The\n        allegation  against  the  petitioners  appears to be that\n        they had transported sand in violation of  the provisions\n        contained under the Act. However,  the  petitioners  have\n        raised  a definite contention that the transportation was\n        on the strength of passes issued by the  local  statutory\n        authority.\n        \t2.  It is not in dispute that  the  vehicles  are\n        now  lying  in  the  custody of the Police, though report\n        under Section 102 of the Code of Criminal  Procedure  has\n        been  filed  before  the court of competent jurisdiction.\n        The petitioners had filed application before the  learned\n        Magistrate  for  interim  custody of their vehicles under\n        Section 457 Cr.P.C.  The learned Magistrate rejected  the\n        plea  through  a  common order which is impugned in these\n        petitions.\n        \t3.   The   learned   Magistrate   dismissed   the\n        applications  since  according  to  him,  it would not be\n        proper to interfere with the jurisdiction of the District\n        Collector  who  has  reportedly  initiated  \"confiscation\n        proceedings\" as  contemplated under the Act.  The learned\n        Magistrate took the view that  the  two  conditions  laid\n        down  under  Section  457 of the Code were not satisfied.\n        In this connection the learned Magistrate placed reliance\n        on a decision of a learned Single Judge of this Court  in\n        <a href=\"\/doc\/178649\/\">Thimothy v.   State  of  Kerala<\/a>  (1987  (1)  KLT 82.  The@@\n        AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA\n        learned Magistrate went on to hold that since the  dictum\n        laid  down  in  the above decision was not \"over ruled or\n        distinquished, in the later decision in Rahim v.    State@@\n                                                AAAAAAAAAAAAAAAAA\n        of  Kerala  (2002  (3)  KLT  340)  the jurisdiction under@@\n        AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA\n        Section 457 of the Code cannot be invoked.  I am  afraid,\n        the  learned Magistrate has proceeded at a palpably wrong\n        tangent.\n        \t4.  In this context it is necessary to  refer  to\n        the  relevant  provisions of the Act which deals with the\n        power of the District Collector to deal with the vehicles\n        which are allegedly involved in illegal transportation of\n        sand.  Section 23 of the Act reads thus:\n        \n.............L..T.......T.......T.......T.......T.......TJ\n             \"23.   Confiscation  of  vehicles:-   Whoever@@\n                    AAAAAAAAAAAAAAAAAAAAAAAAAAAA\n             transports  sand  without  complying with the\n             provisions of this Act shall be liable to  be\n             punished   and   the  vehicle  used  for  the\n             transaction is  liable  for  seizure  by  the\n             Police or Revenue officials.\"\n........L.......T.......T.......T.......T.......T.......T.......J\n        The above provision only postulates that the vehicle used\n        for transportation of sand  without  complying  with  the\n        provisions  of the Act shall be liable for seizure by the@@\n                                                   CCCCCCC\n        Police or the Revenue Officials, apart from the  violator\n        being liable  for  punishment.  Though the heading of the\n        section indicates confiscation, the body of  the  section\n        refers only to seizure.\n        \t5.   Rule  27 of the Rules also does not refer to\n        any power of confiscation, though the heading of the rule\n        is otherwise.  Rule 27 reads thus:\n..............L.T.......T.......T.......T.......T.......T.J\n              \n              \"27. Procedure for confiscation of vehicle:-@@\n              AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA\n              (1)  The  Police  or  Revenue officials shall\n              seize the vehicle used for transporting  sand\n              in violation of the provisions of the Act and\n              these Rules.\n              \n              (2)  In  the case of seizure of vehicle under\n              sub-section (1), a mahazar shall be  prepared\n              in  the  presence  of two witnesses regarding\n              the vehicle and one copy of the same shall be\n              given to the person possessing the vehicle at\n              the time of  seizure  and  one  copy  to  the\n              District Collector.\n              \n              (3) The vehicle may be returned if the  owner\n              of  the  vehicle  or  the possessor remits an\n              amount towards River Management Fund equal to\n              the price fixed  by  the  District  Collector\n              with fine within seven days of seizure.\"\n........L.......T.......T.......T.......T.......T.......T.......TJ\n        \n        Sub-rule (3) of Rule 27 postulates that the vehicle may be\n        returned to its owner, if  he  or  the  possessor  thereof\n        remits  an amount towards the River Management Fund, equal\n        to the price fixed by the  District  Collector  with  fine\n        within 7  days  of seizure.  \n        \t6.   A  conjoint reading of Section 23 and Rule 27\n        undoubtedly shows  that  the  District  Collector  is  not\n        vested with the power to confiscate a vehicle.  It is true\n        that  the District Collector can recover from the owner of\n        the vehicle an amount equal to  the  price  fixed  by  him\n        towards the  River  Management  Fund.   But the vehicle is\n        liable to be returned to the owner if he remits the amount\n        fixed by the District Collector.  Thus it is evident  that\n        the  Legislature  never  intended to invest any power with\n        the District Collector for confiscation of a vehicle, even\n        if  it  is  found  to   have   been   used   for   illegal\n        transportation of  sand.    \n        \t7.   Confiscation  is  \"the  seizure  of   private\n        property  by  the  Government  without compensation to the\n        owner, often as a consequence of conviction for crime,  or\n        because  possession or use of the property was contrary to\n        law\" (Black's Law Dictionary, Sixth Edition).    The  term\n        \"seizure\"  implies taking or removal of something from the\n        possession, actual or constructive, of another  person  or\n        persons.\" (ibid)\n        \t8.    I  have  referred  to  the  above  statutory\n        provisions in the Act and the Rules only to indicate  that\n        the  power  vested  with the District Collector is only to\n        impose on the owner a liability to pay an  amount  towards\n        River Management  Fund.    However, the learned Magistrate\n        seems to have proceeded as though the  District  Collector\n        is vested  with  the  power to confiscate the vehicle.  He\n        has mentioned in the order that the District Collector has\n        reportedly initiated \"confiscation proceedings\".   But  as\n        noticed  earlier, the Collector does not have any power to\n        order confiscation.  His power is confined to recovery  of\n        amounts towards the River management Fund.  In any view of\n        the  matter,  it  is clear that if a report of seizure has\n        been made by the Police before the Court under Section 102\n        Cr.P.C, the court is empowered to deal with it as provided\n        under the Code.  However, the release of  the  vehicle  by\n        way  of  interim  custody to its owner shall be subject to\n        the proceedings contemplated under section 23 of the  Act,\n        read with Rule 27 of the Rules.\n        \t9.    Having   heard   learned   counsel  for  the\n        petitioners  and  the  learned  Public  Prosecutor,  I  am\n        satisfied that the petitioners are entitled to get custody\n        of  their  respective  vehicles  under  Section 457 of the\n        Code.  The learned Magistrate shall release  the  vehicles\n        to  the petitioners on appropriate conditions based on the\n        value of the vehicles, with two sureties in the like  sum.\n        Petitioners  shall  also  file affidavits before the court\n        below undertaking to produce  the  vehicles  as  and  when\n        directed  and  also not to transfer, alienate or dismantle\n        the same till the proceedings are completed.  It  is  made\n        clear  that release of the vehicles will be subject to the\n        proceedings pending before the District Collector  or  any\n        other authority under the Act and the Rules.\n        \tCrl.M.Cs are disposed of in the above terms.\n        \n.SP 1\n        \n        \n        \t\t\t\t\tA.K.
