Respondents\n\n        Petition under Article 226  of  the  Constitution  of  India  for  the\nissuance  of  a  Writ of Habeas Corpus to call for the records relating to the\ndetention order dt.28.4.2006 passed by the  first  respondent  herein  in  his\noffice  ref.D.O.No.29\/2006.C2  quash  the  same  and direct the respondents to\nproduce the petitioner's husband  Anandan,  son  of  Ramalingam,  Se.Andapattu\nvillage, Chengam taluk, Tiruvannamalai district presently undergoing detention\nin the Central Prison, Vellore under Section 3(1) of the Tamil Nadu Prevention\nof  Dangerous  Activities  of  Bootleggers,  Drug Offenders, Forest Offenders,\nGoondas, Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act before\nthis Hon'ble Court and set the detenu at liberty.\n\n!For Petitioner         :  Mr.P.Mani\n^For Respondents        :  Mr.Babu Muthu Meeran\n                        Addl.  Public Prosecutor\n\n:ORDER  \n<\/pre>\n<p>                (Order of the Court was made by P.Sathasivam, J.)<br \/>\n        The petitioner, who is the wife of the detenu by name Anandan, who was<br \/>\ndetained as a &#8221;Bootlegger&#8221; as contemplated under the Tamil Nadu Prevention of<br \/>\nDangerous  Activities  of  Bootleggers,  Drug  Offenders,  Forest   Offenders,<br \/>\nGoondas,  Immoral Traffic Offenders, Slum Grabbers and Video Pirates Act, 1982<br \/>\n(Tamil Nadu Act 14 of 1982), by the impugned detention order dated  28.4.2006,<br \/>\nchallenges the same in this Petition.\n<\/p>\n<p>        2.   Heard  learned  counsel  for  the  petitioner  as well as learned<br \/>\nAdditional Public Prosecutor for the respondents.\n<\/p>\n<p>        3.  At the foremost, learned counsel for the petitioner by drawing our<br \/>\nattention to the fact that at  the  time  of  arrest,  though  the  sponsoring<br \/>\nauthority  has  registered  a case under Section 4(1)(i) and 4(1-A)(ii) of the<br \/>\nTamil Nadu Prohibition Act (hereinafter referred to as the Act) and only later<br \/>\nthe same was altered as 4(1)(i), 4(1)(aaa) read with 4(1-A)(ii)  of  the  Act.<br \/>\nIt  is not clear how the authority mentioned even the altered provision in the<br \/>\nMahazar which was prepared at 13.00 hrs.  on 9.4.2006.    In  the  absence  of<br \/>\nproper  explanation,  according to the learned counsel for the petitioner, the<br \/>\ndetention order is liable to be quashed.\n<\/p>\n<p>        4.  In the light of the  said  contention,  we  verified  the  details<br \/>\nmentioned  in  the FIR which shows that the occurrence took place at 9.30 a.m.<br \/>\non 9.4.2006 and the information was received by the police at 11 .30 a.m.   on<br \/>\n9.4.2006.  In the First Information Report, the offences mentioned are 4(1)(i)<br \/>\nand 4(1-A)(ii)  of the Act.  As rightly pointed out by the learned counsel for<br \/>\nthe petitioner, only after seizure which took place at 13 hrs.   on  9.4.2006,<br \/>\nthe sponsoring  authority  is  able to know the quantum of illicit arrack.  In<br \/>\nsuch circumstances,  it  is  not  clear  how  the  Mahazar  contained  Section<br \/>\n4(1)(aaa) of  the  Act.    In the absence of proper explanation, we are of the<br \/>\nview that the detaining authority has not applied  his  mind  to  this  aspect<br \/>\nbefore passing  the  detention  order.  On this ground, the detention order is<br \/>\nliable to be quashed.\n<\/p>\n<p>        5.  Accordingly,  the  Habeas  Corpus  Petition  is  allowed  and  the<br \/>\nimpugned order  of  detention is quashed.  The detenu is directed to be set at<br \/>\nliberty forthwith from the custody unless he is required in some other case or<br \/>\ncause.\n<\/p>\n<p>ajr<\/p>\n<p>To<\/p>\n<p>1.
