Justice M.L.JOSEPH FRANCIS\n\n Dated :07\/09\/2010\n\n O R D E R\n            R.BASANT &amp; M.L.JOSEPH FRANCIS, JJ.\n                       **********************\n                   W.P(C) No.27678 of 2010\n                        *********************\n             Dated this the 7th day of September, 2010\n\n                            JUDGMENT\n<\/pre>\n<p>BASANT, J.\n<\/p>\n<p>      Petitioners are respondents 1 to 3 in an Original Petition<\/p>\n<p>pending before the Family Court, Kottayam.            They are the<\/p>\n<p>husband and parents-in-law of the respondent herein. That O.P<\/p>\n<p>is filed by the respondent herein claiming return of gold<\/p>\n<p>ornaments, amounts etc.          The matter stands posted to<\/p>\n<p>15.09.2010. The petitioners are expected to appear before the<\/p>\n<p>Family Court. According to the petitioners, petitioners 2 and 3<\/p>\n<p>herein are old and sickly individuals, aged 72 and 64 years.<\/p>\n<p>They are unable to undertake a journey to the Family Court.<\/p>\n<p>They reside in Alappuzha district.       They are afraid that the<\/p>\n<p>Family Court may insist on the personal appearance of all the<\/p>\n<p>petitioners before it. The 1st petitioner is willing to appear. The<\/p>\n<p>2nd petitioner has already entered physical appearance before<\/p>\n<p>the Family Court once. The 3rd petitioner, a woman, is unable to<\/p>\n<p>appear.     In these circumstances, it is prayed that future<\/p>\n<p>appearance of the 2nd and 3rd petitioners may not be insisted.<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.27678 of 2010           2<\/span><\/p>\n<p>Directions under Article 227 of the Constitution may be issued to<\/p>\n<p>the Family Court not to insist on the personal presence of<\/p>\n<p>petitioners 2 and 3 before the Family Court. This in short is the<\/p>\n<p>prayer made in this petition filed under Article 227 of the<\/p>\n<p>Constitution.\n<\/p>\n<p>      2.    We find no reason for us to invoke our extraordinary<\/p>\n<p>constitutional jurisdiction at this juncture. If petitioners 2 and 3<\/p>\n<p>or anyone of them are\/is not able to appear before the Family<\/p>\n<p>Court, they must make an appropriate application before the<\/p>\n<p>Family Court showing all reasons leading to the inability of such<\/p>\n<p>petitioners to appear before the Family Court, supported by<\/p>\n<p>adequate material.      They must request the Family Court to<\/p>\n<p>dispense with their personal appearance and seek permission to<\/p>\n<p>appear through counsel.       The learned counsel submits that<\/p>\n<p>petitioners 2 and 3 are willing to execute an instrument of power<\/p>\n<p>of attorney in favour of the 1st petitioner authorising him to<\/p>\n<p>represent them before the Family Court. Such instrument of<\/p>\n<p>power of attorney can also be filed before the Family Court. The<\/p>\n<p>petitioners must seek appropriate directions from the Family<\/p>\n<p>Court. If such an application is filed before the Family Court,<\/p>\n<p>needless to say, the Family Court has to consider the same on<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.27678 of 2010        3<\/span><\/p>\n<p>merits and pass appropriate orders.      If the petitioners are<\/p>\n<p>aggrieved by any such order, their option to approach this Court<\/p>\n<p>shall remain unfettered. At the moment, we find absolutely no<\/p>\n<p>reason to invoke our extraordinary constitutional jurisdiction<\/p>\n<p>under Article 227.\n<\/p>\n<p>     3.     With the above observations, this Writ Petition is<\/p>\n<p>dismissed.\n<\/p>\n<p>     4.
