SANKARAN, J.\n                     ---------------------------\n                     B.A. No. 4884 of 2009\n                 ------------------------------------\n           Dated this the 14th day of September, 2009\n\n                            O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure.         The petitioners are the<\/p>\n<p>accused persons      in Crime No.333\/2009 of Kovalam Police<\/p>\n<p>Station.\n<\/p>\n<p>     2.    The offences alleged against the petitioners are under<\/p>\n<p>Sections 323, 324, 342, 354, 366 A and 372 read with Section<\/p>\n<p>34 of the Indian Penal Code.\n<\/p>\n<p>     3. When the Bail Application came up for hearing on<\/p>\n<p>26.08.2009, the following order was passed:<\/p>\n<blockquote><p>                &#8221; Heard the learned counsel for the<\/p>\n<p>          petitioners as well as the learned Public<\/p>\n<p>          Prosecutor.\n<\/p><\/blockquote>\n<blockquote><p>                It is submitted by the learned counsel<\/p>\n<p>          for the petitioners that the petitioners are<\/p>\n<p>          prepared to appear before the investigating<\/p>\n<p>          officer on any day fixed by this court.<\/p>\n<p>          Accordingly, there will be a direction that the<\/p>\n<p>          petitioners    shall    appear      before  the<\/p>\n<p>          investigating officer on 28.08.2009 and<\/p>\n<p>          29.08.2009 at 9 A.M.\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">B.A. No. 4884 of 2009              2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                 Post on 09.09.2009.\n<\/p><\/blockquote>\n<blockquote><p>                 It is submitted by the learned Public<\/p>\n<p>           Prosecutor that the petitioners will not be<\/p>\n<p>           arrested till then.&#8221;<\/p><\/blockquote>\n<p>      4.   It is submitted by the learned Public Prosecutor that in<\/p>\n<p>compliance with the order dated 26.08.2009, the petitioners<\/p>\n<p>appeared before the Investigating Officer and their statements<\/p>\n<p>were recorded.\n<\/p>\n<p>      5.   In the facts and circumstances mentioned above, I am<\/p>\n<p>of the view that anticipatory bail can be granted to the<\/p>\n<p>petitioners. There will be a direction that in the event of the<\/p>\n<p>arrest of the petitioners, the officer in charge of the police station<\/p>\n<p>shall release them on bail       on their executing bond for Rs.<\/p>\n<p>25,000\/- each with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the officer concerned, subject to the following<\/p>\n<p>conditions:\n<\/p>\n<\/p>\n<blockquote><p>        A) The    petitioners    shall    appear   before    the<br \/>\n           investigating officer for interrogation as and when<br \/>\n           required;\n<\/p><\/blockquote>\n<blockquote><p>        B) The petitioners shall not try to influence the<br \/>\n           prosecution    witnesses     or  tamper    with   the<\/p>\n<p><span class=\"hidden_text\">B.A. No. 4884 of 2009            3<\/span><\/p>\n<p>           evidence.\n<\/p><\/blockquote>\n<blockquote><p>        C) The petitioners shall not commit any offence or<br \/>\n           indulge in any prejudicial activity while on bail.<\/p>\n<p>        D) In case of breach of any of the conditions<br \/>\n           mentioned above, the bail shall be liable to be<br \/>\n           cancelled.<\/p><\/blockquote>\n<p>      The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                  K.T.
