NO. 87 OF 1999\n               = = = = = = = = = = = = = = =\n           Dated this the 11th day of June, 2010.\n\n                     J U D G M E N T\n<\/pre>\n<p>    This  appeal      is     preferred       against  the<\/p>\n<p>judgment and decree passed by the Subordinate<\/p>\n<p>Judge, Pathanamthitta in O.S.238\/93.             The suit<\/p>\n<p>is one for realisation of the amount, i.e.<\/p>\n<p>Rs.32,000\/- given as the share as well as value<\/p>\n<p>of 17 sovereigns of gold alleged to be taken by<\/p>\n<p>the husband given to the wife at the time of<\/p>\n<p>marriage.  On the other hand, the defendant had<\/p>\n<p>denied the receipt of any amount and had also<\/p>\n<p>denied about the taking of any ornament by him<\/p>\n<p>for his sister&#8217;s marriage.\n<\/p>\n<p>    2.  I find an extremely difficult situation<\/p>\n<p>in this case because the 2nd defendant who is the<\/p>\n<p>husband has not been cross examined at all in<\/p>\n<p>this  case.    An     application        was    filed for<\/p>\n<p>A.S. No. 87 OF 1999<br \/>\n<span class=\"hidden_text\">                        -2-<\/span><\/p>\n<p>permitting him to be cross-examined and it was<\/p>\n<p>allowed. But it appears that he was present on<\/p>\n<p>the next day and he was not cross-examined.<\/p>\n<p>Thereafter again it is recorded that he was not<\/p>\n<p>present and no steps were taken.     It was the<\/p>\n<p>duty of the witness to come before the Court to<\/p>\n<p>face the cross-examination.   I am not blaming<\/p>\n<p>either the plaintiff nor the defendant for the<\/p>\n<p>reason nothing is clear from the trial Court<\/p>\n<p>records what had transpired in that Court and<\/p>\n<p>therefore it is desirable that DW1 is cross-<\/p>\n<p>examined so that the Court will have some idea<\/p>\n<p>about the whole thing.     I am not expressing<\/p>\n<p>anything on the merits of this case and I set<\/p>\n<p>aside the judgment and decree of the Court below<\/p>\n<p>and remit the case back to the trial court for<\/p>\n<p>fresh consideration after permitting the parties<\/p>\n<p>to  adduce   evidence   in  support   of   their<\/p>\n<p>respective contentions.\n<\/p>\n<p>A.S. No. 87 OF 1999<br \/>\n<span class=\"hidden_text\">                        -3-<\/span><\/p>\n<p>    It is made clear that the 2nd defendant shall<\/p>\n<p>make himself available for cross-examination on<\/p>\n<p>the date fixed by the Court and thereafter if<\/p>\n<p>the parties want any other evidence that may<\/p>\n<p>also be permitted. Thereafter the Court below is<\/p>\n<p>directed to dispose of the matter in accordance<\/p>\n<p>with law.  Parties are directed to appear before<\/p>\n<p>the Court below on 22.7.2010.   Being a very old<\/p>\n<p>matter  the  trial  court  shall   see  that   an<\/p>\n<p>expeditious disposal is done.<\/p>\n<p>                        M.N.
