Case No. 26\/2008,<\/p>\n<p>                    pending in the court of Chief Judicial Magistrate,<\/p>\n<p>                    Sitamarhi, is one of the named accused in this case<\/p>\n<p>                    instituted on the basis of complaint case no. 1758\/2007,<\/p>\n<p>                    being a panchayat secretary, with allegation of<\/p>\n<p>                    committing some irregularity in distribution of flood<\/p>\n<p>                    relief to the beneficiaries.\n<\/p>\n<p>                               Submission is that during distribution of<\/p>\n<p>                    flood relief, if any, benefit was granted to other persons<\/p>\n<p>                    it may be at the instance of local Mukhiya (Non-<\/p>\n<p>                    petitioner) who acted as identifier of the persons.<\/p>\n<p>                               Considering the facts and circumstances of<\/p>\n<p>                    the case, in the event of his arrest or surrender within a<\/p>\n<p>                    period of four weeks, let the above-named petitioner be<\/p>\n<p>                    enlarged on bail on furnishing bail bond of sum of Rs.<br \/>\n           10,000\/- (ten thousand only) with two sureties of the<\/p>\n<p>          like amount each to the satisfaction of Chief Judicial<\/p>\n<p>          Magistrate, Sitamarhi, in connection with Parihar P.S.<\/p>\n<p>          Case No. 26\/2008, subject to condition under section<\/p>\n<p>          438(2) of the Code of Criminal Procedure, and<\/p>\n<p>          additional condition to attend the court regularly at<\/p>\n<p>          least for three   years or till disposal of the case,<\/p>\n<p>          whichever is earlier and in the event of failure on two<\/p>\n<p>          consecutive dates, without any reasonable explanation,<\/p>\n<p>          the privilege granted shall be deemed to be cancelled.<\/p>\n<pre>Rajeev\/                       ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sita Ram Paswan vs The State Of Bihar on 12 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.21645 of 2011 Sita Ram Paswan Versus The State Of Bihar ***** 03. 12.09.2011 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
