No.520 of 2009\n              ----------------------------------------------\n                     Dated 4th March, 2009.\n\n                          J U D G M E N T\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>            Appellant\/Kerala State Road Transport Corporation is<\/p>\n<p>the respondent in W.P.(C) No.179\/09.            It is aggrieved by the<\/p>\n<p>direction issued by the learned Single Judge to disburse the<\/p>\n<p>retirement benefits to the writ petitioner overlooking the priority,<\/p>\n<p>observing also that the disbursement shall not be out of the 10%<\/p>\n<p>earmarked for disbursement of the retirement benefits. We are<\/p>\n<p>afraid, in view of the direction issued by the Division Bench of this<\/p>\n<p>Court and by the Apex Court with regard to the disbursement of<\/p>\n<p>the retirement benefits, this court will not be justified in issuing<\/p>\n<p>such a direction. The disbursement of the retirement benefits to<\/p>\n<p>the employees of the KSRTC is to be made, as per the decisions<\/p>\n<p>referred to above, out of the 10% of the income set apart<\/p>\n<p>specifically for the same, unless otherwise permitted by the<\/p>\n<p>Supreme Court, since the Supreme Court is now in seizin of the<\/p>\n<p>entire issue.   The learned Single Judge having found that the<\/p>\n<p>petitioner is entitled for an out of turn treatment, we direct the<\/p>\n<p>appellant to disburse the benefits as directed by the learned<\/p>\n<p><span class=\"hidden_text\">WA NO.520\/09                    2<\/span><\/p>\n<p>Single Judge from out of the 10% set apart for disbursement of<\/p>\n<p>the retirement benefits, within ten days from the date of<\/p>\n<p>production of a copy of the judgment by the petitioner.
