S.\nGiridhar  Petition before the\na   1:66 of M.V.Act, Claiming\ncompenfsfation  respondents, on account of the\n\ndeath if of the \"\"--detQ\u00a2_a.sed in the road traffic accident,\n\n ,AC:vonte11.ding\u00ab..that, at about 7.45 a.m., on 20.4.2005, the\n\ncleceased  going on the road at extreme left side near\n\n 11th Pfatforln at City Market. at that time, the driver of\n\n \"..fjthe0\"bgus' bearing No.KA.O1.F.2580 while taking reverse\n\n'  dashed against the parked vehicle and then he took the\n\n04 irehicle in forward direction with high speed and dashed\n\n\n\n \n\nagainst the another vehicle, which was going\"-.on.x the\n\nright side of the deceased, due to \n\ncrushed between the vehicles \n\nand KA.O1.F.1838 and sustained\n\nsuccumbed to the same.' -It is the' furth;erlw..icasg; of the'\n\nclaimants that, deceased    student\nhaving excellent educational' reco\"rd_,_'\u00bbhe.was the hopes and\nfuture of the parents   to l'iisluTnt~ir11ely death they\n\nhave suffered 'i'r_:.t.VT The said clairri' etition had come u\n_  . L _ P P\n\nfor consid'e'ra'tion,_ beforelthe--vTn\"l3unal. The Tribunal, in\nturI1,7,after  the oral and documentary\n\nevidenceland other\" niaterial available on file, after\n\n asvsessing u the \"'no.t.ional income of the deceased at\n\n   month, deducting 50% towards his\n\npersonal.'.eX_penses and adopting multiplier of 15, has\n\n aWardeCl';.a sum of ?3,60,000\/-- towards loss of dependency\n\nA \":l,\"aIso awarded \u20ac40,000\/-- towards conventional heads\n\n and accordingly, allowed the claim petition in part,\n\n awarding the compensation of ?4,00,000\/-- under\n\n\n\n \n\nin the said accident are not in dispute.  it\n\nemerges that, the Tribunal after assessinglithedtilgoral \n\ndocumentary evidence, has awarded'  T T \n\ntowards conventional heads and the same is \u00abjusdtjrid\n\nreasonable and therefor.eE\"'~.._>it  for\ninterference  A 1\n\n6. Further,  only a\nSum Of ?3i60:.:Q('30\/dependency after\nassessing   deceased at ?4,000\/--\nper    towards his personal\nexpenses''   i\\\/Iultiplier of '15'. The said\n\ncompensation awarded\": by the Tribunal is inadequate\n\n   Itfieds tonlberenhanced. The Tribunal has erred in\n\n notional income of the deceased at\n\n?.4,Q'OO\/v:.fJe--r\"h1onth and the same is on lower side and\n\n\"~..,therefo.re3; it needs to be modi\ufb01ed, for the reason that,\n\n  \"'l:V'dece:'ased was aged about 22 years studying third year\n\n  and the accident was occurred in the year 2005.\n\n Therefore, having regard to his age, educational\n\n\n\n \n\nqualification and the year of accident, We reaasseseg his\n\nnotional income at ?5,000\/-- per month. \n\nwe deduct 50% (\u20ac2,500\/--) towards  \n\nliving expenses, since he was '\u00bbbac,he.l-or,'thetdnet .:incbii1e\n\ncomes to ?2,500\/-- per  Accepting.:v'th:e\"muitiplierit\n\nof 'I5' adopted by Tribunalfwe re--detennine_i:he loss of\ndependency at ?4,5o--,\u00aboioo\/;'=cg(2:j,soo'\/3\u00bb  x 15) instead of\n?3,60,000\/-- awarded  apnlddaccordingly it is\n\nawarded.\n  ground taken by the\nlearned counsehfor'the._\u00a7orporation that. the Tribunal\n\nought totxhave contributory negligence on the\n\n  pa,j't'\u00ab:.of._th-.3' dece'ase--d'is concerned, there is no substance\n\n isubmission made by the Corporation and\n\nthe\"\"sa1ne'V'ei'\u00a7seiiiable to be rejected at threshold, for the\n\n'y_reason_tjhat, charge sheet has been filed against the\n\n\"_d~riye,r of the Corporation and he has been examined\n\n .353 RW1. who has admitted in his cross-- examination\n\n that. deceased was caught between the two vehicles. In\n\n\n\n \n\nView of the said admission made by the dI'i'ver}.ofvV'the\n\noffending Vehicle and by assigning the   pp\n\npara--8 of the judgment, the Tribunal  j \n\n\ufb01nding of fact holding that the \n\non the part of the deceased'-V.eannot__beugeonleidered and\n\ntherefore, fixed the ;_1.QO\u00b0\/capvpneg]'jge'1'1ee onthe of the\ndriver of the offendixngi'  finding of fact\nrecorded by\u00e9jthe and proper and\ntherefore;   \n\n  fgltfigie  the impugned\njudgment'  the Tribunal is liable to be\n\nmodified.V'\"--Tl'le Vtotali Vcoillnpensatiori payable comes to\n\n   ..... \n<\/pre>\n

‘is. as devoid of merits and the appeal \ufb01led by<\/p>\n
 thellolaljmants is allowed in part and the impugned<\/p>\n
it jiidgment and award passed by the Tribunal in MVC<\/p>\n
  N\u00a7o.2648\/2005 is hereby modified, awarding<\/p>\n
 compensation of ?4,90,000\/- instead of ?4,00,000\/–<\/p>\n
