The matter was kept for<br \/>\ntoday for further consideration for the prayer of grant of Regular<br \/>\nBail.  On 13th April 2011, by interim order, the applicant\n<\/p>\n<p>&#8211; convict was ordered to be released on Temporary Bail for a<br \/>\nperiod of 30 days.\n<\/p>\n<p>2.0\tLearned<br \/>\nadvocate Mr. Samir Dave, amicus curiae invited the attention<br \/>\nof the Court to order passed by this Court on<br \/>\n11th<br \/>\nDecember 2008 in Criminal Misc. Application No. 13555 of 2008 in the<br \/>\nmatter of Bhavesh Ganpatbhai Kadiya, order dated 17th<br \/>\nJanuary 2009 in Criminal Misc. Application No. 13928 of 2008 in the<br \/>\nmatter of Ghanshyampuri Anandpuri Goswami  and last but not the<br \/>\nleast, order dated 1st April 2009 in Criminal Misc.<br \/>\nApplication No. 11715 of 2008 in the matter of Bharatsinh Parthiji<br \/>\nVihol.  The learned advocate for the applicant also submitted that,<br \/>\neven if, the case of the prosecution is believed, the main role<br \/>\nplayed by the persons are already granted bail.  He, therefore,<br \/>\npleads for parity.\n<\/p>\n<p>3.0\tTaking<br \/>\ninto consideration the submissions made by the learned advocate for<br \/>\nthe applicant, the application is allowed.  The applicant &#8211;<br \/>\nconvict is ordered to be released on bail in connection with<br \/>\nCriminal Appeal No. 1109 of 2010 pending before this Court on his<br \/>\nexecuting a personal bond of Rs.5000\/- (Rupees Five thousand only)<br \/>\nwith one surety of the like amount to the satisfaction of the<br \/>\nlower Court and subject to the conditions that he shall:\n<\/p>\n<p>\ta)\tnot<br \/>\ntake undue advantage of liberty or abuse liberty;\n<\/p>\n<p>\tb)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>\tc)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>\td)\tfurnish<br \/>\nthe present address of residence to the I.O. and also to the<br \/>\nlower Court at the time of execution of the bond and shall not change<br \/>\nthe residence without prior permission of the Court;\n<\/p>\n<p>\te)\tmark<br \/>\nhis presence before the concerned Police Station once in three<br \/>\nmonths more particularly between 1st<br \/>\nand 10th days of the month between<br \/>\n10:00 a.m. and 2:00 p.m.;\n<\/p>\n<p>\tf)\tnot<br \/>\nleave the limits of the country without prior permission of the<br \/>\nCourt;\n<\/p>\n<p>\tg)\tsurrender<br \/>\nthe Passport, if any, within a week to the lower Court.\n<\/p>\n<p>3.1\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>3.2\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>3.3\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>[<br \/>\nRavi R.
