The issue involved in this petition is simiiar to the<br \/>\none raised and considereo by a Division Bench of this Court in<br \/>\nthe case of M. KOKZLA V. THE STATE OF KARNATAKA AND<br \/>\nOTRERS in Writ Appeai No.972 of 2006 disposed of on 2&#8243;&#8216; April,<br \/>\n2009. Whiie dismissing the above writ appeal, the Division<\/p>\n<p>Bench has observed as hereunder:\n<\/p>\n<p>&#8220;S. Patta lands are agricultural lands. In such<br \/>\nlands agricultural operations have to be canried out. As<br \/>\nper Section 2(1) of the Karnataka Land Reforms Act,<br \/>\n1961 &#8220;agriculture&#8221; includes aquaculture; horticulture,<br \/>\nraising of crops, grass or garden produce, dairy farming,<br \/>\npoultry farming, breeding of livestock and grazing. It<br \/>\ndoes not include mining or quarrying. In View of<br \/>\navailability of minor minerals in patta lands, quarrying<br \/>\noperations are being carried on. It amounts to change of<br \/>\nland use \ufb01om agrfculturaf pmpose to nomagrzicuitural<br \/>\npurpose. Since it involves diversion of agricultural iancl to<br \/>\nnon-agricultural puijooso, conversion is noc\ufb01ty under<br \/>\nSection 95(2) of the Act, which ready-\n<\/p>\n<p>&#8220;95(.2) If any occupant of land<br \/>\nassessed or held for the purpose of<br \/>\nagriculture wishes to divert such land or any<br \/>\npart thereof to any other purpose he shall&#8217;<br \/>\nnoiwitiistan-ding anything contained in any<br \/>\nfew for tire time being in force apply for<br \/>\npermission to the Deputy Commissioner who<br \/>\nmay, subject to the provisions of this Section<\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p>and the rates made thereunder this Act,<br \/>\nre\ufb01ise permission or grant it on such<br \/>\nconditions as he may think \ufb01t. &#8220;&#8216;<\/p>\n<p>In View of this speci\ufb01c provision, the Deputy<br \/>\nCommissioner was justified in issuing the endorsements<br \/>\nimpugned in the writ petitions and the learned single<br \/>\nJudge has rightly dismissed the writ petitions holding that<br \/>\nconversion is necessary to use the patta lands for<br \/>\nextracting minor mineral from them. We are in fully<br \/>\nagreement with the View taken by the learned single<br \/>\nJudge and the order passed by him dew not warrant<br \/>\ninterference by tile Court in exercise of this Court&#8217;s<br \/>\nAppellate Junsdiction and power.\n<\/p>\n<p>6. We may also ado&#8217; that for doing agricultural<\/p>\n<p>operations, no conversion, licence or permit is required<br \/>\nwhereas for canying on mining operations to extract<br \/>\nminor mineral, conversion under Section 95 of the Act,<br \/>\nlicence defined under Section 2(l&lt;) and for their<br \/>\ntransportation permit defined under Section 2(a) of<br \/>\nKarnataka Minor Mineral Concession Rules, 1994 are<br \/>\nrequired. Therefore, the appeilant&#8211;writ petitioners cannot<br \/>\ndo mining operations without conversion order, licence<br \/>\nand permit. Consequentiy, the decision in Veeramadinfs<br \/>\ncase has no application and reliance placed on it is mis-<br \/>\nplaced and legal contention urged by the learned Senior<br \/>\nCounsei placing reliance upon the said decision is wholly<br \/>\nuntenabk in law.\n<\/p>\n<p>S<\/p>\n<p>2. Further we are in respectfu! agreement with the<br \/>\nfindings and reasons recorded by the teamed single judge<br \/>\non the contentious points raised in the writ petition, which<br \/>\nare answered against the Appellant in the impugned<br \/>\nJudgment, after refiernng to the to the rivet Iegai<br \/>\ncontentions, provisiens of the KLR Act and decisions of<br \/>\nthe Apex Court and this Cou .&#8221;\n<\/p>\n<p>8. For the reasons stated above, the writ appeal is<br \/>\ndevoid of merit and liable to be dismissed.&#8221;\n<\/p>\n<p>4. We are in respectful agreement with the views<br \/>\nexpressed by the Division Bench of this Court in Writ Appeal<\/p>\n<p>No.972 of 2006 referred to above.
