Malti and others                        Akhilesh &amp; others\n\n\n16.8.2010\n\n\n       Shri Asim Dixit, Counsel for the petitioners.\n       Shri Shailendra Samaiya, counsel for the respondents.<\/pre>\n<p>       This petition is directed against an order dated<br \/>\n26.3.2010 by III Additional Motor Accident Claims Tribunal,<br \/>\nSagar by which an application filed by the petitioners under<br \/>\nOrder 7 Rule 14 C.P.C. was rejected.            Along with the<br \/>\napplication the petitioner filed documents relating to the<br \/>\ntreatment of her husband Munnalal Ahirwar and allied<br \/>\npapers. The Tribunal found that the case has been fixed for<br \/>\nrecording evidence. No reason has been assigned for non-<br \/>\nfiling of the documents before fixing the case for recording<br \/>\nevidence.     Though it is true that the documents were not<br \/>\nfiled before fixing the case for recording evidence but it<br \/>\nappears that the documents filed by the petitioner belongs to<br \/>\nthe treatment of her deceased husband. Apart from other<br \/>\nmedical papers, the aforesaid documents are necessary for<br \/>\nthe just decision of the case.\n<\/p>\n<p>       In view of the aforesaid, we find that the Tribunal<br \/>\nerred in rejecting the application filed by the petitioners. The<br \/>\nimpugned order in that regard is set aside and it is directed<br \/>\nthat the Tribunal shall receive the documents filed by the<br \/>\npetitioners on record and thereafter shall proceed in the<br \/>\nmatter in accordance with law.\n<\/p>\n<p>       Considering the facts of the case, there shall be no<br \/>\norder as to costs.<\/p>\n<pre>\n\n\n (Krishn Kumar Lahoti)                      (J.K.
