JOSEPH, JJ.\n                        --------------------------------------\n                          W.A.No.2233 of 2008\n                        -------------------------------------\n                       Dated 19th November, 2008\n\n                                 JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>            Appellants\/petitioners while working as Last Grade Servants<\/p>\n<p>in the Soil Conservation Unit of the Agriculture Department, the Public<\/p>\n<p>Service Commission invited applications for the post of Agricultural<\/p>\n<p>Assistant Grade II in the Agriculture Department by Ext.P1 notification<\/p>\n<p>dated 18.11.2003,.   5% of the total vacancies are made available for the<\/p>\n<p>Last Grade Servants in the Agriculture Department for appointment by<\/p>\n<p>transfer.  Appellants, contending that the Soil Conservation Unit will<\/p>\n<p>come under the Agriculture Department, applied for the above post and<\/p>\n<p>appeared for the written examination. However, even though they were<\/p>\n<p>short-listed, they were informed by the Public Service Commission that<\/p>\n<p>Soil Conservation Unit is not part of the Agriculture Department, it is an<\/p>\n<p>independent department and they are not eligible to be considered for<\/p>\n<p>appointment in the post of Agricultural Assistant Grade II in the<\/p>\n<p>Agriculture Department. The whole question is whether appellants who<\/p>\n<p>are working in the Soil Conservation Unit as Last Grade Servants are<\/p>\n<p>eligible to be appointed as Agricultural Assistant Grade II in the<\/p>\n<p>Agriculture Department in terms of Ext.P1 notification. Government has<\/p>\n<p><span class=\"hidden_text\">W.A.2233\/2008                      2<\/span><\/p>\n<p>created a separate Department for Soil Conservation. Ext.R1 (a) is<\/p>\n<p>the order issued by the Government on 7.12.1963. It is true that the<\/p>\n<p>above department is also working jointly under       the Agriculture<\/p>\n<p>Department, but, it is a separate department. Annexure I produced<\/p>\n<p>by the appellants along with the appeal shows that for Soil<\/p>\n<p>Conservation Unit itself separate promotion avenues are available.<\/p>\n<p>For example, for a similar post of Field Assistant the method of<\/p>\n<p>recruitment mentioned is as follows:\n<\/p>\n<\/p>\n<blockquote><p>         &#8220;a) By appointment by promotion\/transfer of<br \/>\n              persons holding Lower Grade posts in the<br \/>\n              Soil Conservation Department possessing<br \/>\n              required qualification.\n<\/p><\/blockquote>\n<blockquote><p>           b) In their absence, by transfer from persons<br \/>\n              holding   Last   Grade    posts   in other<br \/>\n              Departments.\n<\/p><\/blockquote>\n<blockquote><p>           c) In the absence of suitable hands for<br \/>\n              promotion and transfer under items (a) and\n<\/p><\/blockquote>\n<blockquote><p>              (b) above, by direct recruitment.&#8221;\n<\/p><\/blockquote>\n<p>It shows that Soil Conservation Unit is treated as a separate<\/p>\n<p>department and avenues of promotion are different.    The employees<\/p>\n<p>of that department have got other promotional opportunities. It is an<\/p>\n<p>independent unit of the Agriculture Department and appellants cannot<\/p>\n<p>apply to this post as published in Ananexure I. Even though this unit<\/p>\n<p>is under generic term of the Agriculture Department, it is a separate<\/p>\n<p><span class=\"hidden_text\">W.A.2233\/2008                      3<\/span><\/p>\n<p>unit.  In Soil Conservation Unit separate service conditions are<\/p>\n<p>governed by separate special rules and those employees are not inter-<\/p>\n<p>transferable with the employees of Agriculture Department.        The<\/p>\n<p>learned single Judge has considered each and every contentions of the<\/p>\n<p>appellants and found that the appellants working under the Soil<\/p>\n<p>Conservation Unit are not entitled to be appointed and they cannot<\/p>\n<p>claim for the vacancies advised as per Ext.P1.
