No. 413 of 2009\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                Dated this the 29th day of September, 2010.\n\n                                         JUDGMENT\n<\/pre>\n<p>Bhavadasan, J,<\/p>\n<p>           It is unnecessary to go into the details of the<\/p>\n<p>appeal for the simple reason that it can be disposed of on<\/p>\n<p>the basis of the compromise entered into between the<\/p>\n<p>contesting parties.\n<\/p>\n<p>           2. The appellants and the contesting respondents<\/p>\n<p>have filed a compromise petition, which they pray may be<\/p>\n<p>accepted and necessary modifications may be brought<\/p>\n<p>about in the final decree passed by the court below.<\/p>\n<p>           3. On gong through the compromise petition, it is<\/p>\n<p>seen that the parties have agreed to have a particular mode<\/p>\n<p>of allocation of property shown as                             item No.3, which is<\/p>\n<p>taken in by clause 1(a) of the final decree passed by the<\/p>\n<p>court below. Accepting the compromise, clause 1(a) of the<\/p>\n<p>final decree passed by the court below, which is under<\/p>\n<p>challenge, stands modified as follows:<\/p>\n<p><span class=\"hidden_text\">R.F.A.413\/2009..                2<\/span><\/p>\n<blockquote><p>                 The plaintiff has agreed for allotment of<\/p>\n<p>      35 cents of land in item No.3 instead of 40 cents of<\/p>\n<p>      land allotted in the final decree.    The appellants<\/p>\n<p>      have also agreed to the same and they have agreed<\/p>\n<p>      for allotting 35 cents of land in item No.3 in favour<\/p>\n<p>      of the first respondent\/plaintiff. The Commissioner<\/p>\n<p>      shall identify and set part 35 cents of land     with<\/p>\n<p>      equal measurements on four sides in north-eastern<\/p>\n<p>      portion of item No.3 to be allotted to the first<\/p>\n<p>      respondent as per clause 1(a) in the impugned final<\/p>\n<p>      decree.<\/p><\/blockquote>\n<p>            4. The matter shall go back to the trial court for<\/p>\n<p>locating the property agreed upon by the parties in terms of<\/p>\n<p>the above compromise. The compromise shall form part of<\/p>\n<p>the decree. Parties shall appear before the lower appellate<\/p>\n<p>court on 20.10.2010. Records shall be returned to the court<\/p>\n<p>below, if received.\n<\/p>\n<p><span class=\"hidden_text\">R.F.A.413\/2009..              3<\/span><\/p>\n<p>            We   also express   our  appreciation  for the<\/p>\n<p>commendable work done by the Mediator in brining about a<\/p>\n<p>conciliation between the parties.<\/p>\n<p>                          Thottathil B.
