No.1 is practicing as an advocate for more<br \/>\nthan 21 years. He has submitted that due to professional rivalry with<br \/>\naccused No.2 &#8211; Mr.Mahesh Mohanlal Joshi the complainant has<br \/>\nfiled bogus complaint. He has submitted that case of the prosecution<br \/>\nis that accused No.1 and 2 approached the ICICI Bank, Surat for<br \/>\navailing loan with the forged Fixed Deposit Receipt. He has submitted<br \/>\nthat applicants are wrongly booked by the complainant. He has<br \/>\nsubmitted that applicants will be available during interrogation and<br \/>\ninvestigation. He has prayed that applicants may be granted<br \/>\nanticipatory bail.\n<\/p>\n<p>4.\tHeard<br \/>\nMs.Chetna Shah, learned APP for the respondent &#8211; State. She has<br \/>\nread order passed by the learned Judge and contents of the FIR and<br \/>\nvehemently argued that looking to the statements of witnesses of<br \/>\nICICI Bank, Noorsing Subhash Mishra, Abhishek Ratankumar Thakur,<br \/>\nDarshan Shivkumar Dave, Manish Narayan Aaiyar and Mathurdas Nayak and<br \/>\nlooking to the statements of co-accused Mohanlal Joshi and Jatin<br \/>\nMahendrakumar, they have specifically stated that   the present<br \/>\napplicants are involved in the commission of said offence. She has<br \/>\nsubmitted that co-accused Mohanlal Joshi has made contact with the<br \/>\napplicants to obtain loan with forged Fixed Deposit Receipt and<br \/>\npresent applicants gave forged Fixed Deposits Receipt of Rs.1.25<br \/>\ncrores from ICICI bank, Hyderabad, to Jatin Bardolia for obtaining<br \/>\nloan of Rs.1.12 crore. In lieu of this, present applicants decided to<br \/>\ngive 10% commission to Jatin Bardolia. She has submitted that looking<br \/>\nto the role played by the present applicants custodial interrogation<br \/>\nis required.  She has prayed that applicants may not be granted<br \/>\nanticipatory bail.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned Counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statements of the witnesses, gravity<br \/>\nof the offence and quantum of punishment and the fact there is<br \/>\ndefinite allegation made against the applicants, I am not inclined to<br \/>\ngrant bail to the applicants. The learned Judge has considered<br \/>\nstatements of the witnesses which are recorded by the Investigating<br \/>\nOfficer. In the statement of the co-accused role of the present<br \/>\napplicants are prima facie established. I have perused Section 10 of<br \/>\nthe Evidence Act and contents of the complaint shows that ingredients<br \/>\nof Section 120B are prima facie established. Hence, prima facie case<br \/>\nis made out against the present applicant. As custodial interrogation<br \/>\nof the present applicants is required.\n<\/p>\n<p>6.\tAccordingly<br \/>\nthis application is dismissed.
