Learned     counsel   appearing    for    the   petitioners   is<br \/>\nchallenging the non-selection of the present petitioners by the<br \/>\nJharkhand Public Service Commission as a Lecturer.                  In<br \/>\npursuance of the public advertisement dated 31st January, 2007,<br \/>\nthe petitioners appeared in the interview\/viva-voce test and,<br \/>\nthereafter, they were evaluated by the Interviewing Committee<br \/>\nand looking to the over all performance of the present<br \/>\npetitioners, the marks were allotted and were arranged in<br \/>\nseriatim. It is submitted by learned counsel for the petitioners<br \/>\nthat fixation of 40% marks for the viva-voce test is an arbitrary<br \/>\naction and, therefore, the selection process of the respondents<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>2.    I have heard learned counsel for the Jharkhand Public<br \/>\nService Commission, who has submitted that in pursuance of<br \/>\nSection 57 (2) (b) of the Jharkhand State Universities Act, 2000,<br \/>\nthe prescribed procedure has been followed by the Jharkhand<br \/>\nPublic Service Commission, which is only the viva-voce test.<br \/>\nInterviewing Committee was appointed by the Jharkhand Public<br \/>\nService Commission and the candidates&#8217; interviews were taken<br \/>\nincluding of the present petitioners. Marks were allotted by the<br \/>\nInterviewing Committee to the present petitioners and other<br \/>\ncandidates and, thereafter, the petitioners were arranged in<br \/>\nseriatim. Looking to the marks of the present petitioners, the<br \/>\npetitioners are not selected for the post of Lecturers and,<br \/>\ntherefore, the petitioners are now challenging the allotment of<br \/>\n40% marks for the viva-voce test and 60% for educational<br \/>\nqualification.   It is also submitted by learned counsel for the<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>Jharkhand Public Service Commission that this issue has<br \/>\nalready been decided by this Court vide order dated 20th March,<br \/>\n2009 in W.P. (C) No. 270 of 2008 and it has been held by this<br \/>\nCourt that there is no procedural illegality in fixing 40% marks<br \/>\nfor viva-voce test for the selection of the Lecturers, in pursuance<br \/>\nof public advertisement dated 31st January, 2007. The detailed<br \/>\njudgment has been delivered by this Court referring all the<br \/>\nearlier judgments relevant to the facts of the case and applicable<br \/>\nto the candidates in the aforesaid order and, therefore, the<br \/>\npetitions deserve to be dismissed.\n<\/p>\n<p>3.    Having heard learned counsels for both the sides and<br \/>\nlooking to the facts and circumstances of the case especially<br \/>\nSection 57 (2) (b) of the Jharkhand State Universities Act, 2000<br \/>\nand looking to the public advertisement dated 31st January,<br \/>\n2007 as well as looking to the publication in the daily newspaper<br \/>\non 16th March, 2007 and also looking to the several judgments<br \/>\nreferred in the decision rendered by this Court dated 20th March,<br \/>\n2009 in W.P. (C) No. 270 of 2008, there is no procedural<br \/>\nirregularity or illegality in the selection process of the candidates<br \/>\nfor the post of Lecturers. Allocation of marks for viva-voce test<br \/>\ncan not be labelled as an arbitrary, capricious or malafide<br \/>\nbecause there is no written test held in the present case because<br \/>\nit is not required statutorily under Section 57 of the Act, 2000.<br \/>\nWhen the Lecturers are to be appointed, their educational<br \/>\nqualifications etc. are to be properly appreciated and, therefore,<br \/>\n60% marks are allotted to the educational qualification, and the<br \/>\neducational achievements, but, it may happen that some<br \/>\ncandidates might have studied a part of the syllabus. Likewise<br \/>\npart of a new syllabus might not have studied at all by those<br \/>\ncandidates. Therefore, to check their knowledge about the newly<br \/>\nadded syllabus, 40% of the marks have been allotted to the viva-<br \/>\nvoce test, can not be said to be an arbitrary action, on the<br \/>\ncontrary, there is a valid and convincing logic for fixing 40%<br \/>\nmarks for viva-voce test. Whenever the Jharkhand Public Service<br \/>\nCommission is selecting a candidate, all care ought to have been<br \/>\ntaken by the Commission so that a candidate is having a full<br \/>\nknowledge of the latest syllabus of a particular faculty, may be<br \/>\nselected, otherwise, if 100% are to be allotted for educational<br \/>\nqualification, there are all chances for selection of those<br \/>\ncandidates, who have never studied the new syllabus, but, have<br \/>\nsecured higher marks during their graduation or post graduation<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>        study and they will be selected, but, that is not a correct or<br \/>\n        healthy method of a selection and, therefore, rightly the<br \/>\n        weightage has been given by the Jharkhand Public Service<br \/>\n        Commission to evaluate a candidate from the view point of<br \/>\n        knowledge of latest syllabus.\n<\/p>\n<p>        4.      There is also one more reason for allotment of 40% marks<br \/>\n        for the viva-voce test. A cardinal principle for taking viva-voce<br \/>\n        test is to check the suitability of the candidate for the relevant<br \/>\n        post.     Higher percentage of marks during graduation or post<br \/>\n        graduation sometimes is not helpful for the appointment on the<br \/>\n        post. Academic qualification is not the sole criteria. Whether<br \/>\n        the candidate is promptly giving answer or not, what type of<br \/>\n        behaviour the candidate is having, what is the temperament of<br \/>\n        the candidate, especially when cornered questions are asked,<br \/>\n        tolerance power of the candidate and promptness and presence<br \/>\n        of mind and such other abilities will be checked in viva-voce test<br \/>\n        and, therefore, oral interview and its fixation of marks of 40% in<br \/>\n        the facts of the present case can not be labelled as an arbitrary<br \/>\n        action.\n<\/p>\n<p>        5.      It is vehemently contended by learned counsel for the<br \/>\n        petitioners that the ratio of 40% and 60% is not matching with<br \/>\n        each other.     More marks should have been allotted to the<br \/>\n        educational qualification. This contention is not accepted by this<br \/>\n        Court mainly for the reason that the higher percentage of marks<br \/>\n        in graduation or post graduation, sometimes is not giving the<br \/>\n        ability of teaching because teaching is an art and several other<br \/>\n        factors are to be checked of particular candidate as stated<br \/>\n        hereinabove, teachers have to deal with young students. This is<br \/>\n        the only contention raised in this petition otherwise, several<br \/>\n        contentions have already been raised by other candidates and<br \/>\n        they have dealt with in earlier writ petition bearing W.P. (C) No.<br \/>\n        270 of 2008 and in view of this decision also, there is no<br \/>\n        substance in this petition and, hence, the same is hereby<br \/>\n        dismissed.\n<\/p>\n<p>                                                          (D.N.
