            The appellant is the claimant in OP<\/p>\n
(MV) No.1252\/2004 on the file of Motor Accidents<\/p>\n
Claims Tribunal, Irinjalakuda.  He sustained a head<\/p>\n
injury involving extradural hemorrhage in a motor<\/p>\n
accident that occurred on February 3, 2004 at<\/p>\n
Karayamparambu.\n<\/p>\n
    2.      The   accident   happened   while   the<\/p>\n
claimant  was  pillion  riding  on  a  motor  cycle<\/p>\n
bearing registration No. KL8\/U 2804 collided head<\/p>\n
on with a tipper lorry bearing registration No.<\/p>\n
KL7\/AP  9866  owned   and   driven  by   the  first<\/p>\n
respondent.  Alleging   negligence   against  first<\/p>\n
respondent, the claimant filed O.P u\/S. 166 of the<\/p>\n
Motor  Vehicles  Act  before  the  Motor  Accidents<\/p>\n
Claims Tribunal, Irinjalakuda claiming compensation<\/p>\n
from the respondents.\n<\/p>\n

\n                          2<\/span><\/p>\n
    3.      The first respondent, the owner-cum-<\/p>\n
driver  of  the  offending   tipper  lorry  remained<\/p>\n
absent and was set ex-parte by the Tribunal. The 2nd<\/p>\n
respondent, insurer of the offending tipper lorry<\/p>\n
filed a written statement admitting the policy and<\/p>\n
further contended that there was also negligence on<\/p>\n
the part of rider of the motor cycle.<\/p>\n
    4.      This O.P was jointly tried along with<\/p>\n
another O.P filed by the rider of the motor cycle<\/p>\n
and a common award was passed.      On the side of<\/p>\n
claimant Ext.A1 to A10 and Ext.A11 to A15 were<\/p>\n
marked.  On the side of contesting 2nd respondent,<\/p>\n
Ext.B1 was marked before the Tribunal.        On an<\/p>\n
appreciation of evidence, the Tribunal found that<\/p>\n
the accident was occurred due to the negligence on<\/p>\n
the part of first respondent, the owner-cum-driver<\/p>\n
of  the  offending  tipper   lorry  and  awarded  a<\/p>\n
compensation of Rs. 83,700\/-.   The claimant has now<\/p>\n
come  up  in  appeal   challenging the   quantum of<\/p>\n
compensation awarded by the Tribunal.<\/p>\n
    5.      Heard the counsel for the appellant<\/p>\n
and counsel for the 2nd respondent.<\/p>\n

    6.       The accident is not disputed.        The<\/p>\n
finding of the Tribunal that the accident occurred<\/p>\n
due  to  the   negligence    on  the  part  of  first<\/p>\n
respondent, the owner-cum-driver of the offending<\/p>\n
tipper lorry is not challenged in this appeal.<\/p>\n
Therefore,  the   only    question  which arises  for<\/p>\n
consideration is whether the claimant is entitled<\/p>\n
to any enhanced compensation.\n<\/p>\n
    7.       The     Tribunal    awarded   a    total<\/p>\n
compensation of Rs. 83,700\/-.     The break up of the<\/p>\n
compensation awarded is as under:<\/p>\n
        for Medical expenses        : Rs. 58,500
\n        for Treatment expenses      : Rs. 2,200
\n        for Transportation          : Rs. 1,000
\n        for Loss of income          : Rs. 5,000
\n        (Rs.2000 per month
\n        for 2 = months)<\/p>\n
        for Pain and suffering      : Rs. 12,000
\n        for Discomfort and loss     : Rs. 5,000
\n        of amenities\n<\/p><\/blockquote>\n
                                        ———<\/p><\/blockquote>\n
                              Total : Rs. 83,700
\n                                        =========<\/p>\n
    8.       The counsel for the claimant sought<\/p>\n
enhancement   of   the    compensation  for  loss  of<\/p>\n
amenities and enjoyment of life and for pain and<\/p>\n

suffering endured. The Tribunal awarded Rs. 5,000\/-<\/p>\n
for loss of amenities and enjoyment of life which<\/p>\n
appears to be very low.    Taking into account of<\/p>\n
nature  of  injuries  sustained, we  feel  that  a<\/p>\n
compensation of Rs. 10,000\/- would be reasonable on<\/p>\n
this count.  Thus, on this count, the claimant is<\/p>\n
entitled  to  an  additional  compensation of   Rs.<\/p>\n
5,000\/-.\n<\/p>\n
    9.      The Tribunal awarded Rs. 12,000\/- for<\/p>\n
pain and suffering endured by the claimant which<\/p>\n
appears to be inadequate. Taking into consideration<\/p>\n
of nature of injuries sustained, we feel that a<\/p>\n
compensation of Rs.20,000\/-would be reasonable on<\/p>\n
this count. Thus, on this count, the claimant is<\/p>\n
entitled   to   an   additional   compensation  of<\/p>\n
Rs.8000\/-.\n<\/p>\n
    10.     The Tribunal took the monthly income<\/p>\n
of the claimant as Rs. 2000\/- per month for 2 =<\/p>\n
months and awarded a compensation of Rs. 5,000\/-<\/p>\n
towards loss of earnings.  As the claimant is aged<\/p>\n
28 at the time of accident, we feel that his<\/p>\n
monthly income can be reasonably fixed at Rs.<\/p>\n

2,500\/-per month. Thus, on this count, the claimant<\/p>\n
is entitled to a compensation of Rs. 6,250\/-. Thus,<\/p>\n
the  claimant   is   entitled  to   an   additional<\/p>\n
compensation of Rs. 1,250\/- on this count.<\/p>\n
    11.     The    counsel    argued     that   no<\/p>\n
compensation was awarded for disability caused.<\/p>\n
But no document was produced by the claimant to<\/p>\n
show that he suffered any disability on account of<\/p>\n
the injuries he sustained.  Therefore the Tribunal<\/p>\n
is perfectly justified in not awarding compensation<\/p>\n
for disability caused to the claimant.<\/p>\n
    12.     As regards, the compensation awarded<\/p>\n
under  other  heads,  we   find  the  same  to   be<\/p>\n
reasonable and therefore, we are not disturbing the<\/p>\n
same.\n<\/p>\n
    13.     Thus, the claimant is entitled to an<\/p>\n
additional compensation of Rs. 14,250\/-. He is<\/p>\n
entitled to interest at the rate of 7% per annum<\/p>\n
from the date of petition till realization and<\/p>\n
proportionate cost.  The 2nd respondent, being the<\/p>\n
insurer  of  the  offending  tipper   lorry,  shall<\/p>\n
deposit the amount within two months from the date<\/p>\n

of receipt of a copy of this judgment before the<\/p>\n
Tribunal.  The award of the Tribunal is modified to<\/p>\n
the above extent.\n<\/p>\n
        The appeal is disposed of as found above.<\/p>\n
