JAGANNADHA RAO, J.\n<\/p>\n<p>     This Civil\t Appeal has  been  preferred  by  the  Patna<br \/>\nUniversity and\tthe Vice-Chancellor  of the  said University<br \/>\nagainst the judgment of the Patna High Court dated 24.4.1992<br \/>\nin CWJC No. 6824 of 1991 allowing Writ Petition filed by the<br \/>\nrespondent and directing implementation of two orders of the<br \/>\nChancellor  of\t the  University.   The\t first\torder  dated<br \/>\n18.9.1990 of the Chancellor directed the Patna University to<br \/>\nregularise the\tservices of  the respondent  Writ Petitioner<br \/>\n&#8220;on compassionate  grounds&#8221; while the second dated 22.6.1991<br \/>\ndirected implementation\t of the\t direction contained  in the<br \/>\nearlier letter of the Chancellor dated 18.9.1990.\n<\/p>\n<p>     The facts of the case are as follows:\n<\/p>\n<p>     The respondent  holds a  degree of B.Sc. (Home Science)<br \/>\nwith  specialisation   in  Foods   an  Nutrition   from\t the<br \/>\nUniversity of  Udaipur and  also an  M.A.. in Sociology from<br \/>\nPatna university.  (Later she  also obtained a Ph.D from the<br \/>\nsame university).  In 1981, Patna Women&#8217;s College opened the<br \/>\nDepartment of  Home Science.   initially, the respondent was<br \/>\nworking in Siddharth Mahila College.  As per the statutes of<br \/>\nthe university\tin force at that time, the qualification for<br \/>\nappointment as\tLecturer was  P.G. degree in Home Science or<br \/>\nin an  &#8220;allied subject&#8221;.   Respondent  resigned her  job and<br \/>\napplied to  the Patna  Women&#8217;s College\tas she\thad  a\tP.G.<br \/>\ndegree\tin   an\t &#8220;allied  subject&#8221;,  vis.  Sociology.\t The<br \/>\nrespondent was\tappointed on  1.10.1982 on an &#8220;as-hoc&#8221; basis<br \/>\nto take\t up the\t P.G. Home Science Classes and the Principal<br \/>\nby letter  No. 5\\1983  dated 13.1.1983\trequested the  Vice-<br \/>\nChancellor to permit the respondent to &#8220;engage&#8221; P.G. classes<br \/>\non an  adhoc basis  and be  paid per  lecture.\t  The  Vice-<br \/>\nChancellor, by\tletter No.  47 dated 25.1.1983 gave approval<br \/>\nand on\tthat basis, the Education Department of the Govt. of<br \/>\nBihar wrote  to\t the  Patna  University\t on  24.2.1983\tthat<br \/>\nGovernor has accorded sanction for two posts of lecturers on<br \/>\nadhoc  and   purely  temporary\t basis\tand  for  paying  an<br \/>\nhonorarium of  Rs.25\/- per  lecture subject  to a maximum of<br \/>\nRs. 1250\/- p.m. The letter also stated:\n<\/p>\n<blockquote><p>     &#8220;please take  necessary  steps  for<br \/>\n     regular appointment  against  these<br \/>\n     posts   immediately   because   the<br \/>\n     aforesaid\tarrangement   has   been<br \/>\n     approved only  on purely  temporary<br \/>\n     basis.&#8221;<\/p><\/blockquote>\n<p>     On 26.2.1983,  the University informed the principal of<br \/>\nthe Patna  Women&#8217;s College  that the respondent was &#8220;allowed<br \/>\nfor engaging  P.G. classes&#8221;  on Rs. 25\/- per lecture subject<br \/>\nto a maximum of Rs. 1250\/- It was also stated;\n<\/p>\n<blockquote><p>     &#8220;This   is\t  purely   on\tad   hoc<br \/>\n     arrangement    till    a\t regular<br \/>\n     appointment is  made in  accordance<br \/>\n     with the provisions of law&#8221;.<\/p><\/blockquote>\n<p>     It is  not in  dispute that thereafter, statutes passed<br \/>\nby the\tUniversity in  1983 (see para 9 of the Counter filed<br \/>\nin the High Court) prescribed post-graduate qualification in<br \/>\nHome  Science\t(at  least   II\t class\t as  the   requisite<br \/>\nqualification for  appointment as  lecturer in Home Science.<br \/>\nunfortunately,\tthe  respondent\t did  not  possess  a  post-<br \/>\ngraduate degree\t in Home  Science.   Possession of  the Post<br \/>\nGraduate degree in Sociology, as an &#8216;allied subject&#8217; did not<br \/>\nsuffice.\n<\/p>\n<p>     It\t appears   that\t the   respondent  represented\t for<br \/>\nregularisation and  her case  was referred to the Chancellor<br \/>\nthrough the  letter dated 10.12.1986 of the Registrar, Patna<br \/>\nUniversity.    But  the\t Chancellor  stated  he\t would\t&#8220;not<br \/>\ninterfere&#8221; in the matter.  This was conveyed by the Governor<br \/>\nto the\tregistrar by  letter PU-53\/96  dated 20.12.1996 with<br \/>\ncopy to the respondent.\n<\/p>\n<p>     Meanwhile, the  respondent filed CWJC 5664\/1986 and the<br \/>\nsame was disposed of on 28.2.1987 by a Division Bench of the<br \/>\nHigh Court  stating  that  the\trespondent  could  avail  of<br \/>\nalternative remedies available to her.\n<\/p>\n<p>     After  the\t  communication\t of  the  rejection  of\t the<br \/>\nrepresentation\tof  the\t respondent  by\t the  Chancellor  as<br \/>\ncommunicated by\t the Govt.  through letter dated 20.12.1986,<br \/>\nthe respondent filed a fresh Writ petition CWJC 758\/1987 for<br \/>\nregularisation and  the same was dismissed on 2\/10.3.1987 by<br \/>\na Division Bench, stating as follows:\n<\/p>\n<blockquote><p>     &#8220;Heard,  learned  counsel\tfor  the<br \/>\n     writ  petitioner  as  well\t as  the<br \/>\n     learned  Advocate\tGeneral.    This<br \/>\n     Writ application  is  dismissed  in<br \/>\n     limine.&#8221;<\/p><\/blockquote>\n<p>     The matter\t was again  pursued by\tthe respondent.\t The<br \/>\nPrincipal of  the College  wrote a  long letter to the Vice-<br \/>\nChancellor on  29.4.1988 stating  that\tthe  respondent\t was<br \/>\nworking continuously  from 1.10.1982  taking classes for the<br \/>\nP.G. students  on posts\t sanctioned  on\t 24.2.1982,  that  a<br \/>\nCommittee consisting of Dr. S.P. Singh, Pro Vice-Chancellor,<br \/>\nthe Registrar the Department of Home Science opined that the<br \/>\nrespondent &#8220;fulfilled the statutory qualifications laid down<br \/>\nby the\tUGC and\t the State Government&#8221;, for appointment as a<br \/>\nlecturer;  and\tthat  she  had\tearlier\t resigned  from\t the<br \/>\nSiddharth Mahila College and joined in this College in 1982.<br \/>\nIt  was\t  stated  that\t the  essential\t qualifications\t for<br \/>\nappointment as\ta Lecturer  were changed  &#8220;in 1985&#8221; and that<br \/>\nthe Chancellor\tmay be\trequested by  the Government to give<br \/>\nhis concurrence\t for the  appointment &#8220;as  per old  statutes<br \/>\nprevalent at the time of her appointment&#8221;.\n<\/p>\n<p>     It\t appears   also\t that  by  a  further  letter  dated<br \/>\n16.6.1988, the\tUniversity again recommended her case to the<br \/>\nChancellor.   On 18.9.199,  the Secretary  to the Chancellor<br \/>\ncommunicated the  order favourably  issued by the Chancellor<br \/>\nin favour of the respondent.  The said order reads:\n<\/p>\n<blockquote><p>     &#8220;It  is   a  fit\tcase  where  the<br \/>\n     services of  Mrs. Tiwari  should be<br \/>\n     regularised    on\t   compassionate<br \/>\n     grounds &#8211;\torder may accordingly be<br \/>\n     issued.&#8221;<\/p><\/blockquote>\n<p>     On 4.9.1991, the University requested the Chancellor to<br \/>\nlet them know &#8220;as to under which statute the services of the<br \/>\npetitioner could  be regularised.&#8221;  (vide  para\t 11  of\t the<br \/>\ncounter affidavit  in  the  High  Court).    The  Chancellor<br \/>\nhowever,  informed   by\t letter\t dated\t22.6.1991  that\t the<br \/>\nregularisation may  be made as suggested in the University&#8217;s<br \/>\nletter dated  16.6.1988.   Thereafter, it  appears that\t the<br \/>\nUniversity requested  the Chancellor  to review\t his earlier<br \/>\norders.\n<\/p>\n<p>     When the  question of  regularisation was at the stage,<br \/>\nthe  respondent\t  filed\t the   present\twrit   petition\t for<br \/>\nimplementation\tof  the\t letters  of  the  Chancellor  dated<br \/>\n18.9.1990  and\t 22.6.1991  and\t  sough\t a   direction\t for<br \/>\nregularisation.\t  A Division Bench of the High Court allowed<br \/>\nthe writ  petition by  judgment dated 24.4.1992 and directed<br \/>\nregularisation as per the orders of the Chancellor.  Against<br \/>\nthe said  judgment, the\t University and vice-Chancellor have<br \/>\npreferred this appeal.\n<\/p>\n<p>     We have  heard the\t submissions of\t the learned counsel<br \/>\nfor the\t University and also of the Government of Bihar.  We<br \/>\nhave also  heard the  submissions of the learned counsel for<br \/>\nthe respondent writ petitioner.\n<\/p>\n<p>     The   point   for\t consideration\t is:   whether\t the<br \/>\nrespondent&#8217;s services  as Lecturer  in home Science could be<br \/>\ndirected to  be regularised  on the  basis of the letters of<br \/>\nthe Chancellor dated 18.9.1990 and 22.6.1991 and whether the<br \/>\nChancellor&#8217;s  directions   could  be   brought\twithin\t the<br \/>\nprovisions of the Bihar State Universities Act 1976 or other<br \/>\nstatutes of the Patna University?\n<\/p>\n<p>     It is true that when the respondent was &#8220;engaged&#8217; on an<br \/>\n&#8220;ad hoc&#8221;  basis to take up the post-graduate classes in Home<br \/>\nScience, the respondent perhaps satisfied the requirement of<br \/>\nthe &#8216;statute&#8217;  in force\t at that time inasmuch as she was an<br \/>\nM.A. in\t Sociology apart  from having a bachelor&#8217;s degree in<br \/>\nHome Science.\tIt is also true that the respondent resigned<br \/>\nher job\t in the\t Siddharth  College  and  joined  the  Patna<br \/>\nWomen&#8217;s College\t on the basis of the statutes then in force.<br \/>\nBut the\t fact remains  that  the  approval  granted  by\t the<br \/>\nUniversity on  24.2.1983 was  for adhoc appointment only and<br \/>\nthe orders  of the  Registrar dated 26.2.1983 also described<br \/>\nher appointment as purely &#8220;ad hoc&#8221; till regular appointments<br \/>\nwere to be made.\n<\/p>\n<p>     It may  however be\t noticed that as per the requirement<br \/>\nof the\trelevant provision  of the  Bihar State Universities<br \/>\nAct, 1976  namely, Section  56 read  with the  statutes, the<br \/>\npost had  to be\t filled by  and upon  recommendation of\t the<br \/>\nBihar Public  Services Commission.   Later,  Commission\t for<br \/>\nconstituent colleges  was separately  established.  Inasmuch<br \/>\nas the\trespondent was\tnot recruited  by following the said<br \/>\nprocedure, it  was  not\t possible  to  give  her  a  regular<br \/>\nappointment to\tthe post  of Lecturer.\t  In  addition,\t the<br \/>\nstatutes of  the University  which were\t passed after  1981,<br \/>\nprovided that  the essential  qualification  would  be\tP.G.<br \/>\ndegree in  the subject\tconcerned, i.e.\t Home Science.\t The<br \/>\nrespondent was to having a P.G. degree in Home Science.\n<\/p>\n<p>     No\t doubt\t a  statute   was  made\t on  16.11.1978\t for<br \/>\nregularisation of certain teachers appointed before 1977 and<br \/>\nanother statute\t was issued  [letter No., 6 240 G.S. (1)] on<br \/>\n18.11.1980 for regularisation of teachers&#8217; who had completed<br \/>\n24 months  by 31.2.1980 and para 8 of that statute clarified<br \/>\nthat those  purely appointed on temporary basis and who were<br \/>\non their  pots on  19.11.1977 could  be regularised. But the<br \/>\nrespondent did\tnot come  under this  category\tbecause\t her<br \/>\nappointment was\t on 1.10.1982.\t Non can she come within the<br \/>\nscope of a latter statute dated 29.1.1986 (B.S.U.-25\/85-283-<br \/>\nG.S.(1), which\tpermitted regularisation  of those appointed<br \/>\non  a  temporary  basis\t on  or\t before\t 28.2.1982  and\t who<br \/>\npossessed at  least a  second class  Master&#8217;s Degree  in the<br \/>\nsubject.  These statutes did not, take within their sweep, a<br \/>\nperson like the respondent who was appointed on 1.10.1982.\n<\/p>\n<p>     Learned counsel  for the  respondent submitted that the<br \/>\nChancellor&#8217;s orders  could be  brought within  S.74  of\t the<br \/>\nBihar State  Universities, 1976\t which provides for &#8216;Removal<br \/>\nof difficulties&#8217;.  That section reads as follows:-\n<\/p>\n<blockquote><p>     &#8220;S.74 &#8211;  Removal of difficulties by<br \/>\n     the Chancellor  at the commencement<br \/>\n     of\t this  Act:  If\t any  difficulty<br \/>\n     arises in\trespect of establishment<br \/>\n     of the  University, or in the first<br \/>\n     implementation of the provisions of<br \/>\n     this Act  or Statutes  or otherwise<br \/>\n     the Chancellor  may, cut  any time,<br \/>\n     before the\t Constitution of all the<br \/>\n     authorities of the Universities, by<br \/>\n     order consistent with the provision<br \/>\n     of this Act and Statutes, as far as<br \/>\n     possible, make  any appointment  or<br \/>\n     perform any  other function,  which<br \/>\n     seems necessary  or proper\t for him<br \/>\n     for  the\tremoval\t of   the   said<br \/>\n     difficulty;  and  all  such  orders<br \/>\n     shall  take   effect  in  the  same<br \/>\n     manner as\tby the\tsaid appointment<br \/>\n     or function  has been  done in  the<br \/>\n     manner provided in the Act.&#8221;<br \/>\n     Provided that  before issuing  such<br \/>\n     an\t order,\t  the  Chancellor  shall<br \/>\n     elicit the\t opinion  of  the  Vice-<\/p><\/blockquote>\n<blockquote><p>     Chancellor and  of such appropriate<br \/>\n     authority of the University, as may<br \/>\n     have  been\t  constituted,\ton   the<br \/>\n     proposed\t  order\t    and\t    give<br \/>\n     considerations thereon.&#8221;<\/p><\/blockquote>\n<p>     We are  unable to\tsee how\t S.74 can  help.   The\tsaid<br \/>\nprovision deals\t with a situation before the constitution of<br \/>\nthe authorities\t of the\t Universities  and  apart  from\t the<br \/>\nlimited scope  of its  application,  consultation  with\t the<br \/>\nVice-Chancellor was  also necessary.   The present case does<br \/>\nnot fall  within the  limited scope of S.74 nor is there any<br \/>\nfinding that the Chancellor was feeling it necessary to pass<br \/>\nsuch an\t order under  S.74.  In any event, orders under S.74<br \/>\nmust be\t consistent with  the  provisions  of  the  Act\t and<br \/>\nstatutes, as  is expressly  provided in that section.  Hence<br \/>\nS. 74 is of no avail.\n<\/p>\n<p>     Reliance is  also placed  for the\trespondent  on\tsub-<br \/>\nclauses 7(ii)  of S.9  of the  Bihar Universities Act, 1976.<br \/>\nThat provision reads as follows;\n<\/p>\n<blockquote><p>     &#8220;S. 9  (i) that  Chancellor  :  The<br \/>\n     Governor  of  Bihar  shall\t be  the<br \/>\n     Chancellor<br \/>\n     &#8230;&#8230;&#8230;&#8230;&#8230;7(i)(&#8230;&#8230;&#8230;..(ii)<br \/>\n     The Chancellor shall have the power<br \/>\n     for   issue   directions\tto   the<br \/>\n     Universities in  the administrative<br \/>\n     or\t  academic   interest\tof   the<br \/>\n     Universities which the considers to<br \/>\n     be\t necessary.\tThe   directions<br \/>\n     issued  by\t  Chancellor  shall   be<br \/>\n     implemented by the Vice-Chancellor,<br \/>\n     Syndicate, senate\tand other bodies<br \/>\n     of the  University as  the case may<br \/>\n     be.<\/p><\/blockquote>\n<p>     We are  of the  view that\tthe case  of the  respondent<br \/>\ncannot be  brought with sub-clause 7 (ii) of S. 9 of the Act<br \/>\neither.\t    The\t orders\t  in  question\tare  not  passed  in<br \/>\nadministrative exigencies  or in  academic  interest.\t The<br \/>\norders of  the\tChancellor  dated  18.9.1990  and  22.6.1991<br \/>\ndirected that the respondent&#8217;s services as to be regularised<br \/>\npurely on  &#8216;compassionate grounds&#8217;.   In  fact, in  the same<br \/>\nsection 9, sub-clause (4) says that the Chancellor may annul<br \/>\nany proceeding\tor order  of the  University which is not in<br \/>\nconformity  with   the\tAct,  the  statutes,  Ordinances  or<br \/>\nRegulations.   In that\tsetting, it  is not possible to hold<br \/>\nthat  sub-clause   7(ii)  of  Section  9  would\t permit\t the<br \/>\nChancellor to  pass  an\t order\t&#8220;in  the  administrative  or<br \/>\nacademic interest&#8221;  if the  order is  to be in conflict with<br \/>\nthe Act\t or Statutes.\tNo provision has been brought to our<br \/>\nnotice which permits the Chancellor to direct regularisation<br \/>\nof the services of a Lecturer on &#8216;compassionate grounds&#8217;. In<br \/>\nthe present  case the  respondent was  appointed on  ad\t hoc<br \/>\nbasis till  regular appointments were to be made and regular<br \/>\nappointments required  a qualification\twhich the respondent<br \/>\ndid not\t possess and  further, regular appointment could not<br \/>\nbe  made   except  by\tconsulting  the\t  relevant  services<br \/>\nCommission.\n<\/p>\n<p>     The result is no doubt unfortunate but we are unable to<br \/>\nfind any  provision to\tsustain the orders of the Chancellor<br \/>\ndated  18.9.1990   and\t22.6.1991.    The  High\t Court\twas,<br \/>\ntherefore, not correct in directing the enforcement of these<br \/>\norders.\t  We accordingly  allow the  appeal, set  aside\t the<br \/>\njudgment of  the High  court and  dismiss the writ petition.<br \/>\nOrders passed  by the  University consequent to the judgment<br \/>\nof the\tHigh Court are also are also set aside.\t There shall<br \/>\nbe no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Patna University &amp; Anr vs Dr. (Mrs.) Amita Tiwari on 27 August, 1997 Author: M J Rao Bench: Sujata V.
