RAMKUMAR, J.\n             --------------------------------------------------\n               Bail Application No.8649 of 2010\n            ----------------------------------------------------\n           Dated this the 11th day of January, 2011\n\n                                 ORDER\n<\/pre>\n<p>        The petitioner, who is the sole accused in Crime<\/p>\n<p>No.264 of 2005 of Peringom Police Station for an offence<\/p>\n<p>punishable under Section 409 I.P.C. and whose case is now<\/p>\n<p>pending before the Judicial Magistrate of the First Class,<\/p>\n<p>Payyannur as C.C.No.385 of 2007 and LPC.107 of 2009, seeks<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>      2.   Consequent on the non-appearance of the petitioner<\/p>\n<p>before Judicial Magistrate of the First Class, Payyannur, non-<\/p>\n<p>bailable warrants of arrest are pending against the petitioner.<\/p>\n<p>Anticipatory bail cannot be granted to nullify the process issued<\/p>\n<p>by a court of competent jurisdiction. But at the same time, I am<\/p>\n<p>inclined to permit the petitioner to surrender before the court<\/p>\n<p>below and seek bail by filing an application for regular bail.<\/p>\n<p>Accordingly, if the petitioner surrenders before the court below<\/p>\n<p>within two weeks from today and files an application for regular<\/p>\n<p>bail, the court below shall, preferably on the same date on which<\/p>\n<p>the application is filed, release the petitioner on bail on the<\/p>\n<p>petitioner executing a bond for `15,000\/- (Rupees fifteen<\/p>\n<p>Bail Appln.No.8649\/2010<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>thousand only) with two solvent sureties each for the like<\/p>\n<p>amount to the satisfaction of the court below, and subject to the<\/p>\n<p>following conditions:-\n<\/p>\n<blockquote><p>      1.     The petitioner shall report before the Chief<\/p>\n<p>             Ministerial   Officer  of  the  court    below,<\/p>\n<p>             between 10 a.m. and 12 noon on all<\/p>\n<p>             Wednesdays.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>      2.    The petitioner shall appear before the court<\/p>\n<p>             below on all the dates of posting of the above<\/p>\n<p>             case.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>      3.    The petitioner shall not influence or intimidate<\/p>\n<p>             the prosecution witnesses nor shall he attempt<\/p>\n<p>             to   tamper    with   the  evidence   for   the<\/p>\n<p>             prosecution.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>      4.    The petitioner shall not commit any offence<\/p>\n<p>             while on bail.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>      5.
