SANKARAN, J.\n                    ---------------------------\n                       B.A. No. 578 of 2010\n                ------------------------------------\n              Dated this the 5th day of February, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the Code<\/p>\n<p>of Criminal Procedure.     Petitioners are accused Nos. 1 and 2 in<\/p>\n<p>Crime No.26\/2010 of Nadakkavu Police Station, Kozhikode<\/p>\n<p>District.\n<\/p>\n<p>       2. The offence alleged against the petitioners is under<\/p>\n<p>Section 420 read with Section 34 of the Indian Penal Code.<\/p>\n<p>       3. The prosecution case is that the accused persons caused<\/p>\n<p>an advertisement in Mathrubhumi Daily inviting applications from<\/p>\n<p>interested persons offering them jobs in U.S.A and Australia. The<\/p>\n<p>advertisement was given in the name of the travel agency and<\/p>\n<p>showing the licence No. of the travel agency belonging to the de<\/p>\n<p>facto complainant. The de facto complainant reported the matter<\/p>\n<p>to the police. The petitioners were arrested on 25.01.2010 and<\/p>\n<p>they were remanded to judicial custody.\n<\/p>\n<p>       4. Heard the learned counsel for the petitioners and the<\/p>\n<p>learned Public Prosecutor.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 578 of 2010                   2<\/span><\/p>\n<p>         5. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners on stringent conditions.\n<\/p>\n<p>         6. The petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Judicial<\/p>\n<p>Magistrate of the First Class-IV, Kozhikode subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>                 A)  The petitioners shall report before the<br \/>\n                     Investigating Officer between 9 A.M. and<br \/>\n                     11 A.M. on all Mondays, till the final report<br \/>\n                     is filed or until further orders.\n<\/p><\/blockquote>\n<blockquote><p>                 B)   The petitioners shall     appear before the<br \/>\n                     Investigating Officer for interrogation as<br \/>\n                     and when required.\n<\/p><\/blockquote>\n<blockquote><p>                 C)  The    petitioners    shall  surrender  their<br \/>\n                     passports before the Court of the Judicial<br \/>\n                     Magistrate of the First Class-IV, Kozhikode<br \/>\n                     within a period of one week. If any of the<br \/>\n                     petitioners   does     not hold   an   Indian<br \/>\n                     Passport, an affidavit sworn to by him to<br \/>\n                     that effect shall be filed before the learned<br \/>\n                     Magistrate within one week.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">B.A. No. 578 of 2010                 3<\/span><\/p>\n<blockquote><p>                 D)   The petitioners shall not try to influence<br \/>\n                     the prosecution witnesses or tamper with<br \/>\n                     the evidence.\n<\/p><\/blockquote>\n<blockquote><p>                 E) The petitioners shall not commit any offence<br \/>\n                     or indulge in any prejudicial activity while<br \/>\n                     on bail.\n<\/p><\/blockquote>\n<blockquote><p>                 F)  In case of breach of any of the conditions<br \/>\n                     mentioned above, the bail shall be liable to<br \/>\n                     be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>         The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                     K.T.
