Janki Verma                Brajbhushan Verma\n\n\n\n\n19.09.2011.\n         Shri G.S.Thakur, counsel for the appellant.\n         This appeal is filed under Section 28 of Hindu Marriage\nAct, 1955 by which the judgment and decree dated 17.4.2009\npassed by the 6th Additional District Judge (FTC), Chhatarpur in\nHindu Marriage Case No.18-A\/2008 has been assailed.\n         From the perusal of the aforesaid,it is apparent that the\nappellant has challenged the compromise decree under Section\n13B of Hindu Marriage Act which was passed by the trial Court\non the basis of a joint petition filed by the parties.\n         This appeal is filed solely on the ground that at the time of\npassing of judgment, no permanent alimony has been provided\nto the appellant or the appellant is entitled for payment of\nRs.5.00 lacs from the respondent.<\/pre>\n<p>         This appeal is barred by 712 days. In the application, it is<br \/>\nstated that the appellant was ill and she could not contact the<br \/>\ncounsel and when she recovered from illness, she contaced to<br \/>\nthe counsel and this appeal has been filed after such delay. No<br \/>\nparticulars in respect of ailment or the period of ailment has been<br \/>\ngiven in the application. Apart from this, no medical certificate or<br \/>\nmedical papers have been filed to show that in fact the appellant<br \/>\nwas sick for a period of 712 days. In absence of particulars,<br \/>\nwhen a compromise decree has been passed between the<br \/>\nparties, we are not satisfied that the appellant has made out a<br \/>\ncase for condonation of delay.\n<\/p>\n<p>         In view of the aforesaid, we do not find any justification<br \/>\neven for issuance of notice to the other side for condonation of<br \/>\ndelay.<\/p>\n<pre>\n                      FA No.518 of 2011\n\nSmt. Janki Verma                Brajbhushan Verma\n\n\n\n\n<\/pre>\n<p>      In view of the aforesaid, I.A.No.9372\/2011 is dismissed<br \/>\nwithout notice to the other side and accordingly this appeal is<br \/>\nalso dismissed.\n<\/p>\n<p>      So far as contention of the appellant that she is entitled<br \/>\nfor permanent alimony is concerned, the appellant is free to<br \/>\nagitate the matter before the appropriate forum in accordance<br \/>\nwith law, if advised so.\n<\/p>\n<p>      With the aforesaid liberty, this appeal is dismissed with no<br \/>\nother as to costs.<\/p>\n<pre>\n\n\n       (Krishn Kumar Lahoti)             (Smt.
