Justice V.GIRI\n\n Dated :26\/03\/2009\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n         R.P.337\/2009 in W.P.(C).34689\/2008\n                    --------------------\n       Dated this the 26th day of March, 2009\n\n                       ORDER\n<\/pre>\n<p>      Third respondent in the writ petition has filed<\/p>\n<p>this review petition essentially raising a contention<\/p>\n<p>that certain aspects, which according to him were<\/p>\n<p>vital, were not disclosed by the petitioner in the writ<\/p>\n<p>petition.  This inter alia relates to the filing of a<\/p>\n<p>counter     claim    by    the      writ petitioner     in<\/p>\n<p>O.S.239\/2005,     seeking a declaration of title in<\/p>\n<p>relation to the pathway in dispute.         It is further<\/p>\n<p>contended that    based on the judgment          which is<\/p>\n<p>sought to be reviewed, a motion has been made by<\/p>\n<p>the writ petitioner before the Civil Court      for a stay<\/p>\n<p>of further proceedings in O.S.239\/2005            on the<\/p>\n<p>ground that this Court         had directed a statutory<\/p>\n<p>revision to be disposed of by the District Collector.<\/p>\n<p>2.    A direction to the District Collector to dispose<\/p>\n<p>of Ext.P2 revision in the writ petition obviously does<\/p>\n<p>not mean anything more than what it is purported to<\/p>\n<p>R.P.337\/2009<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>convey. I have not considered the merits of the<\/p>\n<p>contentions of the petitioner nor was the direction<\/p>\n<p>intended to enable the writ petitioner to seek a stay<\/p>\n<p>of proceedings in O.S.No.239\/2005 or any other Suit<\/p>\n<p>for that matter. It is open to the review petitioner<\/p>\n<p>to bring    to the notice   of the Civil Court, the<\/p>\n<p>observations being made by this Court in the review<\/p>\n<p>petition.\n<\/p>\n<\/p>\n<p>3.    Learned Government Pleader submits that the<\/p>\n<p>District Superintendent of Survey who is competent<\/p>\n<p>to consider the review petition under Section 13A of<\/p>\n<p>the Surveys and Boundaries Act, has already heard<\/p>\n<p>the parties.   The submission is refuted      by the<\/p>\n<p>learned counsel for the review petitioner. Be that<\/p>\n<p>as it may. I make it clear that I have not considered<\/p>\n<p>the contentions raised    by the writ petitioner on<\/p>\n<p>merits    and all that I have directed is    that the<\/p>\n<p>statutory   authority    exercising   powers should<\/p>\n<p>consider Ext.P2 revision, after notice to all affected<\/p>\n<p>R.P.337\/2009<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>persons and take a decision in accordance with law.<\/p>\n<p>In these circumstances, I do not find any reason to<\/p>\n<p>review the judgment.
