Government Pleader\n\n\t\t\t\t\t  * * * *\t\n:ORDER\n<\/pre>\n<p>\tThis petition has been filed to call for the records of the fourth<br \/>\nrespondent in his proceedings dated 22.10.2008 in Na.Ka.No.441\/08 A3 and quash<br \/>\nthe same and consequently to direct the respondents 2 to 4 herein not to<br \/>\ninterfere with the petitioner&#8217;s peaceful possession and enjoyment of Arulmigu<br \/>\nSadasara Shanmuganathar Temple situates in Survey No.302 at Karuppatti Rock,<br \/>\nVeriyappur Village, Oddanchatram Taluk, Dindigul District.\n<\/p>\n<p>\t2. Heard the learned counsel for the petitioner,  Mr.R.Janakiramulu,<br \/>\nlearned Special Government Pleader, who took notice on behalf of the respondents<br \/>\n1 and 2 and also Mr.K.M.Vijayakumar, learned Additional Government Pleader, who<br \/>\ntook notice on behalf of the respondents 3 and 4.\n<\/p>\n<p>\t3. The grievance of the petitioner as aired by the learned counsel for the<br \/>\npetitioner placing reliance on the averments in the affidavit accompanying the<br \/>\nwrit petition, is to the effect that the petitioner is a Poojari of the temple<br \/>\nviz., Arulmigu Sadasara Shanmuganathar Temple, Karuppatti Rock, Veriyappur<br \/>\nVillage, Oddanchatram Taluk, Dindigul District; while so, some miscreants<br \/>\nattempted to disturb his function as Poojari in that temple; thereupon he<br \/>\napproached the District Munsif Court, Palani and got a decree for injunction in<br \/>\nO.S.No.218 of 2000; as against which appeal was filed and it was also dismissed;<br \/>\nwhile so, some persons unauthorizedly attempting to convert that hillock, where<br \/>\nthe temple is situated, as a stone quarry; meanwhile, the fourth respondent<br \/>\nissued the impugned order dated 22.10.2008, without giving him due opportunity<br \/>\nof being heard.  Hence, this writ petition.\n<\/p>\n<p>\t4. The petitioner&#8217;s contention is that the temple should be protected from<br \/>\nbeing demolished by unauthorized persons, who are trying to set up a stone<br \/>\nquarry in that locality.\n<\/p>\n<p>\t5. The learned counsel for the respondents 3 and 4 would submit that as<br \/>\nper the impugned order, the Hindu Religious and Charitable and Endowment<br \/>\nDepartment officials are only trying to take action as per the provisions of the<br \/>\nHR &amp; CE Act and there need not be any quashment of that order and they would<br \/>\nalso see to it that the temple is preserved.\n<\/p>\n<p>\t6. Heard both sides.\n<\/p>\n<p>\t7. It is therefore clear that the petitioner as well as the Hindu<br \/>\nReligious and Charitable and Endowment Department officials are interested in<br \/>\nprotecting the temple.  The petitioner is interested in safeguarding his right<br \/>\nas a poojari in that temple and nothing more.  Hence, in these circumstances,<br \/>\nthe following direction is issued:\n<\/p>\n<p>\tThe Hindu Religious and Charitable and Endowment Department shall do well<br \/>\nto see that immediately action is taken under the HR &amp; CE Act to preserve the<br \/>\ntemple and at that time, the petitioner shall be given due opportunity of being<br \/>\nheard so as to safeguard his right as poojari in that temple.  The Hindu<br \/>\nReligious and Charitable and Endowment Department officials and the District<br \/>\nCollector, Dindigul shall see that no one is demolishing the temple.\n<\/p>\n<p>\t8. With the above directions, this Writ Petition is disposed of.  No<br \/>\ncosts.
