Shah, A.G.P. for Respondent(s) : 1, \nDS\nAFF.NOT FILED (N) for Respondent(s) : 1, \nRULE SERVED for\nRespondent(s) :\n2, \n========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/05\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npetitioner has prayed for quashing and setting aside the order dated<br \/>\n27.2.2007 whereby the application of the petitioner for compassionate<br \/>\nappointment was rejected on the ground of delay.\n<\/p>\n<p>2.\tFather<br \/>\nof the petitioner, who was working with respondent, died in harness<br \/>\nand thereafter the petitioner made an application for compassionate<br \/>\nappointment.\n<\/p>\n<p>3.\tLearned<br \/>\nAdvocate for the petitioner submitted that the respondent authority<br \/>\nhas erroneously rejected the request of the petitioner even though<br \/>\nthe father of the petitioner had died in harness. According to him,<br \/>\nthe delay caused in applying for appointment on compassionate ground<br \/>\nshould have been condoned.\n<\/p>\n<p>4.\tAs<br \/>\na result of hearing and perusal of the record, there is no dispute<br \/>\nthat the father of the petitioner has died on 13.03.1989 and the<br \/>\napplication for appointment on compassionate ground was made on<br \/>\n31.01.2000. Admittedly there is a long delay in applying for<br \/>\nappointment under the scheme.\n<\/p>\n<p>5.\tIn<br \/>\nthe appointment on compassionate ground, there should not be any<br \/>\ndelay in such appointment. In the case of State of Manipur Vs. Md.<br \/>\nRajaodin, reported in (2003)7 SCC 511 the Apex Court has<br \/>\nheld that when there is a long delay in applying for appointment<br \/>\nunder the scheme, such request cannot be accepted. It is required to<br \/>\nbe noted that the purpose of providing appointment on compassionate<br \/>\nground is to mitigate the hardship due to death of the breadwinner in<br \/>\nthe family. Such appointments should, therefore, be provided<br \/>\nimmediately to redeem the family in distress. The facts that the ward<br \/>\nwas a minor at the time of death of his father is no ground, unless<br \/>\nthe scheme itself envisages specifically otherwise to state that as<br \/>\nand when such minor becomes a major he can be appointed without any<br \/>\ntime consciousness or limit. The above principle is laid down in the<br \/>\ncase of Sushma Gosain Vs. Union of India, reported in (1989) 4 SCC\n<\/p>\n<p>468. As held in the case of Sanjay Kumar Vs. State of Bihar<br \/>\nand others, report in (2000)7 SCC 192, there cannot be any<br \/>\nreservation of a vacancy till such time as the petitioner becomes a<br \/>\nmajor after a number of years, unless there are some specific<br \/>\nprovisions. The aforesaid view has further been reiterated by the<br \/>\nApex Court in the case of Eastern Coalfields Limited Vs. Anil<br \/>\nBadyakar and others, reported in (2009) 13 SCC 112. In the<br \/>\npresent case the petitioner is not able to point out any provision in<br \/>\nthe scheme which enables the petitioner to apply for appointment on<br \/>\ncompassionate ground after a long delay. Therefore, this Court is of<br \/>\nthe view that the authority has rightly rejected the request of the<br \/>\npetitioner in view of the long delay in making application.\n<\/p>\n<p>6.\tIn<br \/>\nthe premises aforesaid, I do not find any merits in the petition. The<br \/>\nsame is accordingly rejected. Notice is discharged.
