Justice R.BASANT\n\n Dated :01\/01\/2008\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                       B.A.No.8086 of 2007\n                      -------------------------------------\n              Dated this the 1st day of January, 2008\n\n                                  ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioners are accused 1<\/p>\n<p>and 2 in a crime registered for offences punishable, inter alia,<\/p>\n<p>under Sections 324 and 308 I.P.C. Altogether there are 3 accused<\/p>\n<p>persons. The 3rd accused has already been arrested and released<\/p>\n<p>on bail also. The allegation is that on account of prior animosity,<\/p>\n<p>the accused persons, armed with stick and swordS, allegedly<\/p>\n<p>attacked the defacto complainant and caused injuries to the<\/p>\n<p>defacto complainant. Investigation is in progress. The petitioners<\/p>\n<p>apprehend imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioners submits that<\/p>\n<p>the petitioners are innocent. Exaggerated allegations are raised<\/p>\n<p>falsely with the sole intention of vexing and harassing the<\/p>\n<p>petitioners. The inclusion of the offence under Section 308 I.P.C<\/p>\n<p>reveals the vexatious intent of the defacto complainant. In any<\/p>\n<p>view of the matter, the petitioners do not deserve to endure the<\/p>\n<p>trauma of arrest and detention.              The petitioners may now be<\/p>\n<p>granted anticipatory bail, it is prayed.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.8086 of 2007                2<\/span><\/p>\n<p>      3.    The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor has taken me through the nature<\/p>\n<p>of injuries suffered which includes a lacerated injury on the scalp.<\/p>\n<p>The learned Public Prosecutor         submits that there are no<\/p>\n<p>circumstances warranting or justifying the invocation of the<\/p>\n<p>extraordinary equitable discretion under Section 438 Cr.P.C.<\/p>\n<p>      4.    Having considered all the relevant inputs, I find merit<\/p>\n<p>in the opposition by the learned Public Prosecutor. I agree with<\/p>\n<p>the learned Public Prosecutor that this is an eminently fit case<\/p>\n<p>where the petitioners must surrender before the learned<\/p>\n<p>Magistrate or the Investigating Officer and then seek regular bail<\/p>\n<p>in the ordinary course. I am unable to find any features in this<\/p>\n<p>case that can justify or warrant the invocation of the discretion<\/p>\n<p>under Section 438 Cr.P.C.\n<\/p>\n<p>      5.
