Case No. 95 of 2010 for the offences punishable<\/p>\n<p>                      under section 4\/5 of Explosive Substances Act and section<\/p>\n<p>                      17 of C.L.A. Act.\n<\/p>\n<p>                                     Learned counsel appearing on behalf of<\/p>\n<p>                      petitioner submits that petitioner is innocent and has been<\/p>\n<p>                      falsely implicated in this case only on the basis of the<\/p>\n<p>                      confessional statement of co-accused Krishna Kumar<\/p>\n<p>                      Sharma, who is arrested on the spot with explosive<\/p>\n<p>                      substance.\n<\/p>\n<p>                                     On perusal of the First Information Report, it<\/p>\n<p>                      appears that Krishna Kumar Sharma and Prabhu Tiwari<\/p>\n<p>                      was arrested on the spot with dumpher from which about<\/p>\n<p>                      1500 K.G. of explosive, recovered in three bags by the<\/p>\n<p>                      informant, who is police officials on reaching at the spot<\/p>\n<p>                      receiving secret information while two persons succeeded<\/p>\n<p>                      to flee away. Accused Krishna Kumar Sharma has<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>        disclosed the name of the petitioner who succeeded to flee<\/p>\n<p>        away.\n<\/p>\n<p>                     Under the facts and circumstances of this case<\/p>\n<p>        and nature of offence, I am not inclined to grant bail to the<\/p>\n<p>        petitioner.
