Justice K.SURENDRA MOHAN\n\n Dated :24\/03\/2010\n\n O R D E R\n                K.SURENDRA MOHAN, J.\n             -------------------------------------------\n                W.P.(C) No.36747 of 2009\n             -------------------------------------------\n         Dated this the 24th day of March, 2010\n\n                          JUDGMENT\n<\/pre>\n<p>     The petitioner has filed this Writ Petition challenging<\/p>\n<p>Ext.P3 proceedings of the Joint Regional Transport Officer,<\/p>\n<p>Kanhangad refusing to convert the vehicle as a light motor<\/p>\n<p>vehicle for personal use.         According to the petitioner,<\/p>\n<p>though his vehicle has been issued with a contract<\/p>\n<p>carriage permit, due to ill health, he is not able to use the<\/p>\n<p>same as a contract carriage.           Therefore, the petitioner<\/p>\n<p>wants to use the same only for his personal purposes.<\/p>\n<p>According to the petitioner, the relevant rule permits<\/p>\n<p>conversion of the vehicle to a light motor vehicle intended<\/p>\n<p>for personal use.\n<\/p>\n<p>     2. According to the learned              Senior Government<\/p>\n<p>Pleader, the vehicle was involved in a criminal case and<\/p>\n<p>the vehicle was re-registered without disclosing its<\/p>\n<p>previous registration. According to the petitioner, he had<\/p>\n<p>purchased it from one Vijayan of Adimaly who had<\/p>\n<p>registered the vehicle in his name.               The Government<\/p>\n<p><span class=\"hidden_text\">wpc No.36747\/2009         2<\/span><\/p>\n<p>   Pleader submits that there is a racket with deep roots<\/p>\n<p>   across the State, involved in the registration and re-<\/p>\n<p>   registration of vehicles. Therefore, if the conversion of the<\/p>\n<p>   vehicle is permitted, the authorities would lose control<\/p>\n<p>   over the same and it is apprehend that the vehicle itself<\/p>\n<p>   would disappear.\n<\/p>\n<p>         3. The counsel for the petitioner points out that the<\/p>\n<p>   vehicle has been put in custody of the petitioner as per<\/p>\n<p>   orders passed by the Judicial First Class Magistrate&#8217;s<\/p>\n<p>   Court, Hosdurg in Criminal M.C.No.3567\/1997 dated<\/p>\n<p>   6.1.1998. As per the said order, the petitioner has the<\/p>\n<p>   responsibility to produce the vehicle on the orders of the<\/p>\n<p>   Court.\n<\/p>\n<p>         4. Since the petitioner has only been put in interim<\/p>\n<p>   custody of the vehicle, as per orders of the Magistrate&#8217;s<\/p>\n<p>   Court, with liability to produce the same as and when<\/p>\n<p>   required, I do not think there is any justification for<\/p>\n<p>   disallowing the conversion that is sought for. It cannot be<\/p>\n<p>   disputed that the conversion that the petitioner has sought<\/p>\n<p>   for is permissible in accordance with the rules. I also<\/p>\n<p>   notice from Ext.P2 judgment of this Court that the<\/p>\n<p><span class=\"hidden_text\">wpc No.36747\/2009         3<\/span><\/p>\n<p>   petitioner had earlier been permitted to pay the tax and to<\/p>\n<p>   renew the permit without insisting on production of the<\/p>\n<p>   original Registration Certificate, which itself is in the<\/p>\n<p>   custody of the Court. In the above circumstances, the<\/p>\n<p>   refusal of the third respondent to allow the conversion<\/p>\n<p>   that was sought for is without any justification.<\/p>\n<p>         5. Accordingly, this Writ Petition is allowed. Ext.P10<\/p>\n<p>   is set aside.
