Respondent\n\nL s:a.;r&amp;\u00a7\u00a7,*T:Ramakrishna, HCGP]\n\n\" This Criminal Appeai is \ufb01led U\/S 374(2) of\n\n \" 'C.1_'.P.C., praying to set aside the judgment dated\n\n 'v:3_1:;1.2007 and order dated 1.2.2007 in Special Case\n No.2\/2006 passed by the learned 11 Additional Special\n Judge, D K, Mangaiore.\n\nc9wS\"\"\"\"\"'-\"\\.4\n\n\n\n2\n\nThis Criminal Appeal coming on for further\nsubmission and for dictating judgment this day, the\ncourt made the following:\n\nJUDGMENT\n<\/pre>\n<p>The accused in Special Case No.2\/2006 file<\/p>\n<p>of the learned 11 Additional Special <\/p>\n<p>Mangalore [hereinafter referred&#8221;&#8221;&#8216;to. gasp Colurt&#8217; for &#8216;; <\/p>\n<p>short) has challenged in <\/p>\n<p>judgment and order of conviction an&#8217;d.._s&#8221;entenc&#8217;e&#8221; dated<\/p>\n<p>3 1.1.2007 passed in the said &#8216;cased&#8221;e.onvicting&#8221;him for the<\/p>\n<p>offences under   376 IPC and<br \/>\nsentencingfihgirniifigo  for a period of six months<\/p>\n<p>for  forrnerg  R1 for a period of seven years<\/p>\n<p>and to pay  \ufb01ne ofRs..25,000\/&#8211; with default sentence of<\/p>\n<p>..  A i&#8221;rr1pri.s&lt;on:&quot;nent formfurther period of six months for the<\/p>\n<p>  the arguments of Sri Sharat Chandra Bijai,<\/p>\n<p> A the &quot;learned counsel for the appellant &#8212; accused and Sri<\/p>\n<p>  Ramakrishna, the learned High Court Government<\/p>\n<p> Pleader for the respondent &#8211;~ State. Perused the entire<\/p>\n<p> M<\/p>\n<p><span class=\"hidden_text\">3<\/span><br \/>\nmaterials in the original records obtained from the Trial<\/p>\n<p>Court.\n<\/p>\n<p>3. Though the accused was chargesheeted.-for the<\/p>\n<p>offences under Sections 448, 376, 506 read Section<\/p>\n<p>3(1](XIl] of sc and ST [PA] Act, 1989, the  <\/p>\n<p>appreciation of oral evidencielddllofe <\/p>\n<p>&#8220;to  the 7<\/p>\n<p>documents at Exs.P1 to P16 and ix\/Itj)s.lj.\u00bb&#8217;,t:_oA <\/p>\n<p>by the prosecution and als&#8217;o:after  HEVx.Dl, a<br \/>\nportion of the stateinent  :.miar.l:ed forthe accused,<br \/>\nfound the accused   under Sections<\/p>\n<p>448:&#8217;a1&#8217;1d i3\u00bb&#8217;AV\/&#8217;V&#8217;Vt&#8217;5&#8243;&#8216;&lt;)&#039;i&#039;=&quot;tf:p(:7land-~convicted him accordingly.<\/p>\n<p>4.  _ Oflkthev&#8230;.&#8217;&#8211;nir1eVA&#8221;&#8216;:witnesses examined for the<\/p>\n<p> &#8216;plroseoition, PW&#8217;l'&#8221;VKum.Girija is the prosecutrix, PW2<\/p>\n<p>   is her uncle and PW6 Smt.Bethru is her<\/p>\n<p>niothver.  4 and 8 are Medical Officers, who<\/p>\n<p> to exazniiied the prosecutrix. PWs.5 and 9 are the police<\/p>\n<p>A&#8217; &#8216;~-V_V&#8217;wi-tnesses and PW.7 is the panch to EXP2 scene of<\/p>\n<p>ii  offence.\n<\/p>\n<p>.,..c*&#8217;~&#8221;\n<\/p>\n<\/p>\n<p>5. In order to prove the incident of forcible sexual<br \/>\nintercourse alleged to have been committed the<\/p>\n<p>accused on PWI Kum.Girija, the prosecution..h_as_&#8217;_<\/p>\n<p>reliance on the oral evidence of PWs.    <\/p>\n<p>is the complaint of PW1 comp}lainl_a4n&#8217;t.  <\/p>\n<p>recorded by PW5 PS1 on 2&#8217;1.,__12.Ll&#8217;O.(v)l5 at  <\/p>\n<p>she was under treatment   Hospital at<br \/>\nMangalore. Her  al1egeld&#8217;~&#8211;i_n..,Atl1,e said complaint is<\/p>\n<p>as under:    _  &#8216;<\/p>\n<p>eibtiut 10.00 am. the<\/p>\n<p>  and other members of the<br \/>\n  Ujire and as such she was<br \/>\n ivngthelhouse and at that time, While she was<\/p>\n<p>it c1eanin&#8217;g..lth_e&amp;Ai\ufb02oor, the accused entered into the<br \/>\n under the guise of taking a cassette and<br \/>\n V&#8221;.t~,s.eeing nobody was in the house, he<br \/>\nvcothiriitted forcible sexual intercourse by dragging<br \/>\nand lying her on the \ufb02oor by force. When she<br \/>\nraised cry, he threatened her saying that if she<br \/>\nwere to cry, he would kill her. Despite her<br \/>\nresistance, he continued his act of forcible sexual<\/p>\n<p>intercourse on her for about half an hour and<br \/>\n&#8216;,___;&#8221;&#8221;&#8216;&#8221;N-&#8230;&#8230;,\u00ab-=-\n<\/p>\n<\/p>\n<p>6.<\/p>\n<p>thereafter he went away from her house by<br \/>\nthreatening her that if she were to disclose before<\/p>\n<p>any one, he would kill her.\n<\/p>\n<p>Her mother, elder sister and bIf\u00a73tl1!31V&#8217;~&#8211;._i&#8217;:f1V~:-l\ufb01wl,<\/p>\n<p>who had gone to Ujire, returned   <\/p>\n<p>a.m. and she informed theniall  incident 01&#8242; <\/p>\n<p>and thereafter they all tool\u00e9:l:\u00b0ii&#8217;er <\/p>\n<p>hospital at Belthangady, where she: <\/p>\n<p>aid and then she vvlas&#8217;l&#8217;taken~..toi*VLady Goshen<br \/>\nhospital for f1j&#8217;1&#8217;t_I_1errtreatnlentpas advised by the<br \/>\ndoctor at   Belthangady.\n<\/p>\n<p>While slf1&#8217;eV_was~&#8217;takifigV  the hospital at<\/p>\n<p>Mangialoigs,  police :..reco1&#8243;ded her complaint<\/p>\n<p> statenient as per<\/p>\n<p> the&#8217;  ofili\ufb01felthangady PS has stated in his<\/p>\n<p>evidence thatsoln 20.12.2005, he received information<\/p>\n<p>,0 ;&#8217;fron1.,:the\u00ab,:Government hospital, Belthangady that one<\/p>\n<p>if *  brought to the said hospital and she<\/p>\n<p>was referred to Lady Goshen hospital at Mangalore as<\/p>\n<p>it ~  she had excessive bleeding and therefore, after receiving<br \/>\nlffrom the Medical Officer of Government Hospital,<\/p>\n<p>Belthangady Ex.P6 intimation to that effect, he went to<\/p>\n<p>______;&#8211;..-..&#8212;-.___..\n<\/p>\n<p><span class=\"hidden_text\">6<\/span><br \/>\nLady Goshen hospital, Mangalore and recorded the<\/p>\n<p>complainants statement of the prosecutrix as per<\/p>\n<p>Ex.P1.\n<\/p>\n<p>&#8216;7. PW.3 Dr.Ramesh, the Medical  of<\/p>\n<p>Community Health Centre of Beithangadyiliaselstated$_&#8221;in&#8217;\u00bb <\/p>\n<p>his evidence that on 20.12.2005.at._5.;oo7;)_.fn;&#8211;7&lt;pWi F <\/p>\n<p>Kum.Girija aged about 20_years&#039;wiasi.broughtto <\/p>\n<p>hospital by PW2 Kariya  with&#039;Vforcible<br \/>\nintercourse on her  [accused herein)<br \/>\non the morning of    her residential<\/p>\n<p>house. &#8211;_ He Vhas:furthie&#039;r&#8211;..deposed that since the patient<br \/>\nwas a girhhe  to Dr.Swarna Latha, the other<\/p>\n<p>  the said hospital and the said<\/p>\n<p>&#039; ;Dr,Swari1a&quot;&quot;Latha gave her first aid treatment and<\/p>\n<p>&quot; .referred.V&#8211;&#039;toVher to Lady Goshen hospital at Mangalore for<\/p>\n<p>further treatment. He has further deposed that on<\/p>\n<p> x_f23.,12.2005 at 9.45 am the accused was brought to him<\/p>\n<p>by pc No.1929 of Belthangady ps and he examined the<\/p>\n<p>accused as to his competency to commit sexual<\/p>\n<p>-P&#8221;&#8221;&#8221;&#8221;&#8221;-&#8216;x&#8230;&#8217;<\/p>\n<p><span class=\"hidden_text\">7<\/span><br \/>\nintercourse and issued EX.s.P3 and P4\u00bb certificates. He<\/p>\n<p>has further deposed that when he examined the victim<br \/>\nKum.Girija, he noticed some abrasions on right and left<\/p>\n<p>side of her chest and also below the collar boneV,V&#8221;.._&#8217;._<\/p>\n<p>8. PW4 Dr.Swarna Latha, the Lady Medical.&#8217; at<\/p>\n<p>Community Health Centre, Belthangady,&#8217;:has:.b_5&#8217;tated&#8217; <\/p>\n<p>her evidence that on 20.12.2[o05[t&#8217;at;t   <\/p>\n<p>PWI Kurn.Giri_\u00a7a aged abo-ut__20  <\/p>\n<p>said hospital by her uncle &#8216;K.a;iya.&#8217;E{1irrnar VVEPWZ) with<br \/>\na history of sexual  on; one Sheikunhi<\/p>\n<p>[accu_serj&#8217; morning of that day. She has<br \/>\nfurther&#8221;d_ep0_sed_ tha&#8217;t.sl_;1e noticed one laceration and also<\/p>\n<p>p.rofnse b1e&#8217;e&#8217;di.ng___pj.n her Vagina and therefore, after<\/p>\n<p>&#8216; ;Vgivi11.g&#8217;her\u00e9&#8221;\ufb01r_st aid treatment, she advised that she be<\/p>\n<p>&#8221; taken  Goshen Hospital at Mangaiore.<\/p>\n<p>9} i.  &#8220;p_,w_8 Dralacintha D&#8217;Souza, the Lady Medical<\/p>\n<p>A  yC5f\u00a3_icer at Lady Goshen Hospital at Mangalore, has<\/p>\n<p>deposed in her evidence that she examined the victim<\/p>\n<p>..-.&#8211;.5&#8243;v&#8221;&#8216;\\r-\u00ab.&#8211;s.&#8211;a\u00ab&#8230;\u00bbr&#8211;s<\/p>\n<p><span class=\"hidden_text\">8<\/span><br \/>\nKurn.Girija at 7.50 pm. on 20.12.2005, who was<\/p>\n<p>referred to the said hospital by the Medical Officer of<br \/>\nBelthangadi Hospital, the said girl gave history before<\/p>\n<p>her that in the morning of that day, she was Vsubjected<\/p>\n<p>to forcible sexual intercourse by one Sheikufrihi<\/p>\n<p>herein] and that after the said &gt;incident;&#8221;sh:e,  <\/p>\n<p>to the Government Hospital at Beltha1&#8217;rgadil\u00a7&#8221;Wi1:ere&#8221;*Ishe .<\/p>\n<p>was given first aid treatniierit: This llladyili\/ledical Officer&#8217;<\/p>\n<p>has further deposed in helrfe_Vid_ence &#8220;that clinical<\/p>\n<p>examination of the vlic=timtg_irl.,&#8217; j.sheil,i:otic_ed the following:<\/p>\n<p> iiii   ail&#8221;_loi}*evr the body of the girl; no<br \/>\n found either on her breasts<br \/>\nor-pm  of the body; there was vaginal<\/p>\n<p>_ .. p1eedi&#8217;n.glH&#8217;a&#8217;s alresult of laceration measuring about<br \/>\n i.j&#8217;3~~4&#8242; ..crns.:llone more injury was found at posterior<br \/>\n   the Vagina measuring about 2 cms.;\n<\/p>\n<p>&#8216;vhf-riaerilllwas ruptured; uterus was of normal size;<br \/>\n painful; blood stains were found on legs<br \/>\na &#8220;and thighs and there was still bleeding from her<\/p>\n<p>vagina.\n<\/p>\n<p><span class=\"hidden_text\">10<\/span><\/p>\n<p>the victim sustained the said injuries in her vagina as a<br \/>\nresult of thrusting of some wooden stick for aborting as<\/p>\n<p>she was pregnant. But P.W.8 has denie:df_l&#8217;~~this<\/p>\n<p>suggestion and absolutely no material is<\/p>\n<p>record on behalf of the accused\u00bbito__shot\\XrV&#8221;that; &#8216; . <\/p>\n<p>girl was pregnant at any timeto   <\/p>\n<p>the incident. Therefore, ll  the.__conside;red&#8221;oiainion V<\/p>\n<p>that through the evidence -..&#8221;g_of&#8221;&#8216;-thesell&#8217;three Medical<br \/>\nOfficers and the   by them, the<\/p>\n<p>prosecution,  esitahjtishedAlbeyond&#8217; reasonable doubt<\/p>\n<p>that the  it  \u00bb fiamely&#8221;, V V P.W. 1 Kurn. Girija, was<br \/>\nsubjected to intercourse on the morning<\/p>\n<p>of 20. 12.l2oo&#8217;5, ..\n<\/p>\n<p>&#8216;l V.  A  :,P,W&#8230;1 victiiiillgirl, has stated in her evidence that<\/p>\n<p>  &#8221; a.In. on that day, While she was cleaning<\/p>\n<p>the floor. her house, the accused came into her house,<\/p>\n<p> , held &#8220;her firmly, laid her on the floor and then<\/p>\n<p>&#8216;committed sexual intercourse on her by removing her<\/p>\n<p>&#8220;clothes and also his clothes, despite her resistance and<\/p>\n<p>\u00a3,&#8230;.\u00ab$-&#8216;-?&#8221;p~&#8221;&#8216;&#8221;K\u00a2r<\/p>\n<p><span class=\"hidden_text\">11<\/span><br \/>\nwithout her Consent. She has further deposed that<\/p>\n<p>when she tried to cry, the accused threatened her that if<\/p>\n<p>she were to cry, he would kill her. She has&#8217;u&#8217;\u00bb:.it1rrther<\/p>\n<p>deposed that at the time of the incident, aloiare<\/p>\n<p>in the house as her parents had   <\/p>\n<p>at about 11.00 a.m., her unc1e=_i3.W.r2 S<\/p>\n<p>her parents returned home from &#8216;Ujiree.&#8221;an:d:4_Vthe&#8217;ndishes.<\/p>\n<p>narrated the incident to  and the.re&#8217;afteV15&#8217;, she was<br \/>\ntaken to Governmerrt\ufb02Plospittjalatfielthangadi and from<\/p>\n<p>there to LadytGoshe1*1&#8243;Hospital__at&#8217;Manga1ore for further<\/p>\n<p>treatment\u00bb,.:    A admitted as inpatient. She<br \/>\nhas further on the next day morning, the<\/p>\n<p>Police of&#8221;&#8221;B_e&#8217;lthanlg&#8217;adi: Police Station came there and<\/p>\n<p>&#8216;S S.  A rVlee:or\u00a5:ied&#8217;l&#8217;her cornlplvaint statement as per Ex.Pl and her<\/p>\n<p>    taken on it and it is at Ex.Pl{a).\n<\/p>\n<p>l1&#8243;3. above evidence of P.W.1 prosecutrix falls in<\/p>\n<p> .. line. with her allegations in the complaint Ex.P1. The<\/p>\n<p>S &#8220;&#8216;._VVsu&#8217;g:gestion put to her on behalf of the accused that she<\/p>\n<p>was pregnant as she had illicit intimacy with C.W.7<\/p>\n<p>,-..f&#8221;V&#8217;*-&#8220;&#8221;1&#8230;.\u00ab&#8212;-\u00bb-.\n<\/p>\n<p>Somanatha, who happened to be her brother\u00ab~in~1aw,<br \/>\nand that when she attempted to get aborted by resorting<\/p>\n<p>to the rude method of thrusting a wooden stic};Vi1uto._her<\/p>\n<p>private parts, she sustained the said inju_ries,i<\/p>\n<p>by her in specific terms. The accnsedhas:i&#8217;iot'&#8221;broVught&#8217; &#8216; \\&#8217; <\/p>\n<p>any material on record, through the &#8216; cross&#8217;4e:};a:mi;i1ation<\/p>\n<p>of any of the prosecutionyvitnesses, to that his<\/p>\n<p>said defence is probable.  no dtcircuihstance is<br \/>\nbrought on record  show that the<\/p>\n<p>victim was, ayptoonsenting par\u00b0t_y_ toithe act of sexual<\/p>\n<p>interetourse}V7cVorn3i&#8217;riitted&#8217;by hirnvion her. He has also not<br \/>\nbrought  1&#8217;ece&#8221;1jfd_it&#8217;an:y\u00bb\u00bb\u00abcircumstance to show that the<\/p>\n<p>co1js1p1ainantV~Victirn&#8217;-fiied her complaint against him and<\/p>\n<p> ..agains&#8217;tWAhim falsely at the cost of her<\/p>\n<p>1 =. 3 r_eput.a&#8217;ti.on  . V V <\/p>\n<p>   observed by Hor1&#8217;ble Supreme Court in the<\/p>\n<p> by &#8221; case of STATE OF PUNJAB Vs. GURMIT SINGH AND OTHERS<\/p>\n<p>tdfeported in AIR 1996 so 1393 that Cl girl, in a tradition<\/p>\n<p>H bound non-permissive society in India, would be<\/p>\n<p>__ <\/p>\n<p><span class=\"hidden_text\">13<\/span><br \/>\nextremely reluctant even to admit that any incident which<\/p>\n<p>is likely to reflect upon her chastity had occurred, being<br \/>\nconscious of the danger of being ostracized by the society<\/p>\n<p>or being looked down by the society. It iscfurther<\/p>\n<p>observed by the Supreme Court at the <\/p>\n<p>of its judgment that the Courts  <\/p>\n<p>evidence, remain alive to the fact that in..a~..ca,seV\u00a7:f rape.<\/p>\n<p>no self-respecting worrianrivauld conie_foriva.\ufb01d&#8230;inVVa Court<\/p>\n<p>just to make a humiliatingstatement  honour<\/p>\n<p>such as is involved in-.of rape on her. It<\/p>\n<p>is alsolllobstervetifyhither-\u00e9\u00a7i11 thbat&#8221; the testimony of victim in<br \/>\ncasesaof sexudl&#8217;:_ijofj&#8217;e&#8211;.nces~*&#8217; is vital and unless there are<\/p>\n<p>compelling t_:Vre.$onsV'&#8221;:which necessitate looking for<\/p>\n<p>. V.  A corroboration of&#8217; statement, the Courts should \ufb01nd no<\/p>\n<p>   on the testimony of a victim of sexual<\/p>\n<p>as__sault .V.alone to convict and accused where her<\/p>\n<p> t testimony inspires confidence and is found to be reliable.<\/p>\n<p>&#8216;1&#8217;fj.: Following the above observations of Horfble<\/p>\n<p>&#8220;Supreme Court, I am of the considered opinion that the<\/p>\n<p>&#8230;..s*&#8212;~&#8221;\n<\/p>\n<p>Trial Court did not commit any error in accepting the<br \/>\nevidence of the prosecutrix insofar as it relates to the<\/p>\n<p>occurrence of the incident of forcible sexual intercourse<\/p>\n<p>on her by the accused without her consen_t&#8221;&#8216;an.d_.<\/p>\n<p>her resistance.\n<\/p>\n<p>16. Further, the evidence of  0<\/p>\n<p>maternal uncle and   <\/p>\n<p>prosecutrix, falls in line  then &#8216;a\\rern1ents in the<br \/>\ncomplaint EX.Pl aiidf th.e&#8221;~&#8211;oral&#8217;~ievidence of P.W.l<\/p>\n<p>prosecutrix. The  believed the<\/p>\n<p>evidence- l&#8217;&#8211;th~egs&#8217;e twomyvitriesses namely. P.Ws.2 8: 6<br \/>\ninsofar &#8220;it relateslto  circumstances immediately after<\/p>\n<p> occurrence&#8217; of the incident of rape on the victim girl<\/p>\n<p>.0 &#8220;by the accused and the girl narrating before<\/p>\n<p>    incident and also as to taking of the<\/p>\n<p> to the hospitals for her treatment.\n<\/p>\n<p>it ~    Sarat Chandra Bijai, the learned counsel for the<\/p>\n<p>Vfaplpellantwaccused strongly contended that though the<\/p>\n<p>incident took place at about 10.00 am. on 20.12.2005<\/p>\n<p>(__\u00a7\\,..,a<\/p>\n<p>:5<br \/>\nas alleged in the complaint and also as deposed by<\/p>\n<p>P.W. 1 prosecutrix, she was taken to hospital at<br \/>\nBelthangadi at about 5.00 p.m. and her complaint came<\/p>\n<p>to be recorded on the next day at about 11.30 &#8216;and<\/p>\n<p>the prosecution has not successfully  <\/p>\n<p>delay and therefore, the Trialmgp<\/p>\n<p>disbelieved the evidence of :&#8221;san13-;e_*&#8217;it .<\/p>\n<p>ought to have acquitted the accused  <\/p>\n<p>benefit of doubt.\n<\/p>\n<p>18. Per contra, learned,.\u00a7&#8217;i&#8217;*l:&#8217;Iight~v:h_fijourt Government<\/p>\n<p>Plea&#8217;der__contended.&#8217; that after the parents of the<br \/>\nV1&#8217;CtilT1&#8242; girllireturnegci\u00bb&#8211; they searched for a jeep and<\/p>\n<p> &#8220;the gi&#8217;rl.._,iyas taken in the jeep to Belthangadi, as<\/p>\n<p>t  P.W.2, and thus, the prosecution has<\/p>\n<p>   delay caused in taking the girl to the<\/p>\n<p>h4ospi&#8217;tal..&#8217; He further contended that, as deposed by<\/p>\n<p>it   the P.S.l. of Belthangadi Police Station, soon<\/p>\n<p> after he came to know of the admission of the victim girl<\/p>\n<p>in Lady Goshen Hospital at Mangalore, he rushed to the<br \/>\ne&#8211;&#8220;\\&#8221;&#8221;L&#8217;\/\/&#8212;-\n<\/p>\n<p><span class=\"hidden_text\">16<\/span><br \/>\nsaid hospital at about 11.30 am. on the very next<\/p>\n<p>morning of the admission of the prosecutrix in the said<br \/>\nhospital and recorded the statement of the girl as per<br \/>\nEX.P1 and thereafter, he immediately dispatc}:1ed._V&#8217;the<\/p>\n<p>F.I.R. to the Court.  &#8216;\n<\/p>\n<p>19. As could be seen from the contents&#8217;,<\/p>\n<p>&#8220;f  <\/p>\n<p>the residence of the prosecutriii was xat_;a._:&#8217;di_starieet&#8221;of hi&#8217; it<\/p>\n<p>about 25 kms. from _Be1thEanga_di  = <\/p>\n<p>Further, the Victim was  profuse&#8217;b1&#8243;eedinHg&#8221; and as<br \/>\nsuch, she could d\ufb02ken  any public<\/p>\n<p>conxfeyancepfwppqfhereforeg it was quite reasonable for<br \/>\nP.W.2 A  other .&#8211; of the family of the<\/p>\n<p>prci\u00e9seciitrixV&#8217;to._.Vspend few hours in getting the jeep for<\/p>\n<p>t to the hospital at Belthangadi. Further,<\/p>\n<p>it &#8216;-therev.&#8217;is&#8221;_&#8217;noA&#8217;p::.ahnorma1 delay in recording the compiaint<\/p>\n<p>stateriierit of P.W.t prosecutrix. Besides this, no<\/p>\n<p>it cireurnstance is brought on record by the accused to<\/p>\n<p>Vgshow that the said complaint was falsely created by the<\/p>\n<p>prosecutrix against him with a definite motive.<\/p>\n<p>,\u00bb.._.(&#8220;&#8221;&#8221;~<\/p>\n<p>Therefore, the submission of the learned counsei___for the<\/p>\n<p>appellant-accused that there was abnor1na1j&#8221;def}ay.,&#8217;4 in<\/p>\n<p>taking the girl to the hospital and also  4&#8242;<\/p>\n<p>compiaint statement and that&#8221; -the   <\/p>\n<p>remained unexplained, cannot be a&#8211;ccepte&#8217;d.,.  \u00ab. V&#8217; <\/p>\n<p>20. In View of the cogentdxand  eigidence of<br \/>\nP.Ws.1, 2 8: 6 her uncle<br \/>\nand her mother, and..aJ_s0  O\ufb01icers<br \/>\nnamely,   &#8216;ddthefconsidered opinion<br \/>\nthat the  beyond reasonable<br \/>\ndoubt  t&#8217;heT&#8221;.a._ce1ised who committed sexual<br \/>\nintercourse  forcibiy without her<\/p>\n<p>consent. andddespitevher resistance and for that purpose<\/p>\n<p>  i11_egai13;..,.6\ufb02tered into the residential house of the<\/p>\n<p>  as such, the Trial Court was quite<\/p>\n<p>justitieyd  recording its finding that the accused<\/p>\n<p>if  coinmitted the offences under Sections 448 8: 376 of<\/p>\n<p>; .p.c.\n<\/p>\n<p>as\n<\/p>\n<p>21. As to the sentence imposed on the accused\u00bb<\/p>\n<p>appellant, the learned counsel for the appe11ant~accuse_d<br \/>\nhas produced in this appeal the affidavit of the accused-<\/p>\n<p>appellantd The presence of the accused&#8211;appel]ant_:&#8217;can1e<\/p>\n<p>to be secured on dated 05.08.2009 by_.issuing.. __%t,i&#8221;+T)._.C_;1&#8217;j,\u00a7<\/p>\n<p>warrant against him. On thattlate, _th&#8221;e&#8221; . <\/p>\n<p>was sworn to by the accused&#8221;-:,as;&#8217;_&#8217;to&#8217;i&#8217;the <\/p>\n<p>other conditions of his  to&#8221;  are<\/p>\n<p>mitigating circumst.ances__.in:&#8221;vreducing&#8217;-the_:3period of _<\/p>\n<p>imprisonment imposledsubstance of the<\/p>\n<p> the  affidavit is as under:\n<\/p>\n<p>&#8212; &#8212;  in the said case by the P.S.I.\n<\/p>\n<p>ofee1:hengedy&#8217;\u00ab;\u00a7e1:ee Station on 22.12.2005 i.e.,<\/p>\n<p>it on the verysecond day of the incident, and since<br \/>\nhe has been in custody. Thus, he has<br \/>\n  about three years and seven and<br \/>\nhail&#8217;1..V_n&#8217;ionths in jail. He has two sons aged about<\/p>\n<p>i ,.  years and two years and his wife is aged about<br \/>\n&#8217;22 years as on this date. Himself and his wife are<br \/>\niiliterates and he was doing coolie work. His<br \/>\nfamily does not own any property, such as<\/p>\n<p>agricultural land, for the livelihood of his family<\/p>\n<p>&#8216;,_,\\g*~x.-..,&#8230;..\n<\/p>\n<p>:9<br \/>\nmembers. His father died three months before his<\/p>\n<p>birth. Though he has three elder brothers and one<br \/>\nelder sister, they are also Very poor and they<br \/>\nthemselves have their respective large families and<br \/>\nas such, they are not in a position topfrlprroyide<\/p>\n<p>anything to his family. His aged mot1\u00a7;.er,&#8217;<\/p>\n<p>living with him, as he is her last son}.__Byj:reason_,&#8217;of&#8221; <\/p>\n<p>his absence in the fam..iiy,-.,theremhaVs been  <\/p>\n<p>person to look after them.\n<\/p>\n<p>stigma attached to him by realson o,f&#8221;his.:con\\:}ictiori ;<\/p>\n<p>for the offence of rapvegihis neighbcursfhaye been<br \/>\nlooking downthe me1nbers\u00bb&#8230;pf his&#8221;~fa&#8217;rr1ily. His<br \/>\nbehaviour in the;}&#8217;ai1_,_f,ejver&#8217;.sinc&#8217;e_Vthe date of his<\/p>\n<p>,..arre_sti.an&#8217;d; Vde&#8217;ten.tion been good enough. In<\/p>\n<p>case visv-relea&#8217;sed._fI&#8217;o&#8217;m jail by reducing the period<\/p>\n<p>of,_sentence\u00ab~.,&#8217;impo_sed on him, he shall become a<\/p>\n<p> good&#8217;   also a dutiful father, husband<\/p>\n<p> ,_and_ son.&#8217; &#8216; &#8216;~&#8211;s&#8211;n&#8217;tinuation of his imprisonment would<\/p>\n<p>.&#8217;2.&#8221;Z&#8217;.f<\/p>\n<p>..vin hardship to his entire family.<\/p>\n<p>&#8216;jaliove facts stated by the appellant-accused in<\/p>\n<p>his af\ufb01davit sworn to on 05.08.2009, which have<\/p>\n<p> .,rerifs.ained undisputed, constitute special and adequate<\/p>\n<p>Ereasons for reducing the period of imprisonment<\/p>\n<p>imposed on him by the T rial Court. Therefore, i am of<\/p>\n<p>e:&#8217;-.&#8211;5uK&#8221;&#8221;\\r~\\_,_..\u00bb.\n<\/p>\n<p><span class=\"hidden_text\">20<\/span><br \/>\nthe considered View that the ends of justice would be<\/p>\n<p>met with if the period of rigorous imprisonment imposed<br \/>\non the appe11ant&#8211;accused for the offence under Section<\/p>\n<p>376 of I.P.C. is reduced from seven years to fonrjrears.<\/p>\n<p>However, the sentence of fine of <\/p>\n<p>the defauft sentence imposed onmhim fo_r&#8221;the::jsai&#8217;d offence&#8217; , <\/p>\n<p>do not deserve to be reduced._to::&#8221;anyfczitentg&#8221;&#8216;\u00e9\u00a7iid&#8221;*:i;11e<\/p>\n<p>sentence imposed on him&#8217;for_ theAoffence&#8221;..nnder&#8221;S~ection.S&#8217;<\/p>\n<p>448 of I.P.C. also does not  \u00bbvfo1wg1ny. idnterference.<\/p>\n<p>23. In View of my foregoir\ufb01gAidiscnsgsions, I proceed to<\/p>\n<p>passcjfthe   _ _<br \/>\n &#8216; &#8216; S &#8216;V<br \/>\nThe-.p1&#8217;esen_._t  filed by the accused in Special<\/p>\n<p>\/2o&#8217;os.._en the file of the learned 11 Additional<\/p>\n<p>  D.K., Mangalore, is hereby aifowed in<\/p>\n<p>if &#8216;A con\ufb01rming the impugned judgment and<\/p>\n<p>orderof conviction convicting the accused&#8211;appe11ant for<\/p>\n<p>  offences under Sections 448 8: 376 of I.P.C., the<\/p>\n<p>__sentence of rigorous imprisonment imposed on him for<\/p>\n<p>the offence under Section 376 of I.P.C. is hereby<\/p>\n<p>,\u00a2-.__S.&#8221;&#8221;\u00b0&#8221;&#8221;&#8216;\\..\u00bb-~..\u00bb<\/p>\n<p>reduced from seven years to four years and the sentence<br \/>\nof fine of Rs.25,000\/&#8211; and also the default sentence<\/p>\n<p>imposed on him for the said offence aI1(i_.&#8221;~a:_1:?~.o&#8217;~\u00bb.vthe<\/p>\n<p>sentence for the offence under Section 448:-.o&#8217;f<\/p>\n<p>left undisturbed.
