PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nPATTANAIK, J.\n<\/p>\n<p>     Delay condoned.\n<\/p>\n<p>     Leave granted.\n<\/p>\n<p>     This appeal  by special  leave is\tdirected against the<br \/>\njudgment of  the  Central  Administrative  Tribunal,  Madras<br \/>\nBench dated  19.9.1995 in  OA No.  267\tof  1994.  The\tSaid<br \/>\napplication has\t been filed by the appellant for a direction<br \/>\nto the\trailway administration\tto promote  the appellant as<br \/>\nWelfare Inspector  Grade &#8211;  II with  effect from 2.4.1993 as<br \/>\none post was available in the reserved category.\n<\/p>\n<p>     The brief\tfacts necessary for deciding this appeal are<br \/>\nstated as under :\n<\/p>\n<p>     The appellant was appointed as Assistant Station Master<br \/>\nin the\tscale Rs.  330-560 and was then promoted to a higher<br \/>\npost in\t the scale of Rs. 425-640 with effect from 8.1.1985.<br \/>\nHe was\tfurther promoted as Welfare Inspector grade &#8211; III in<br \/>\nthe scale  of Rs.  1480-2300 and  joined the  said  post  on<br \/>\n27.12.1991. The\t appellant admittedly  belongs to  Scheduled<br \/>\nCaste. The  cadre  of  Welfare\tInspectors  consisted  or  3<br \/>\ncategories: namely: Welfare Inspector Grade &#8211; I in the scale<br \/>\nof Rs.\t2000-32000; Welfare Inspector Grade &#8211; II in scale of<br \/>\nRs. 1600-2660  and Welfare  Inspector Grade-III in the scale<br \/>\nof Rs.\t1400-2300. By  Order dated  27th January,  1993\t the<br \/>\ncadre  strength\t of  the  different  categories\t of  Welfare<br \/>\nInspectors was\trestructured and it was directed that 35% of<br \/>\nposts would  be in  Grade &#8211;  I, 40%  in Grade-II  and 25% in<br \/>\nGrade &#8211;\t III. In  view of  the change  of percentage  of  he<br \/>\ndifferent categories  of posts,\t the  appellant\t expected  a<br \/>\npromotion to  Grade &#8211;  II but the same having not been done,<br \/>\nhe filed the application before the Tribunal. It was averred<br \/>\nin the\tapplication filed  before the  Tribunal\t that  three<br \/>\nposts from  Grade-III having  been upgraded  to grade  &#8211; II,<br \/>\ntotal number of posts available in Grade-II is 26 as against<br \/>\nthe  original number of 23 and since there is reservation of<br \/>\n15% for Scheduled Caste, the total number of posts available<br \/>\nfor the\t Scheduled Caste  in Grade  &#8211; II would work out at 4<br \/>\nbut factually  only 3  persons belonging  to  the  Scheduled<br \/>\nCaste  are  working  in\t Grade\t&#8211;  II,\tand  therefore,\t the<br \/>\nappellant was  entitled to  promotion to  Grade\t &#8211;  II.\t The<br \/>\nrespondent  in\t the   counter-affidavit   filed,   however,<br \/>\ncontended that\tthere has  been no change in the strength of<br \/>\nthe post  in grade  &#8211; II which remained at 23 but for sports<br \/>\npersonnel some posts were upgraded from grade-III to grade &#8211;<br \/>\nII and those upgraded posts cannot be taken into account for<br \/>\ndetermining the\t number\t of  posts  available  for  reserved<br \/>\ncategory as  such upgradation was temporary in nature and is<br \/>\nnot a  permanent  addition  to\tthe  number  of\t posts,\t and<br \/>\ntherefore, can&#8217;t  be taken  into account for computation 15%<br \/>\nreservation in\tthe said  Grade &#8211;  II. The  Tribunal by\t the<br \/>\nimpugned judgment  accepted the\t contention  raised  by\t the<br \/>\nrespondent and\tcame to\t hold that the posts which have been<br \/>\nupgraded having\t been borrowed\tfrom grade  &#8211; III  and being<br \/>\nspecially meant\t for sports  personnel cannot be counted for<br \/>\ndetermining the\t 15%  reserved\tquota  meant  for  Scheduled<br \/>\nCaste, and therefore, the cadre strength of Grade &#8211; II being<br \/>\n23 only 3 persons from the Scheduled Caste would be promoted<br \/>\nto the Grade &#8211; II and thus three persons having already been<br \/>\nthere the  claim of  the appellant  cannot be  allowed. With<br \/>\nthis  conclusion   the\t Tribunal   having   dismissed\t the<br \/>\napplication filed  by the  appellant, the present appeal has<br \/>\nbeen preferred.\n<\/p>\n<p>     The question  that arises for consideration, therefore,<br \/>\nis whether  the number\tof upgraded post from Grade &#8211; III to<br \/>\nGrade &#8211;\t II meant  for sports  personnel can  be taken\tinto<br \/>\naccount\t for   determining  the\t number\t of  reserved  posts<br \/>\navailable for  Scheduled Case  in Grade-  II. It is admitted<br \/>\nthat total  number of  posts is grade- II was 23 and 3 posts<br \/>\nfrom Grade  &#8211; III  were upgraded  to that of Grade &#8211; II. The<br \/>\nupgraded posts\twhich were  made as early as in August 1987,<br \/>\nas per Memorandum dated\t 24.08.1987, still continues. It is,<br \/>\ntherefore, not\tpossible for  us to accept the contention of<br \/>\nthe learned  counsel for  the respondent  that\tthe  alleged<br \/>\nupgradation was\t made for  ra  temporary  period  meant\t for<br \/>\nsports personnel.  The post  which were upgraded in the year<br \/>\n1988 having  continued still  dated, the  cadre strength  of<br \/>\nGrade &#8211; II inspectors must be held to have become 26 and not<br \/>\n23 as  contended by  the respondent.  If 15% of the cadre is<br \/>\nmeant for  reserve category people then it would work out at<br \/>\n4 and  admittedly there\t are only 3 persons belonging to the<br \/>\nScheduled Caste\t in Grade  &#8211; II.  In that view of the matter<br \/>\nthe appellant  was entitled  to be  promoted against the 15%<br \/>\nreserved quota\tof posts  i Grade  &#8211; II\t to be\t26.  In\t our<br \/>\nconsidered opinion  Tribunal was in error in not taking into<br \/>\naccount the  upgraded posts  which have\t been upgraded\tfrom<br \/>\ngrade &#8211;\t III to\t Grade &#8211;  II on the ground that it was meant<br \/>\nfor sports  personnel. While  computing the  number of\tpost<br \/>\navailable for  reserved category,  there is no justification<br \/>\nto exclude  the upgrade\t post which  had continued from 1988<br \/>\ntill date.\n<\/p>\n<p>     In the  aforesaid premises the impugned judgment of the<br \/>\nTribunal is  set aside\tand OA\tNo. 267 of 1944 filed in the<br \/>\nCentral Administrative\tTribunal, Madras Stands allowed. The<br \/>\nrespondents are\t directed to  consider the case of promotion<br \/>\nof the\tappellant to  a post in Grade-II, Welfare inspector,<br \/>\nwith effect  from 1993. The appeal is allowed.
