Justice M.C.HARI RANI\n\n Dated :06\/12\/2010\n\n O R D E R\n            K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n                     * * * * * * * * * * * * *\n                      W.P.C.No.35573 of 2010\n                    ----------------------------------------\n            Dated this the 6th day of December 2010\n\n                            J U D G M E N T\n<\/pre>\n<p>K.M.JOSEPH,J<\/p>\n<p>     The petitioner has approached this Court seeking the<\/p>\n<p>following reliefs:\n<\/p>\n<p>           A.    Issue a writ of mandamus or other<\/p>\n<p>           appropriate writ or direction directing the<\/p>\n<p>           respondents 2 to 4 to afford proper and<\/p>\n<p>           adequate police protection to the life and<\/p>\n<p>           property of the petitioner from the threat of the<\/p>\n<p>           first respondent and their hired Goondas, agents<\/p>\n<p>           and servants from re-possessing the vehicle of<\/p>\n<p>           the petitioner by using illegal methods and by<\/p>\n<p>           using force.\n<\/p>\n<p>           B.    Direct the second respondent to take<\/p>\n<p>           proper and adequate preventive action against<\/p>\n<p>           first respondent and their agents, servants, and<\/p>\n<p>           hired Goondas from causing any untoward<\/p>\n<p>           incident against the petitioner, his family and his<\/p>\n<p>           vehicle.\n<\/p>\n<p>     2.   Also there is a direction sought to dispose of Ext.P2<\/p>\n<p>representation after giving an opportunity to the petitioner for<\/p>\n<p>personal hearing.\n<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.35573 of 2010            2<\/span><\/p>\n<p>      3.    Briefly put, the case of the petitioner is as follows:<\/p>\n<p>      4.    The petitioner availed a loan of Rs.4,00,000\/- from the<\/p>\n<p>1st respondent for purchasing a vehicle.          According to the<\/p>\n<p>petitioner, the amounts were cleared off. However, it is the case<\/p>\n<p>of the petitioner that the 1st respondent, his agents and hired<\/p>\n<p>goondas are trying to repossess the vehicle of the petitioner by<\/p>\n<p>using force and illegal methods. There is threat to the life of the<\/p>\n<p>petitioner and to the lives of the members of his family unless he<\/p>\n<p>surrenders the vehicle.\n<\/p>\n<p>      5.    We have heard the learned counsel for the petitioner<\/p>\n<p>and the learned counsel for the 1st respondent and the learned<\/p>\n<p>Government Pleader.\n<\/p>\n<p>      6. The learned counsel for the 1st respondent submits that<\/p>\n<p>amounts are due even after the petitioner was given the benefit<\/p>\n<p>of rescheduling in the year 2009.     However, he submits that the<\/p>\n<p>1st respondent will not resort to any illegal or forcible method to<\/p>\n<p>repossess the vehicle. The 1st respondent will proceed only in<\/p>\n<p>accordance with law.\n<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.35573 of 2010             3<\/span><\/p>\n<p>      7.    We record the submission and dispose of the writ<\/p>\n<p>petition directing that if contrary to the submission of the 1st<\/p>\n<p>respondent, the 1st respondent attempts to illegally repossess the<\/p>\n<p>vehicle and a complaint is lodged by the petitioner to the 4th<\/p>\n<p>respondent, the 4th respondent will look into it and if the threat is<\/p>\n<p>found to be genuine, he shall afford protection against such<\/p>\n<p>repossession.
