M. SAHAI)<\/p>\n<p>\t\tThis<br \/>\nLetters Patent Appeal<\/a> has been filed challenging the order of the<br \/>\nlearned Single Judge dated 23rd July, 2009 in Special Civil<br \/>\nApplication No. 6684 of 2009, by which the learned Single Judge has<br \/>\ndismissed the petition filed by the petitioner.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner was appointed as Vidyut Sahayak (Helper) with the<br \/>\nrespondents, by order dated 3rd February, 2007 for a fixed period of<br \/>\nthree years. Before the petitioner was appointed, a criminal case<br \/>\nunder Sections 323, 326, 504, 506(2) and 114 of the Indian Penal Code<br \/>\nwas lodged against the petitioner. He concealed this fact in the<br \/>\napplication, which he made with the respondents, at the time of<br \/>\nappointment that he was involved in the criminal case. In the<br \/>\nappointment letter, in para-12, it was mentioned that if the<br \/>\npetitioner is found to have been convicted in any criminal case, then<br \/>\nhis appointment would be cancelled. This criminal case was<br \/>\ncompromised by the petitioner before Lok Adalat on 7th April, 2007<br \/>\nafter he joined the service. He was found to be guilty under Bombay<br \/>\nPolice Act and rest of the offences were compounded and he was<br \/>\nacquitted.  This fact of pendency of criminal case came to light in<br \/>\nthe police verification report as after the appointment of the<br \/>\npetitioner, the police verification was sought by the respondents.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel for the petitioner has placed reliance on the decision of the<br \/>\nApex Court in the case of  <a href=\"\/doc\/1734320\/\">State<br \/>\nof Gujarat vs. Anand Acharya<\/a> alias Bharat Kumar Sadhu, reported in<br \/>\n2007 AIR SCW 1542 and has urged that punishment of<br \/>\ndismissal from service is too harsh and since in that case,<br \/>\npunishment of removal was reduced to  stoppage of two increments by<br \/>\nHigh Court and therefore, the Apex Court did not interfere. This<br \/>\ndecision is of no help to the appellant in view of the fact that the<br \/>\nappellant was appointed only for a fixed period of three years. He<br \/>\nwas neither a regular employee nor a permanent employee of the<br \/>\nrespondents. A person, at the time of his appointment, is supposed to<br \/>\nmake correct declaration about the fact as to whether a criminal case<br \/>\nis pending against him or not and whether he is convicted in a<br \/>\ncriminal case or not. He should be fair to the employer. In our<br \/>\nopinion, non-disclosure of the fact that a criminal case was pending<br \/>\nagainst him amounts to misleading the employer and on his<br \/>\nmisrepresentation,  the respondents had appointed him. Had the fact<br \/>\nof criminal case pending against him been disclosed, the respondents<br \/>\nwould not have appointed the appellant in service.\n<\/p>\n<p>4.\t\tWe<br \/>\nare further of the opinion that non-disclosure of the criminal<br \/>\nproceedings pending against an employee\/appellant is a serious matter<br \/>\nwhich calls for his termination from service as he had obtained<br \/>\nobtained appointment fraudulently by making false representation.\n<\/p>\n<p>5.\t\tLearned<br \/>\ncounsel for the appellant then urged that the order dated 26th March,<br \/>\n2007 castes stigma on him as it is mentioned that his services are<br \/>\nterminated with effect from 26th February, 2007 in light of the<br \/>\nprovisions of para-16 of GSO-07 due to his involvement in a criminal<br \/>\ncase. In this regard, the appellant has placed reliance on two<br \/>\ndecisions of the Apex Court in the cases of  Kamal<br \/>\nNayan Mishra vs. State of Madhya Pradesh and others reported in<br \/>\n(2010) 2 SCC 169 and <a href=\"\/doc\/88269\/\">Union of India and others vs. Mahaveer<br \/>\nC.Sanghvi,<\/a> reported in (2010) 8 SCC 220.\n<\/p>\n<p>6.\t\tPara-16<br \/>\nof General Standing Order No. 5 dated 24.9.1960  of Gujarat State<br \/>\nElectricity Board reads as under:\n<\/p>\n<p>&#8220;Any<br \/>\ncandidate who is found to have knowingly furnished any particulars<br \/>\nwhich are false or who have suppressed material, information of a<br \/>\ncharacter which, if known, would ordinarily have debarred him from<br \/>\nobtaining employment in the service of the Board, is liable to be<br \/>\ndisqualified and if appointed, to be removed from service.&#8221;\n<\/p>\n<p>7.\t\tThe<br \/>\nimpugned order of termination mentions that the appellant has been<br \/>\nterminated in light of the provisions of para-16 of GSO-07 extracted<br \/>\nabove, due to involvement in a criminal case. We are of the<br \/>\nconsidered opinion that the mention of GSO and involvement of the<br \/>\nappellant in a criminal case does not cast any stigma on the<br \/>\nappellant. The Apex Court decisions relied upon by the learned<br \/>\ncounsel for the appellant do not help him as they were cases of<br \/>\nprobationers, whereas the appellant was appointed for a fixed period<br \/>\nof three years only and his services have been terminated by only<br \/>\nmentioning the fact that he has concealed his involvement in a<br \/>\ncriminal case. We do not find any illegality in the impugned order<br \/>\ndated 26th March, 2007 passed by the respondents as well as the<br \/>\njudgment dated 23rd July, 2009 passed by the learned Single Judge.<br \/>\nThis Appeal fails and is accordingly dismissed.
