Justice ANTONY DOMINIC\n\n Dated :12\/12\/2007\n\n O R D E R\n                        ANTONY DOMINIC, J.\n\n                = =W.P.(C) = =36694=OF= = = = =\n                     = = =No. = =       =\n                                           2007 R\n                = = = = = = = = = = = = = = = =\n\n                Dated this the 12th December, 2007\n\n                           J U D G M E N T\n<\/pre>\n<p>      Petitioners, against whom proceedings were initiated by the<\/p>\n<p>respondent Corporation, have approached this Court contending<\/p>\n<p>that though the property mortgaged have been sold to a stranger,<\/p>\n<p>they are now willing to pay off the sale value to the Corporation. On<\/p>\n<p>this basis the petitioners pray that the Corporation be directed to<\/p>\n<p>re-convey the property to the petitioners.\n<\/p>\n<p>      2. Standing Counsel for the Corporation submits that in the<\/p>\n<p>sale that was conducted the property was purchased by a stranger<\/p>\n<p>and that the purchaser has already remitted 1\/3rd of the bid<\/p>\n<p>amount. In view of the aforesaid facts, I am not prepared to direct<\/p>\n<p>the Corporation to accept the offer made by the petitioners and re-<\/p>\n<p>convey the the property to the petitioners.           However, if the<\/p>\n<p>petitioners are so advised they may institute proceedings,<\/p>\n<p>impugning the sale with the buyer also in the party array.<\/p>\n<p><span class=\"hidden_text\">WPC No. 36694\/07                  &#8211; 2-<\/span><\/p>\n<p>      3. At this stage counsel for the petitioners complains that the<\/p>\n<p>petitioners are unaware of the whereabouts of the bidder and as a<\/p>\n<p>result thereof, they are not in a position to proceed with the bidder<\/p>\n<p>on the party array. In my view the grievance is certainly genuine<\/p>\n<p>and the Corporation will provide the address and other particulars<\/p>\n<p>of the person who has purchased the property in auction.<\/p>\n<p>      4.
