Both \u00a0 the \u00a0 parties \u00a0 were \u00a0 present \u00a0 and \u00a0 made \u00a0 their \u00a0 submissions. \u00a0 The\u00a0<\/p>\n<p>Appellant\u00a0had\u00a0sought\u00a0a\u00a0number\u00a0of\u00a0details\u00a0including\u00a0records\u00a0relating\u00a0to\u00a0a\u00a0criminal\u00a0<\/p>\n<p>case\u00a0filed\u00a0by\u00a0the\u00a0CBI\u00a0against\u00a0two\u00a0individuals.\u00a0The\u00a0CPIO\u00a0had\u00a0provided\u00a0some\u00a0of\u00a0<\/p>\n<p>the\u00a0information\u00a0but\u00a0had\u00a0refused\u00a0to\u00a0disclose\u00a0the\u00a0records\u00a0relating\u00a0to\u00a0the\u00a0locker\u00a0<\/p>\n<p>number\u00a0630\u00a0and\u00a0its\u00a0contents\u00a0by\u00a0claiming\u00a0that\u00a0the\u00a0matter\u00a0was\u00a0pending\u00a0trial\u00a0and\u00a0<\/p>\n<p>CIC\/WB\/A\/2010\/000231\u00adSM<br \/>\n was,\u00a0therefore,\u00a0exempted\u00a0from\u00a0disclosure\u00a0under\u00a0Section\u00a08(1)\u00a0(h)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0<\/p>\n<p>Information\u00a0(RTI)\u00a0Act.\u00a0The\u00a0Appellate\u00a0Authority\u00a0had\u00a0also\u00a0endorsed\u00a0this\u00a0decision.<\/p>\n<p>3.      During \u00a0 the \u00a0 hearing, \u00a0 the \u00a0 Appellant \u00a0 submitted \u00a0 that \u00a0 he \u00a0 required \u00a0 this\u00a0<\/p>\n<p>information\u00a0in\u00a0connection\u00a0with\u00a0a\u00a0case\u00a0he\u00a0has\u00a0filed\u00a0before\u00a0the\u00a0High\u00a0Court.\u00a0The\u00a0<\/p>\n<p>Respondent\u00a0argued\u00a0that\u00a0these\u00a0records\u00a0were\u00a0part\u00a0of\u00a0the\u00a0case\u00a0which\u00a0the\u00a0CBI\u00a0had\u00a0<\/p>\n<p>filed\u00a0before\u00a0the\u00a0competent\u00a0court\u00a0and\u00a0the\u00a0disclosure\u00a0of\u00a0this\u00a0information\u00a0at\u00a0this\u00a0<\/p>\n<p>stage \u00a0 when \u00a0 the \u00a0 trial \u00a0 was \u00a0 pending \u00a0 could \u00a0 impede \u00a0 the \u00a0 prosecution \u00a0 of \u00a0 the\u00a0<\/p>\n<p>offenders.\u00a0 Out\u00a0 of\u00a0 the \u00a0 three\u00a0 queries,\u00a0 two \u00a0 are \u00a0 in \u00a0 the\u00a0 nature\u00a0 of\u00a0 purely\u00a0 factual\u00a0<\/p>\n<p>details,\u00a0such\u00a0as,\u00a0the\u00a0name\u00a0of\u00a0the\u00a0holder\u00a0of\u00a0the\u00a0locker\u00a0number\u00a0630\u00a0and\u00a0the\u00a0date\u00a0<\/p>\n<p>on\u00a0which\u00a0the\u00a0said\u00a0locker\u00a0was\u00a0sealed.\u00a0We\u00a0do\u00a0not\u00a0seem\u00a0particularly\u00a0how\u00a0the\u00a0<\/p>\n<p>disclosure \u00a0 of \u00a0 these \u00a0 factual \u00a0 details \u00a0 can \u00a0 have \u00a0 any \u00a0 adverse \u00a0 effect \u00a0 on \u00a0 the\u00a0<\/p>\n<p>prosecution.\u00a0However,\u00a0his\u00a0third\u00a0query\u00a0is\u00a0regarding\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0locker.\u00a0As\u00a0<\/p>\n<p>the\u00a0Respondent\u00a0clarified,\u00a0the\u00a0disclosure\u00a0of\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0locker\u00a0during\u00a0the\u00a0<\/p>\n<p>pendency\u00a0of\u00a0the\u00a0trial\u00a0of\u00a0the\u00a0case\u00a0could\u00a0have\u00a0adverse\u00a0effect\u00a0on\u00a0the\u00a0trial\u00a0itself\u00a0<\/p>\n<p>since\u00a0 this \u00a0 material \u00a0 could \u00a0 be \u00a0 put \u00a0 to \u00a0 use \u00a0 against\u00a0 the \u00a0 prosecution.\u00a0 He \u00a0 further\u00a0<\/p>\n<p>argued\u00a0that,\u00a0in\u00a0any\u00a0case,\u00a0the\u00a0trial\u00a0court\u00a0was\u00a0seized\u00a0of\u00a0the\u00a0matter\u00a0and\u00a0any\u00a0relief\u00a0<\/p>\n<p>should\u00a0be\u00a0sought\u00a0from\u00a0the\u00a0trial\u00a0court\u00a0itself.\u00a0We\u00a0are\u00a0inclined\u00a0to\u00a0agree\u00a0with\u00a0this\u00a0<\/p>\n<p>line\u00a0of\u00a0argument.\n<\/p>\n<\/p>\n<p>4.      Thus,\u00a0 only\u00a0 two\u00a0 pieces\u00a0 of\u00a0 information\u00a0 need\u00a0 to \u00a0 be\u00a0 disclosed\u00a0 as\u00a0 stated\u00a0<\/p>\n<p>above,\u00a0namely,\u00a0the\u00a0name\u00a0of\u00a0the\u00a0holder\u00a0of\u00a0the\u00a0locker\u00a0as\u00a0well\u00a0as\u00a0the\u00a0date\u00a0on\u00a0<\/p>\n<p>which \u00a0 the \u00a0 locker \u00a0 had \u00a0 been \u00a0 sealed. \u00a0 We \u00a0 direct \u00a0 the \u00a0 CPIO \u00a0 to \u00a0 provide \u00a0 this\u00a0<\/p>\n<p>information\u00a0to\u00a0the\u00a0Appellant\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0the\u00a0receipt\u00a0of\u00a0this\u00a0order\u00a0<\/p>\n<p>along\u00a0with\u00a0the\u00a0photocopies\u00a0of\u00a0any\u00a0relevant\u00a0record.<\/p>\n<p>5.      The\u00a0appeal\u00a0is\u00a0disposed\u00a0off\u00a0accordingly.\n<\/p>\n<p>6.
