{"id":215560,"date":"2010-11-26T00:00:00","date_gmt":"2010-11-25T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/b-n-p-memorial-school-vs-regional-provident-fund-on-26-november-2010"},"modified":"2018-01-30T20:35:58","modified_gmt":"2018-01-30T15:05:58","slug":"b-n-p-memorial-school-vs-regional-provident-fund-on-26-november-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/b-n-p-memorial-school-vs-regional-provident-fund-on-26-november-2010","title":{"rendered":"B.N.P.Memorial School vs Regional Provident Fund &#8230; on 26 November, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">B.N.P.Memorial School vs Regional Provident Fund &#8230; on 26 November, 2010<\/div>\n<pre>                      W.P.No. 16261 \/ 2010\n (BNP Memorial School, Rewa..v. ..Regional P.F.Commissioner &amp; anr.)\n26-11-2010\nShri Uttam Maheshwari, learned counsel for the petitioner.\n\nShri J.K.Pillai, counsel for the respondents.<\/pre>\n<p>       Heard on the question of admission and interim relief.\n<\/p>\n<p>       Admit.\n<\/p>\n<p>       With the consent of the learned counsel for the parties the<br \/>\npetition is heard and decided finally.\n<\/p>\n<p>       The petitioner has filed this petition being aggrieved by order<br \/>\ndated 1-10-2010, passed by the respondent No.1 Regional Provident<br \/>\nFund Commissioner, Jabalpur, the respondent No.1 rejecting the<br \/>\napplication filed by the petitioner under Section 7B of the Employees&#8217;<br \/>\nProvident Fund and Miscellaneous Provisions Act, 1952 (hereinafter<br \/>\nreferred to as the &#8216;Act&#8217;) for review of the order dated 30-7-2010.\n<\/p>\n<p>       It is submitted by the learned counsel for the petitioner that the<br \/>\nprovisions of the aforesaid section require the authority who had passed<br \/>\nthe initial order to review the same whereas in the instant case the order<br \/>\npassed by the respondent No. 2 has been reviewed by respondent No.<br \/>\n1 which is contrary to law. This is the short ground on which the<br \/>\nimpugned order has been assailed.\n<\/p>\n<p>       It is submitted by Shri J.K.Pillai, the learned counsel, who has<br \/>\nentered appearance for the respondents on advance copy, that the<br \/>\naforesaid situation and position is correct. It is stated that on account of<br \/>\ncertain administrative orders and arrangements the order has been<br \/>\nreviewed by respondent No.1.\n<\/p>\n<p>       Having heard the learned counsel for the parties and looking to<br \/>\nthe provisions of Section 7B of the Act, the petition filed by the petitioner<br \/>\nis allowed.
